That permission and authority are hereby granted to Lloyd H. Ueeker to construct and thereafter ma.intAin at no cost to the City of Saint Paul a private sewer connection to a private sewer owned by the Department of Parks, Recreation and Public Buildings in Carroll Avenue and across City of Saint Paul property located within the area of - vacated Carroll Avenue between Lexington Avenue and Oxford Street, the following described property -to be served by such sewer: a= a a. 0 Northerly 47.32 feet of the southerly 97.32 feet of Lots 12, 13 and 14 in Block 2 except that part taken for Lexington Parkway in G. V. Bacon's Subdivision of Lots 11 and 12 in Buel and Mackubints Outlots to St. Paul The South fifty (s. and Thirteen W), , Lot Fourteen thereof, Block Two of Lot Eleven (11) to St. Paul. 50) feet of Lots Twelve (12) and _South fifty (s. 50) feet-of except the West seven (7) feet (2), G. V. Baconts Subdivision, of -Buel and Mackubints Outlots Sec. 2. Tit the construction of said sewer shall be in compliance with the following condition: a 1. Said permittee -shall construct said sewer entirely at its own expense, under the supervision and to the satis- faction of the Commissioner of Public Works. 2. Said permittee shall pay the cost of publication of this ordinance. a 3. Said permittee shall properly protect all excavations " made in the .street and on said public property both day and night so as to avoid all damage or injury to person or property; said permittee shall properly fill "and tamp said street and public property to avoid settling, and shall restore said street and public property to its original condition. 4. Said permittee expressly agrees and undertakes to fully indemnify and hold harmless the City of Saint Paul, its agents, officers, and employees from any and all damages, claims, losses, judgments, suits, or expenses arising out of or occasioned by its perform - ance of the work contemplated by this permission and ' authority. 6. Said permittee shall furnish a bond to the City of Saint Paul in the sum of Ten Thousand Dollars ($10,000.00) conditioned to comply with all the terms of this ordi- nance and to indemnify and save harmless said City from all liability, loss, judgments, suits, costs, charges, damages or expense that may accrue to person or property occasioned by the making of the improvement or arising out of same. 7. Said permittee shall, within 30 days after the passage of this ordinance, file a written acceptance thereof with the City Clerk. I - r Sec. 3.
