That the Zoning Code, Chapters 60 to 64 inclusive, of the Saint Paul Legislative Code, pertaining to Use Districts, Height Districts, and Rezoning of certain properties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following described property from "B" Residence District to "C" Residence District, to -wit: Lots 21, 22, 23, Block 7, Como Park 3rd Addition, according to the plat thereof-on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota, being located on the easterly side of North Como Boulevard west of North Avon Street. Section 2. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 3. On November 22, 1963, the Commissioner of Finance reported the petition sufficient with the owners of 11 of a possible 13 (84.61 %) tracts of land within the prescribed 100 foot radius having signed the petition. The subject property is level and at the street grade of Como Boulevard. As stated in the petition, it is proposed to use the site as an entrance driveway to a larger tract recently rezoned to t1C" residence district for which there is no street frontage. A plot plan submitted by the petitioner also indicates parking for 11 cars on the site, The Board of Zoning considered the matter at their regular meeting on December 19, 1963. It does not appear that the proposal would have a detrimental effect on the residential uses on Como Boulevard in this block, and it would provide the petitioner with his only means of ingress and egress for his proposed apartment development to the north.
