Section 64.06 of the Zoning Code as amended requires the Planning Board to conduct a public hearing on the proposed rezoning of which hearing published notice shall have been given in a daily newspaper of general -1- circulation at-least once each week for three successive weeks prior to such hearing. A number of proponents appeared and spoke in support of the proposal. After affording every one present the opportunity to be heard, the hearing was officially adjourned at 10:00 A.M. and the Board was to re- convene in Room 1315 to take action of this amendment. (A copy of the minutes of the Public Hearing held by the Board is attached and here- by made a part of this report as Enclosure W. i i The first item on the Agenda after the Board re- convened was the con sideration of the afore - described amendment to the Zoning Code which imposes height restrictions on certain property south of Kellogg Boulevard. The Board made a finding that a survey and study has been made of the whole area of the City of Saint Paul and of an area of not less than forty acres. A motion passed unanimously that the number of descriptions of real estate affected by such changes and alterations renders the obtaining of written consent impractical{ The Board then unanimously passed a motion that (a) the rezoning is reasonably related to existing land uses, (b) the proposed rezoning is reasonably related to the over -all needs of the community and (c) the proposed rezoning is reasonably related to the plan for future land use. This was held for the purpose of hearing opponents and proponets to the proposed amendment to the Zoning, Code which would restrict height of structures on the south side of Kellogg Boulevard. Present: Chairman Adam, Mrs. De oster, Messrs. Cohen, Dorle, Gadler, Haarstick, Janes, Mass0y, McPartlin, Neve, and Troy. Absent: Messrs Fischer, Schell; Whitcomb, and Wylie Also Present: Mr. Langland - St.I Paul Dispatch, Mr. Sheahan - Corporation Counsel's office, F. Schirmer, Messrs, Teig, Butz, Cosgrove, and Betz of the staff, and approximately 20 private citizens. Mr. Adam introduced the members of the Board and staff. Mr. Adam advised the purpose of the meeting was toldiscuss a new Zoning Code restricting., height of buildings on the south side of Kellogp Boulevard between St. Peter and Sibley Streets. Mr. Adam advised the three necessary publications of notice of the Public Hearing had been ma4e. Mr. Teig gave a brief resume of the history of Kellogg Boulevard incl ding plans for its development and the height regulations as imposed by he Zoning Ordinance adopted in 1922 and amended in 1929. Shippee, Executive Director of the Housing E Redevelopment Auth city stated the matter had been considered at their June 11 meeting and that t}e Authority was in favor of it as being in the interest of the communityland the specific interest of the Dovmtown Redevelopment Plan. The Authority endorses the proposed ordinance on restriction of heights on the land south of Kellogg Boulevard. Mr, W. E. Rumble, President of 1411I.C., stated he was speaking as a citizen of Saint Paul and did not have specific authorization of his Board of Dir- ectors though he felt -they were unanimously in favor of the amendment. He stated his committee had been wo7king approximately three years on the de- velopment of the Downtown, rough�y the area from Seventh to Kellogg, and Sibley to Wabasha, and now are reaching the crucial steps in the Downtown program and it is very important that no action be taken that might impair the plans for the development oflthe area and that action be taken wherever possible which will make it easier and better for development of that area. It is vital to the development ofd that area that an unobstructed view of the River and of the land across the;River from Kellogg Boulevard be preserved. It is vital that the original boulevarding and parking plans for Kellogg Boulevard be carried out. That plan contemplated a park area south of Kellogg Boulevard in the area mentioned. With the plans for substantial new construction in the Downtown rea, the height restrictions south of Kellogg is going to be one of the strongest arguments to induce developers to come into the area. The park spect of this particular area was, and is, vitally important. The economic �nd aesthetic situations are vital to the result that may be reached today }}`f the amendment of the ordinance is re- commended. This will benefit all the citizens of Saint Paul and not only those persons interested in M.I.C1 or the Downtoum. Persons living in the suburbs also will be directly affgcted and will benefit from the amendment. The next speaker for the amendment) was Mr. Louis Lundgren, Chairman of the Architect's Counseling Committee of M.I.C. He commended the Planning Board for presenting this amendment and felt the Architect's Committee as a whole was in favor of it. He felt this would benefit the entire City and should not be allowed to be developed in any fashion other than this. Mr. Fisher of H. & Val Rothschild Las the next speaker in favor of the amendment. He stated he was speaking for the Rothschild business who handled the Degree of Honor Building and the Guardian Building. There were decidedly in favor of the restriction as when the Degree of Honor Building was developed they understood that the air right' south of Kellogg; Boulevard would be pre- ? served. The next speaker was Mr. Axelrod of the Auto Club on Kellogg Boulevard. He felt the view should be protected �nd that this was the attitude of the entire City. This benefitted also the tr4vellers coming, into the City. Mrs. Richard Russell, President of the Y.W.C.Ao stated when they built their present building they had the view of the Mississippi River in mind and wished it preserved. They feel this is o e of the advantages to the City of Saint Paul. Many people in Saint Paul, the community, and out of the City use the building and admire the view. (They have a membership of 18,000. The view enhances the value of the property. 