THIS IS AN EMERGENCY ORDINANCE RENDERED NECESSARY FOR THE PRE- SERVATION OF THE PUBLIC PEACE, HEALTH AND SAFETY. THE COUNCIL OF THE CITY OF SAINT PAUL-DOES ORDAIN: Section 1. That the Zoning Code, Chapters 60 to 64r; inclusive, of the Saint Paul Legislative Code, pertaining to Use Districts, Height Districts, and Rezoning of certain pro- perties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following des- cribed property from "Ali Residence District to 11C71 Residence District, to -wit: "Lots 20 and 21, Cottage Homes -" situated on the southeast corner of Western and Cottage Avenues, in Saint Paul. Section 2. That as a condition precedent to the issuance of any City of Saint Paul Building Permit for the erection of a multiple family apartment building on the hereinabove described premises, the owner of said premises or his successors or assigns, in respect of the same, shall exhibit the plans and specifications for any such development of said premises to and confer with the Technical Staff of the Board of Zoning, thereon, such exhibition and conference to be confirmed by the pertinent Certificate of the Recording Secretary of said Board of Zoning and the filing of the same with the Commissioner of Parks and Recreation and Public Buildings. Section 3. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health, and safety. Section 4. This ordinance shall take effect and be in force upon its passage, approval and publication. Gerber Jr. City Clerk Building Dear Sir: This is in the matter of the petition of John J. Sullivan to rezone from "A" to, "C" residence property located at the southeast corner of Western and Cottage Avenues which is described as Lots 20 and 21, Cottage Homes. Addition. On April 21, 1964, the Commissioner of Finance reported the petition "sufficient with the owners of '7 of a possible 9 (77.77%) tracts of land within the prescribed 100 foot radius having signed the petition. The subject property consists of two large platted lots which have a combined frontage on the south -side of unimproved Cottage Avenue of 625.36 feet and a frontage on the east side of Western Avenue of 580.8 feet resulting in an area of approximately 325,437 square feet, or 7.5 acres. A topographic map of the subject property submitted by the petitioner and dated March 1963, indicates that the present elevation of the property varies in elevation from 147 to 194 feet, or a variation \� of 46 feet. The Board of Zoning considered this matter at its regular meeting on June 4, 1964. The staff reported that the surrounding area consisted primarily of undeveloped land with the exception of a few scattered ` single - family residences. Because of the topography of the site, it would not lend itself to single - family development. The staff also reported that a conference had been held with the petitioner relative to the placing of the buildings, the off- street parking facility and the necessity for grading and-surfacing the adjoining Streets. Mr. Sullivan agreed to confer with the staff before proceeding with the development of the property. After discussing the matter, the Board of Zoning voted to approve the petition to rezone the above described pro- perty to a "C ", residence district subject to the petitioner conferring with the staff prior to the development of the site.
