PRESENTED BY MILTON ROS � /lam' ORDINANCE NO. 0 An ordinance granting permission and authority to the Village of Vadnais Heights to discharge the sewer systems of said Village of Vadnais Heights to -the public sewer system of the City of Saint Paul and thereafter maintain and operate the same as an outlet for said sewer systems of said Village for sewage conveyance and disposal purposes, and providing applicable terms and conditions. The Council of the City of Saint Paul Does Ordain: SECTION I That the Village of Vadnais Heights hereby is granted permission and authority, subject to all of the terms and conditions hereinafter expressed, to discharge the contents of the sewer systems located within said Village, into the public sewer system of the City of Saint Paul, said discharge point being a Minneapolis, St. Paul Joint Interceptor manhole located in Commercial Street approxi- mately 700 feet east of East 3rd Street, and said discharge point to be used by said Village for the expeditious, convenient, and effective conveyance and disposal of sewage entering sewer systems located within said Village. That the authorized area in said Village of Vadnais Heights to be served by this ordinance shall be as follows: Commencing at the intersection of the Northerly shore of Twin Lake where the dividing line between Lots 6 and 7 of Vadnais Lake Villas, produced, would intersect the shore of said lake, thence North 400 East along said produced line, 22 feet to the intersection of said line with the Westerly line of land belonging to the Board of Water Commissioners of the City of Saint Paul; thence running North 650 40, West along said Westerly line, 504 feet to a stake; thence running North 490 451 West along said Westerly line 1823 feet to the Easterly line of the right -of -way of the St. Paul Waterworks conduit line; thence South 400 20' West along the Easterly line of said right -of -way, 831 feet; thence South 250 West 320 feet • thence South 820 101 East 1150 feet; thence south 590 �5' East 953 feet to a post in Twin Lake, thence North 720 15' East 565 feet to said point on the North shore of said Lake, the place of beginning, except that portion thereof, which lies South of Lake Owasso Boule- vard and the North shore of said Twin Lake, containing 3.1 acres, more or less, and which heretofore has been conveyed by the said Swan A. Carlson and Mathilda Carlson, to Lake Vadnais Gospel Tabernacle, recorded in Illo44" Deeds 75, all being a part of Government Lots 2,3, and 4 and of the NW'J of SEV of Section 311 Township 30, J. SECTION 2 That the Village of Vadnais Heights shall completely pump each day any holding tanks designed for temporary storage of sanitary sewage wastes and located within said authorized Village Limits. Said raw sewage to be trucked into said City shall be carefully discharged into the City manhole to prevent spillage onto street surfaces. That the Village of Vadnais Heights shall discontinue said raw sewage trucking into said City and cause a direct con- nection to the planned jointly -used sanitary interceptor facili- ties identified in the METROPOLITAN ST. PAUL SANITARY SEWER REPORT (Engineering) as soon as these sanitary interceptors are available for use. SECTION 3 That the Village of Vadnais Heights as part of its Obligation hereunder, shall pay to the City of Saint Paul the sum of $8.00 per year for each single family dwelling, two family dwelling, governmental building, church, or schoolhouse sewer connection existing at the time of the connection of said sewer systems hereinunder or thereafter made, to the said sewer system of -the Village of Vadnais Heights; for each other residential, commercial; industrial, or other sewer connection classification not listed, existing at the time of the connection of said sewer systems hereunder-or thereafter made to the sewer system of the Village of Vadnais Heights, the Village of Vadnais Heights shall pay to the City of Saint Paul an annual charge to-be determined by the Council of the City of Saint Paul, by resolution, on the basis of relevant factors including, among others, in respect of commercial or industrial property or other sewer connection classification not listed, in each instance, the character and daily volume of industrial sewage waste involved and, therefore, for this purpose, the Village of Vadnais Heights shall be obli- gated to furnish upon request of the City of Saint Paul, all such data to be collected in each instance at the sole expense of the Village of Vadnais Heights, provided that such annual charge for each such connection shall be the substantial equivalent of the amount charged through taxation to properties of similar value 'located within the limits of the City of Saint Paul, but in no event less than $8.00 per year, and the same shall be subject to adjustment from time to time by the Council of the City of Saint Paul. That the Village of Vadnais Heights, as part of its obligations hereunder, shall pay to the City of Saint Paul, in addition to the aforesaid annual charges, annual sewer rental, charges in accordance with the current schedule for sewer rental charges of similar service applicable to property within