4- Ir r The next speaker was Mr. Herbert B�'utow, President of the Chamber of Commerce. The Directors were info mally polled and all were in favor of the amendment. They felt Third Street (Kellogg, Boulevard) should be maintained as originally intended hich was as a Mall. They believe Kellogg Boulevard could well becom the "Michigan Boulevard" of Saint Paul and are very much in favor of the amendment. Mr, Altman representing, the Hilton �otel interests, stated they selected the site on Kellogg Boulevard for t} a flow of traffic and the magnificent view and would like to have it pres rved, Mr. W. J. Hickey of the Athletic•Clu stated the Summit Room was constructed with the view of the River in mind a�d they agree with the Planning Board in presenting, this plan. The last speaker was Mr. Dick Radman of the Trades & Labor Union who stated no official action had been taken by his organization but he felt if it was presented they would certainly go•alonp with the amendment. I i The City Council resolution proposes the re- establishment of building height limitations in certain portions of Height District III (first paragraph of precedinI description) and certain portions of Height District IV (second I paragraph of preceding description). The original Zoning Ordinance, adopted in 1922, set forth building height restrictions it each of four Height Districts. The geographic limits of these districts were set forth on the Zoning Map, which became a part of the Ordinance, and can be approximately described as follows: Height District IV: the Central Business District core, roughly bounded by Second Street Sibley Street, Seventh Street, and St. Pbter Street. -2- Height District III: the Central Business District fringe9 generally that area surrounding the core and extending, to Broadway Street on the east, Telth Street on the north, Main Street, Seven Corners and Kellogg gg Boulevard I on the west, and the area between Second Street and the River on the south, l Height District II: the area surrounding the C.B.D. fringe, ex- tending generally to Mounds Boulevard on the east, fourteenth Street and the State Capitol on the north, and Rice Street, the Cathedral, St, Luke's Hospital area and Irvine Park area on the west and south- west; also the Midway industrial and commercial areas, the Harriet Island industrial area; 11 University Avanue frontage; and short sections along Snelling :venue, West Seventh Street, Rice Street, and Mississippi Street. I Height District I applies to all other areas of the City not in Height Districts II, III,ior IV. In 1929 the City Council rescinded the restrictions set forth for Height Districts III and IV, though the Districts themselves remained a part of the Orlinance. Thus, the current Zoning Ordin- ance provisions for Sections 61.04 and 61.05, dealing with Height Districts III and IV respactively, reads: "There shall be no re- strictions as to the height to which any building or structure may be erected. . . . . . ." C. The amendment to the Zoning Code under consideration deals with that portion of Height Districtl III bounded by St, Peter Street, Second Street, Sibley Street, and the Harbor Line of the Mississippi River. Additionally, the amendment is concerned with a portion of Height District IV, that portion immediately adjacent and north of the portion of Height Dist�ict III under consideration, and bounded by the centerline of Kellogg Boulevard, Sibley Street, and Second Street. The amendment divides the subject portion of Height Dis- trict III into four sections each with a different maximum building g height limit, these limits being determined in such a way that no building, constructed inIlany of these sections will rise higher than the established grade of Ke logg Boulevard. In precisely the same manner, Height District IV is divided into four sections, so that sections 1, 2, 3, and 4 in both Height Districts III and IV have corresponding restrictions. The established grade of Kellogg Boulevard can be con- sidered in terms of the established elevation at the intersection of the centerline of Kellogg with the centerline of the streets which cross it; these are as f�llows: at Kellogg and St. Peter: 93.41; at I Kellogg and Wabasha: 94.11; Kellogg and Cedar: 93.61; Kellogg and Minnesota: 76.21; Kellogg and Robert: 62.6'; Kellogg and Jackson: 45.51; Kellogg and Sible : 25.91. These elevations and all other street grades in the City are measured from a zero point known as the City Datum, which is 694,58 feet above sea level. However, paragraph "f" of Section 61.06 readss "None of the provisions or