That the Zoning Code, Chapters 60 to 64, inclusive of the Saint Paul Legislative Code, pertaining to Use Districts, Height Districts and Rezoning of certain pro- perties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following des- cribed property from "B" Residence District to "C" Residence District, to -wit: "Lot 6, except the north 10 feet thereof Block 112, Lots 8, 99 10, Block 125, West St. Paul Proper and would now, in effect also include that part of recently vacated Elizabeth Street which adjoins Lot 6, Block 112 and Lot 10, Block 125, Wiest St. Paul Proper;," situate on property located on the west side of South Robert Street at vacated Elizabeth Street in the City of -Saint Paul, Sec. 2. This Ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Sec. 3. Hathaway et al to rezone certain properties from "!B" to "C" residence district which are located on the west side of South Robert.Street at vacated Elizabeth Street. The subject property is described in the petition as Lot -6 ex. the north 10 feet thereof, Block 112, Lots 8, 9, 10, Block 125, West St. Paul Proper and would now, in effect, also include that part of recently vacated Elizabeth Street which adjoins Lot 6, Block 112 and Lot 10, Block 125 West St. Paul Proper. On December 16, 1964, the Commissioner of Finance reported the petition sufficient with the owners of 12 of a possible 18 (66 2/30) tracts of land within the prescribed 100 foot area having signed the petition and therefore qualifying for Council consideration. The site is pre- , sently vacant and for the most part has recently been graded to the elevation of South Robert Street upon which it fronts. As stated in the petition, it is proposed to develop the site with a 22 unit apart- ment building. The Board of Zoning considered this matter at its regular meeting on January 7, 1965 and after hearing the petitioner and the Planning Board staff report, concluded that because the property fronted on Robert Street which is a trunk highway, that the proper use of this property would be multi- family residential development.
