An Ordinance amending the Zoning Code,
Chapters 60 to 64 inclusive, of the Saint
Paul Legislative bode, pertaining to Use
Districts, height Districts and Rezoning of
certain properties in the City of Saint Paul,
as amended. This is an emergency ordinance
rendered necessary for the preservation of the
public peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64,
inclusive, of the SaintmPaul Legislative Code pertaining to Use
Districts, Height Districts,-and Rezoning of 6ertain properties
in /the City of Saint Paul, as amended, be and the same is hereby
"'further amended so as to rezone the following described property
from "All Residence District to "C" Residence District, to -wit:
"Lot 19, Cottage Homes ;"
situate on property located at the southwest corner of
Western and Cottage Avenues in the City of Saint Paul; subject,
however, t6 -the following express condition:
(a) the proper vacation of 'Western Avenue and further
the dedication to the City of Saint Paul, for
street purposes, easterly 33 feet of Lot 21
and the west 38 feet of the east 71 feet
of the south 105 feet, Lot 21, Cottage Homes,
Section 2. That the conditions of this Ordinance
must be approved and accepted by the petitioner kithin 30 days
of its first publication.
Section 3. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.,

PETITION TQ REZONE
A petition having been flled request-
ing that Chapters 60 to 64 inclusive,
St. Paul Legislative Code, re Zoning,
etc., be amended so as to rezone rop-
erty described as Lot 19, Cottage Homes
Addition, at the southwest corner of
Western and Cottage Aves., to Class
"C" Residence District, the Council of
the City of Saint Paul has fixed the
14th day of January, 1965, at ten
o'clock in the forenoon in the Council
Chamber in the City Hall of said City,
and at said time and place, the Council
will hear all persons and all objections
and recommendations relative to said
proposed amendment.

Council File No. 2218+0, but respectfully request Your Honorable
Body to amend the said ordinance, so as to delete that portion re-
quiring the vacation of Western Avenue, as revised plans prepared
for the development of this and adjacent property, which have been
reviewed and approved by Department of Public Works engineers and

Dear Sir:
This is in the matter of the petition of Lorence E. Johnson to rezone
from "A" to "C" residence district property located at the southwest
corner of Western and Cottage Avenues which is described as Lot 19.'
Cottage Homes Addition.
On November 18, 1964, the Commissioner of Finance reported tbe.petition
sufficient with the owners of 6 of a ,possible 8 (75%) tracts of land
within the prescribed 100 foot radius having, signed the petition. The
site is presently vacant and it is proposed to vacate unimproved Western
Avenue which adjoins the subject.property to the east for the purpose of
consolidating the subject property with Lots 20 and 21,Cottage Homes,
located on the east side of Western Avenue which was recently rezoned
to "C" residence. The combined tracts would then be--developed for apatt-
went use.
The Board of Zoning considered this Matter at its regular meeting on
December 17, 1964. The staff reported.tbat this petition had been re-
viewed with the Public Works Department in regard to the proposed vacation
of Western Avenue, and it is the recommendation of the staff and the
Public Works Department that the rezoning of the above described pro-
perty and the vacation of Western Avenue be subject to the dedicating to
the City of St. Paul for street purposes the easterly 33 feet of Lot 21,
and the west 38 feet of the-east 71 feet of the south 105 feet, Lot 21,
Cottage Homes. The staff reported further that, subject to the vacation
of Western Avenue, the•proposed rezoning would be ari extension of the
existing "C" Residence zoning,to,tbe east, and it did not appear that
it would have a detrimental effect on the adjoining properties.
In consideration of the above factors,'the Board of Zoning recommends
the granting of the petition to'rezone the above described property to
a "C" residence district subject to dedicating that portion of Lot 21,
Cottage Homes for street purposes as described above.