restrictions of Section 61.06 shall apply to govlern or restrict the erection of buildings in Height District III or Hiipht District IV." The proposed amendment in no way alters or changes this paragraph, thus precluding the con- struction of any portion of a building higher than the proposed limits by virtue of decreased bilk or by virtue of the nature of the con- struction. The proposed 'amendment further stipulates that Section 63013 of the present Ordilnance$ which deals with the method of deter- mination of building height, shall not have any application to the erection of any building fn Height District III or Height District IV. The non - application of Section 63.13 is intended to insure that the height of any proposed structure in the subject Height Districts will be determined solely by mJ,asurement from the elevation of City Datuma 1 -5- II. Planning Board Considerat The Planning Board, in it deliberations on this proposed amendment to the Zoning, Ordinance, must make certain findings and recommendations, as set forth in Section 641.06 of the 'Zoning Ordinance; these are as follows: le The Planning Board should consider whether a survey of the whole area of the City of Saint Paul or of an area not less than forty acres has been conducted by the Board, within which the proposed area to be rezoned is located. 2. Consideration must be given as to whether the number of des- criptions of real estate affected by such changes and alterations render the obtaining�of written consent impractical.' 3. A finding must be made on one of the following three alternatives: (a) The proposed reloning is related to existing land uses; (b) The proposed reloning is reasonably related to the over -all needs of the co unity; (c) The proposed rezoning is s reasonabl y r el ated to a plan For future land use. I aStudy Findings Data pertinent to each of the th ee Planning Board considerations (II - 11 2, 6 3) follows: I A. A survey of the whole area of the City of Saint Paul has been made in the form of the Comprehensive Plan for Saint Paul, adopted by the Planning Board on April 19, 19634 Community Plan Report 14 entitled 6- 0 "Saint Paul's Cen ment" adopted by pertinent study, Business District, A Concept for Its Develop- Planning Board on March 8. 1963 is another the Central Business District area, an area of which the subject property is a part. The C.B.D. Study examines the current situation in the downtown area, and also makes proposals for future development and redevelopment of various areas of the C.B.D., inclu ing the subject properties and properties directly affected by the subject properties. The points made in the C.B.D. report as they relate to the proposed zoning amendment wiil be discussed later in this report. B. Consideration has beep given to the number of descriptions of real CO estate affected by thb proposed rezoning. In a letter dated April 21 1964, the office of the Commissioner of Finance reported that within a 100 -foot radius of the subject property there are 33 property des- criptions. A compilation of 58 typical rezonings approved by the City Council since July, 1962 reveals that there was an average of 17.7 property descriptions involved in these cases, with only three of the 58 involving mode than 30 descriptions, In view of the fact that there are 33 prop�rty descriptions involved in the present case, it appears that this n�mbar of descriptions of real estate affected by the proposed zoning amendment renders the obtaining of written consent impractical. It seems likely that of irmative findings readily may be made on all three of the alternativ,s noted in item II -3(a), (b), and (c) above. -7- - i 1. Finding: that land use. proposed rezoning is related to existing Photographs taken many�years ago on file in the Planning Board office give vivid testimony to the chaotic and ugly development that existed between Second {and Third Streets and below Second Street on the southern edge of the I C.B.D. The total clearance that took place and the resultant devellpment of Kellogg Boulevard was designed not just to up -grade the traffic arteries, for the development of the Hall area was an integr 1 part of the planning for the area. Some of'-the earlier plans fo the Kellogg Boulevard development leading to the final development pll n had envisioned two levels of parking in the area but these , s parking levels were to be below what is now the Mall area, and the roof f the parking structure was to be landscaped and developed similar tolwhat now exists. Other earlier plans for the bluff area vary greatly in their details, but they all share one common objective; that is'p to develop the bluff area in such a way that no buildings or structures constructed south of Third Street (the present Kellogg Boulevard) would attain a height higher than that of Kellogg Boulevard: This thinking is reflected in the current development of the area. t is true that the current development of the entire area does not q t fully reflect the early plans. Until the Y.W.C.Ae building was ompleted, development of the Kellogg Boule- vard frontage was e Kellogg Boulevard frontage sparse, and oven today almost 55% of the Ste Peter and Sibley Streets is either vacant or useC for automobile parking or related uses. How- ever, the demolition of the Ballard