224840An ordinance amending Chapter 347 of the Saint Paul Legislative Code, as amended, pertaining to motor vehicle rentals. This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That Section 347.04 of the Saint Paul Legislative Code-, as amended, be and the same hereby is further amended by deleting the same and substituting in lieu and in place thereof the following: "347.04. Lessee shall be licensed. No licensee shall let or furnish any such motor vehicle to any person who is not licensed by the State of Minnesota to operate such vehicle, or, in the case of a non- resident, who is not duly licensed to operate such vehicle under the laws of the state or county of his residence. It is unlawful for a person to whom a motor. vehicle is rented, leased, or furnished to rent, sublease, or otherwise authorize the use of the motor vehicle to a person who is not licensed -by the State of Minnesota to operate such vehicle. Before letting, leasing or furnishing aril motor vehicle to any person, the licensee shall make a _permanent and legible -- record containi_n the name, address and age of the person to whom the motor vehicle is leased, rented or let and shall record thereon the number and date of issue and expiration of the driver's license, together with the descrip- tion of the person as shown by the driver's license, and identify the vehicle leased or rented to the person by the motor vehicle license number issued by the State of Minnesota, together with the date or dates of such licensing. It is unlawful to let, rent or furnish any motor vehicle to any person under -the age of 18 years unless such person shall furnish and leave with the licensee a statement in writing showing the consent of the parent or guardian to the leasing or letting of the motor vehicle to such person. All records required by this section shall be kept for a period of not less than one year and shall at all times be open to inspection by the Police Department of the City of Saint Paul." Sec. 2. "347.05. Insurance Required. No such license shall be issued to any person, firm or corporation to engage in said business in the City of Saint Paul until the applicant shall obtain and file with the City of Saint Paul a policy of liability insurance, in an insurance company authorized to do business under the laws of the State of Minnesota. The lia- bility or indemnity insurance for each motor vehicle as in this chapter defined shall be in the amount of $25,000.00 for injury to or death of any one person in any one accident, $50,000.00 for injury to or death of more than one person in any one accident and $5,000.00 because of damage to or destruction of property in any one accident. The policy shall also contain a provision-, providing for at least $200.00 medical payments to cover the operator or passenger of such motor vehicle if persor.Bl: injury results to the operator or passenger from its use. Such policy shall be in such form that it shall provide for the payment of any judgment against the insured therein to the extent of the liability therein, obtained by any person injured in person or property by reason of any act of the owner, driver or any other person irl the.operation of said vehicle, and for the payment of any judgment obtained against the insured therein by any person injured or by the'representative of any person killed or injured by such act. Such policy shall have a condition that it cannot be cancelled after loss or without ten (10) days written notice to the City of Saint Paul; and in case of any cancellation the license herein provided for, issued .to'the person, firm or corporation whose policy is so cancelled, shall become by virtue of such can- cellation, inoperative and void, unless- another policy is forthwith issued, approved and filed in lieu of said cancelled policy. The policy shall also contain an endorsement to the effect that the liability under the policy is not affected by reason of any motor vehicle having been furnished to or rented or -leased by a minor. The Council of the City may require the said licensee to replace said policy of insurance if it deems said policy unsatisfactory or insufficient for any reason, and the default or refusal of said licensee to comply with any such order of the Council shall be grounds for revocation of the license of the person, firm or corporation so offending. Said policy shall be approved as to form by the Corporation Counsel and shall be filed with the City Comptroller. Page 3. Sec. 3. That Chapter-347 of the Saint Paul Legislative Code be and the same hereby is further amended by adding thereto the following: "347.07. Maintenance, Operating Instructions and Safety Helmets. The licensee shall maintain in a safe operating condition all motor vehicles rented, leased or furnished by him. The'licensee, his agent or employee shall explain the operation, including but not limited to, the controls, pedals, gears and brakes of the particular motor vehicle to be used before said vehicle leaves the premises of the licensee, unless the licensee, his agent or employee is aware that the person has sufficient knowledge of the operation of the particular motor vehicle. The licensee, his agent or employee shall call to the attention of the operator of any motorized bicycle, motor scooter, or motorcycle the precautionary measures that must be followed for the safety of the driver and the public, and shall make available and offer for the use of the driver of each of'said motorized bicycles, motor scooters or' motorcycles, a sanitized safety helmet or similar head gear." Soa. 4. This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Sec. 5. This ordinance shall take effect and be in force upon its passage, approval and publication.
