This is an-,emergency ordinance rendered necessary for the preservation of the ' public peace, health and safety. i THE COUNCIL OF ]HE CITY OF SAINT PAUL DOTES ORDAIN: Section 1. That the Zoning Code, Chapters 60 to 64, inclusive, of the Saint Paul Legislative Code, pertaining to Use Districts, Height Districts, and Rezoning of certain properties in the City of Saint Paul, as amended; be and the same is hereby further amended so as to rezone the following described property from "B" Residence District to "C" Residence District, to -wit: - -� Lots 1, 2, 3, 4, except the south 30 feet thereof, Block 3, Soderberg's Addition; situate on property located at the southwest corner of Maryland Avenue and Cumberland Street in the City of Saint Paul. ' Section 2. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 3.. Soderberg to rezone from "B" to "C" residence property located at the southwest corner of Maryland Avenue and Cumberland Street which is described as Lots 1, 2, 3, 4, except the south 30 feet thereof, Block 2, Soderberg Addition. On June 25, 1965, the Commissioner of Finance reported the petition sufficient with the owners of 10 of a possible 15 (66 2/3%) tracts of land having signed the petition. The Board of Zoning considered this matter at its regular meeting on July 15, 1965. The staff reported that the proposed apartment develop- ment would not be compatible with the existing area uses which are pre- dominantly single - family residences many of them recently constructed. The Comprehensive Land Use Plan indicates the highest and best use of the property would be R -3, single- family residences. After hearing the staff report and the-petitioner, the Board of Zoning discussed the matter and agreed that the proposed development would not be compatible with the existing area uses.