buildings for the Hilton Hotel and other announced and tentative plans for the frontage is rapidly changing this situation, 30 years after the Kellogg Mall development. While it has taken many more years than had probably been anticipated, the total concept of the Kellogg Boulevard scheme is now on the verge of being realized. To reiterate, the original concept, valid today, envisions a highly developed Kellogg Boulevard frontage, fronting on a park setting on the edge of the bluff, and with an unobstructed view across the River and up and down its banks. This concept has guided and formed a basis for existing development and is guiding and forming a basis for the recent redevelopment plans in the area. It is this concept that the proposed amendment seeks to preserve. I 2. Finding: that the proposed rezoning is reasonably related to the over -all needs of the community I The proposed rezoning, is intended to protect the aesthetic and eco- nomic amenities of the City as a whole. The aesthetic benefits of an unrestricted and unobstructed park setting overlooking the River on the edge of the C.B.D. are apparent. Such a development is bene- ficial to people within the C.I.D., whether they be employers, em- ployees, or any other citizen who visits the C.B.D. for any purpose whatsoever. From an economic standpoint, it is intended to protect the economic investment and economic potential of the C.B.D. The City services provided for all tl he citizens of the City are paid for to a very substantial degree by the tax -yield of the Central Business -9- District. The amount of this tax -yield is dependent upon the in- tensity and nature of development and the resultant value of C.B.D. properties. A prohibition of unrestricted development south of Kellogg Boulevard is intended to prevent dilution of C.B.D. core development. At the same time, it is intended to protect those values of the C.B.D. that contribute to its desirability and economic worth to the City as a whole, I 3. Finding: that the proposed rezoning is reasonably related to a plan for future land use Page 28 of the City Planni g Board's Community Plan Report #14, "Saint Paul's Central Business District" discusses proposals made for the Kellogg Boulevard frontage and are shown on several maps and a sketch contained in the report. The report kes land use proposals for the Kellogg frontage from the City Hall nd Courthouse to the proposed site of the new Federal Courts Building, and concludes the discussion with a para- graph containing the followin "Kellogg Boulevard is the front porch of the Central Business District I , and the magnificent vista of the Cen- tral Business District that i:s available is evident to any one who has ever approached the City from Highway 61 or the Robert or Wabasha Street Bridges." Further, "The redevelopment proposed in the Plan is intended to capitalize on the natural ma. of the sites along Kellogg and to enhance the skyline of the Clntral Business District." The proposals of this plan for future develop lent reiterated and reinforced those that have been put forth over the ears. This was held for the purpose of hearing opponents and propo�nets to the proposed amendment to the Zoning, Code which would restrict height of structures on the south side of Kellogg Boulevard. Present: Chairman Adam, Mrs,, DeCoster, Messrs. Cohen, Dorle, Gadler, Haarstick, Janes, Massey, McPartlin, Neve, and Troy. Absent: Messrs Fischer, Schell, Whitcomb, and Wylie Also Present: Mr. Langland -St. Paul Dispatch, Mr. Sheahan - Corporation Counsel's office, F. Schirmer,) Messrs. Teig, Butz, Cosgrove, and Betz of the staff, and approximately 20 private citizens. Mr. Adam introduced the members of the Board and staff. Mr. Adam advised the purpose of the meeting was to discuss a new Zoning Code restricting height of buildings on the south side of Kellogg Boulevard between St. Peter and Sibley Streets, Mr. Adam advised the three necessary'publications of notice of the Public Hearing had been made. Mr. Teig gave a brief resume of the history of Kellogg Boulevard including plans for its development and the . height regulations as imposed by the Zoning Ordinance adopted in 1922 and amended in 1929. When making your presentation, please come forward to the end of the conference table. As required, Mr. Adam called hree times for opponents to this rezoning. No one appeared to speak against it. As required, Mr. Adam called �or proponents. Mr. Shippee, Executive Director of the Housing 6 Redevelopment Authority stated the matter had been considered at their June 11 meeting and that the Authority was in favor of it as being -3- in the interest of the community and the specific interest of the Downtown Redevelopment Plan. The Authority endorses the proposed ordinance on restriction of heights on the land south of Kellogg Boulevard, Mr. W. E. Rumble, President o� M.I.C., stated he was speaking as a citizen of Saint Paul and did not hav specific authorization of his Board of Dir- ectors though he felt they we a unanimously in favor of the amendment. He stated his committee had been working approximately three years on the de- velopment of the Downtown, roughly the area from Seventh to Kellogg and Sibley to Wabasha, and now are reaching the crucial steps in the Downtown program and it is very important