the City of Saint Paul, and computed, assessed and levied at the rates and upon the bases of the following schedule of annual sewer rental charges according to the size of'the, water service meter installed and operated or determined as required to be installed and operated for each separate property that shall be connected with said sewer 2. both water meter and individual well in accordance with the above schedule'of annual sewer charges except when such private water supply is used for irrigation purposes only. That such schedule shall be deemed conclusively reflec- tive of the employment of the aforesaid relevant factors -in con- trolling for all purposes of the prescription hereunder. That in no such instance shall the determined and employed applicable annual sewer rental charge represent less than that here - inabove scheduled and made applicable to property which shall be connected with the Village of Vadnais Heights sewer system and equipped with ar5 /8 inch size water service meter. That the words "mobile home" when used herein shall mean any vehicle used or so constructed as,to permit its being used as a conveyance upon the public streets or highways•and shall include self - propelled vehicles as designed, constructed, reconstructed or added to by means of an enclosed addition or room in such manner as will permit the occupancy thereof as a dwelling or sleeping place for one-or more persons, having no foundation other than wheels, jacks, skirtings or blocks. 'The words "mobile home park" when used herein shall mean any site, lot, field, or tract of land upon which two or more occupied mobile homes are harbored either free of charge or for revenue purposes, and shall include any. building, structure, tent, vehicle or enclosure used or intended for use as part of the equipment of such mobile home park. That despite any contrary provision hereinabove or hereinafter con- tained, in each instance of the existence of any such mobile home park and the connection of the same for sewage,drainage purposes by single sewer service' connection with the public sewer system of- said Village of Vadnaia Heights,or to the "sewer system de—scribed, in je,ctfaa:Jrhereof, such drainage shall be restricted to the sani- tary sewage which shall originate therein,• and the "annual #.charge "' hereunder therefor shall represent that computed on.the basis and. at the rate of $5.00 per. "mobile home" therein, and the "annual sewer rental charge".-hereunder therefor shall represent that com- puted on the basis and at the rate of $5.00 per "mobile home" therein. -, }. That the Village of Vadnais Heights, asµpart of its :o:bligation hereunder, shall, at its own cost and expense, collect andreompile -all requisite data and deliver its written certifica- tion, from time to time, unto the City of Saint Paul, as to the reasonable capacity of -each such private water supply pump at pressure of 40 pounds per square inch. That the first-such certi- fication shall be made and delivered by the Village of Vadnais Heights to the City of Saint Paul within 60 days next after such connection of said sewer systems and subsequent certification for similar purpose shall be made and delivered by the Village of - R' Vadnais Heights to the City of Saint Paul as shall be required, to.,the end that the latter shall be- advised currently in the premises. That in respect of property which shall be connected with the Village of Vadnais Heights sewer system for the discharge and disposal of industrial sewage waste, additional to aforesaid applicable annual sewer rental charge, and additional to all other applicable charges hereunder, the City of Saint Paul hereby reserves the right to impose such supplemental sewage volume rate charge for payment by the Village of Vadnais Heights as-the Council of the City of Saint Paul shall determine as reasonable and warranted and shall prescribe for payment by the Village of Vadnais Heights of such supplemental charge to the City of Saint Paul. t, 4. WHEREAS, the City of Sai_rit Paul, Ramsey County, Minnesota, has heretofore, by Ordinance No. 13085, approved November 2, 1965, granted permission to the Village of Vadnais Heights to connect its sewer system to the sewer system of the City of Saint Paul, upon and subject to theprovisions, terms and conditions therein set forth, said Ordinance No. 13085 being, by reference thereto, hereby incorporated herein and made part hereof with the same intent, purpose and effect as if said Ordinance No. 13085 were set forth herein verbatim; NOW, THEREFORE, THE VILLAGE COUNCIL OF VADNAIS HEIGHTS DOES HEREBY ORDAIN: ' • Section 1. That the Village of Vadnais Heights does hereby accept and agree to abide by all the provisions, terms and condi- tions set forth in Ordinance No. 13085 of the City of Saint Paul, Ramsey County, Minnesota, approved November 2, 1965. _ Section 2. That this acceptance and agreement expressly applies only to the area of Vadnais Heights specified in Section 1 of Ordinance No. 13085 of the%City of Saint Paul, as spelled out in Section 4 of said ordinance, including the rates set forth in Section 3 of said ordinance, which apply only to the specified area.
