OF CHARGES FOR THE USE OF THE SAINT PAUL MUNICIPAL STADIUM AND DETERMINING TO WHAT USES THE STADIUM SHALL BE DEVOTED AND REPEALING ORDINANCE NO. 11022, APPROVED JUNE 18, 1957, AS AMENDED. THIS IS AN EMERGENCY ORDINANCE RENDERED NECESSARY FOR THE PRESERVATION OF THE PUBLIC PEACE, HEALTH AND SAFETY. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. Under the direction of the Council, the Commissioner of Libraries, Aci _r � I D 1-f L( 10 $(d) For use for State High School Baseball 'Tournaments, 300.00 per tournament, plus 5% (five percent) of the gross receipts; said charge shall include day and /or night use as necessary to conduct said tournament. In addition to the foregoing charge, the user shall be required to pay for the public address announcer, scoreboard operator, ticket sellers, and takers, to the extent such personnel is desired. (e) For baseball games between teams of college level, the charge shall be $200.00 per day plus 5% (five percent) of the gross receipts. In addition, the user shall furnish or pay for attendant service. (f) For practice sessions for teams from high schools, secondary schools and colleges the charge shall,-.be $25.00 per session, not to exceed two hours. This shall include only daytime sessions. If sessions are conducted at night and the playing field lights are used there shall be an additional charge of $100.00. 2. For the use of the Stadium for football events: W teFor use by college teams, $250.00 per day, plusil0% percent) of the gross receipts. In addition, the user shall furnish all attendant service, or shall pay for such attendant service as shall be required. (b) For use by high schools or secondary schools, $100.00 per day plus 5% (five percent) of the gross receipts. In addition the user shall furnish or pay for attendant service. 3. Charges for other events except as hereinbefore provided, shall be established by resolution adopted by the Council, upon the recommendation of the Commissioner of Libraries, Auditorium,and Civic Buildings, and approved by the Council. 4. Charges for vehicle parking on the Municipal Parking Areas adjacent to said Stadium shall be 25¢ per vehicle per event conducted at the Stadium, except for such events where the Council may by resolution determine that a different rate should be charged, or that parking should be permitted free of charge. 5. Concession receipts shall belong entirely to the City, orE' to the City and to the organization operating the 1 224888 3• concessions under agreement with the City. Section 2. When the use of the Stadium is for a strictly public purpose, or of particular benefit to the general public and where no admission fee is charged, the Council may grant the free use of the Stadium for such performance or event. Section 3. Whenever in this ordinance the rental of the Stadium is provided for on the basis of a percentage of the gross receipts of any event, or on a fixed charge and a percentage of gross receipts of any event, the term "gross receipts" shall mean the total revenue received from the admissions charge, less any Federal; State or City amusement taxes, if any. Section 4. Whenever the free use of the Stadium is granted, the Stadium Fund shall be reimbursed from the Contingent Fund to the extent of the cost of opening and operating the Stadium for any such free use event. Section 5. The Director of the Stadium, under the direction of the Commissioner of Libraries, Auditorium, and Civic Buildings, may, in his discretion in the rental of the Stadium or any part thereof, require a deposit from the respective user which,in no case shall be less than the base use charge for such type of event as is hereinbefore specified, or as the Council may, by resolution, determine. Section 6. It shall be the duty of the Director of the Stadium, under the direction of the Commissioner of Libraries, Auditorium, and Civic Buildings, to execute a proper agreement in writing, signed by such person or persons and by the• "Commissioner of Libraries, Auditorium, and Civic Buildings on behalf`of the City of Saint Paul. Said agreement shall define the use for which the Stadium is hired, the price to be charged for same, and shall contain such additional provisions as are usual in agreements of this kind, including a provision for insurance coverage to protect and save the City harmless from all demands, claims, actions, causes of action, costs, etc. arising out of the use of the Stadi- um for such events. It shall also be the duty of the Director of the Stadium, under the direction of the Commissioner of Librar- ies, Auditorium, and Civic Buildings, to collect the forego ng charges when the use of the Stadium or any of its facilities shall be granted to any person or persons. � 7 - 'Original to city clerk. , ORDINANCE ✓ COUNCIL FILE NO. 22488 , PRESENTED BY ORDINANCE NO.-' 4 Section 7. Nothing herein contained shall be construed as affecting or changing the rates to be charged for the use of the Stadium or any part thereof now existing under contracts or commitments hereinbefore entered into by the City. Section 8. The various provisions of this ordinance shall be severable, and if any part or provision shall be held to be invalid, it hhall not be held to invalidate any other part or provision thereof. Section 9. That upon the effective date of this ordinance, Ordinance No. 11022, C. F. No. 183073, appproved June 18, 1957, as amended by Ordinance No. 12559, C. F. 21+703, approved October 3, 1963, be and the same hereby is repealed. Section 10. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 11. This ordinance shall take effect and be in force upon its passage, approval and publication.