that no action be taken that might impair the plans for the development of the area and that action be taken wherever possible which will make it easier and better for development of that area. It is vital to the development of that area that an unobstructed view of the River and of the land across the River from Kellogg Boulevard be preserved. It is vital that the original �oulevarding and parking plans for Kellogg Boulevard be carried out. That plan contemplated a park area south of Kellogg Boulevard in the area mentioned. With the plans for substantial new construction in the Downtown area, the height restrictions south of Kellogg is going to be one of Iihe strongest arguments to induce developers to come into the area. The park aspect of this particular area was, and is, vitally important. The economic and aesthetic situations are vital to the result that may be reached today if the amendment of the ordinance is re- commended. This will benefit all the citizens of Saint Paul and not only those persons interested in td. .C. or the Downtown. Persons living in the suburbs also will be directly fected and will benefit from the amendment. The next speaker for the amend :en't was Mr. Louis Lundgren, Chairman of the Architect's Counseling Committee of M.I.C. He commended the Planning Board for presenting this amendment and felt the Architect's Committee as a whole was in favor of it. 4 felt this would benefit the entire City and should not be allowed to b? developed in any fashion other than this. Mr. Fisher of H. & Val Rothschild was the next speaker in favor of the amendment. He stated he was s eaking for the Rothschild business who handled the Degree of Honor Building and the Guardian Building. There were decidedly in favor of the restriction aslwhen the Degree of Honor Building was developed they understood that the air rights south of Kellogg Boulevard would be pre- served. The next speaker was Mr. Axelrod of the Auto Club on Kellogg Boulevard. He felt the view should be protec ed and that this was the attitude of the entire City. Mr. Altman representing the Hilton Hotel interests, stated they selected the site on Kellogg Boulevard fo� the flow of traffic and the magnificent view and would like to have it plreserved. Mr. W. J, Hickey of the Athletic Club stated the Summit Room was constructed with the view of the River in mind and they agree with the Planning, Board in presenting, this plan. The last speaker was Mr. Dick Ra4msn of the Trades & Labor Union who stated no official action had been taken by his organization but he felt if it was presented they would certainly go along with the amendment. They have taken action, however, along with the Housing & Redevelopment Authority and the M.I.C. for the plans on the Downtown and since Kellogg Boulevard is an integral part of Downtown Saint Paul, he feels the Trades and Labor Union would support this amendment to the Zoning Code. Mr, -Adam stated the public hearin, was indicative of the trends in Saint Paul and that there is progressiv thinking, and Saint Paul is moving forward. He thanked every one for coming speaking. In 1929 the City Council rescinded the restrictions set forth for Height Districts III and IV, though the Districts themselves remained a part of the Ordinance. Thus, the current Zoning Ordin- ance provisions for Sections 61.04 and 61,05, dealing with Height Districts III and IV respectively, reads: "There shall be no re- strictions as to thI height to which any building or structure may i be erected. . . . . . ." The amendment to the Zoning Code under consideration deals with that portion of Height District III bounded by St, Peter Street, Second Street, Sibley Street, and the Harbor Line of the Mississippi River. -3- Additionally, the amendment is concerned with a portion of Height District IV, that portion immediately adjacent and north of the portion of Height District III under consideration, and bounded by the centerline of Kellogg Boulevard, Sibley Street, and Second Street. The amendment divides the subject portion of Height Dis- trict III into fou� sections, each with a different maximum building height limit g , these limits being determined in such a way that no building constructed in any of these sections will rise higher than the established grade of Kellogg Boulevard. In precisely the same manner, Height District IV is divided into four sections, so that sections 1, 29 3, and 4 in bot Height Districts III and IV have corresponding restrictions. The established grade of Kellogg Boulevard can be con- sidered in terms of�ellogp the established elevation at the intersection of the centerline of with the centerline of the streets which cross it; these are as follows: at Kellogg and St. Peter: 93.41; at Kellogg and Wabash 94.21; Kellogg and Cedar: 93.61; Kellogg and Minnesota: 76.21; Kellogg and Robert: 62.61; Kellogg and Jackson: 45.51; Kellogg and Sibley: 25.91; These elevations and all other street grades in the City are measured from a zero point known as the City Datum, which is 694.58 feet above sea level. In accord with this system, the proposed amendment would limit the height of any building or structure within the, subject portions of Height Districts III and IV to a height measured from City Datum according to the following schedule: -4- Height Districts III 6 IV ight District Section Delineation and street Grade at Kellopc? However, paragraph "f" of Section 61.06 reads: "None of the provisions or restrictions of Section 61.06 shall apply tc, govern or restrict the erection of buildings in Height District IIIior Height District IV." The proposed amendment in no way alters or; changes this paragraph, thus precluding the con- struction of any portion of a building higher than the proposed limits by virtue of decreased bulk or by virtue of the nature of the con- struction. The proposed amendment further stipulates that Section 63.13 of the present Ordinance, which deals with the method of deter- mination of buildinI height, shall not have any application to the erection of any building in Height District III or Height District IV. The non-application I of Section 63.13 is intended to insure that the height of any proposed structure in the subject Height Districts'will be determined solel} by measurement from the -5- elevation of City Datum. II. Planning Board Cons ions The Planning Board, in its deliberations on this proposed amendment to the Zoning? Ordinances must make certain findings and recommendations, as set forth in Sectio 64.06 of the Zoning Ordinance; these are as follows: 1, The Planning Board should consider whether a survey of the whole area of the City of Saint Paul or of an area not less than forty acres has been Londucted by the Board, within which the proposed area to be rezo�ed is located. 2, Consideration must be given as to whether the number of des- criptions of re�l estate affected by such changes and alterations render the obta'ning of written consent impractical. 3. A finding, must a made on one of the following three -alternatives: (a) The proposed rezoning is related to existing land uses; (b) The proposed rezoning is reasonably related to the over -all needs of ti�e community; (c) The proposed rezoning, is reasonably related to a plan for future land use. III.Study Findings Data pertinent to each of the three Planning Board considerations (II - 10 2, & 3) follows: A. A survey of the whole area of the City of Saint Paul has been made in the form of the Comprehensive Plan for Saint Paul, adopted by the Planning, Board on'April 19, 1963. Community Plan Report 14 entitled -6- "Saint Paul's Central Business District, A Concept for Its Develop- ment" adopted by the Planning Board on March S. 1963 is another pertinent study,lcovering, the Central Business District area, an area of which thIe subject property is a part. The C.B,D.* Study examines the current situation in the downtown area, and also makes proposals for fyture development and redevelopment of various areas of the C.B.D., 'Including the subject properties and properties directly ffect b the subject ro erties The points made in the Y Y 7 P p � P C.B.D. report as they relate to the proposed zoning amendment will be discussed later in this report. B. Consideration has been given to the number of descriptions of real estate affected by the proposed rezoning. In a letter dated April 2, 1964, the offic of the Commissioner of Finance reported that within a 100 -foot radius of the subject property there are 33 property des- criptions. A clmpilation of 58 typical rezonings approved by the City Council since July, 1962 reveals that there was an average of 17.7'property descriptions involved in these cases, with only three of the 58 involving more than 30 descriptions. In view of the fact that there are 33 property descriptions involved in the present case9 it appears thatithis number of descriptions of real estate affected by the proposed zoning amendment renders the obtaining of written consent impractical. Co It seems likely that affirmative findings readily may be made on all three of the alternatives noted in item II -3(a), (b), and (c) above. -7- 1. Finding: that the proposed rezoning is related to existing land use. Photographs taken many years ago on file in the Planning Board office give vivid testimony to the chaotic and ugly development that existed between Second and Third Streets and below Second Street on the southern edge Of the C.B.D. The total clearance that took place and the resultant evelopment of Kellogg Boulevard was designed not just to up -grade t I e traffic arteries, for the development of the Mall area was an integral part of the planning for the area. Some of-the earlier plans for the Kellogg Boulevard development leading to the final development plan had envisioned two levels of parking in the area, but thes parking levels were to be below what is now the Mall area, and the roof of the parking structure was to be landscaped and developed similar to what now exists. Other earlier plans for the bluff area vary greatly in their details, but they all share one common objective; that is9 to develop the bluff area in such a way that no buildings or structures constructed south of Third Street (the present Kellogg Boulevard) would attain a height higher than that of Kellogg Boulevard. This thinking is reflected in the current development of the area. It is true that the current development of the entire area does not yet fully reflect the early plans. Until the YaW.C.A. vard frontage was Kellogg Boulevard ling was completed, development of the Kellogg Boule- extremely sparse, and even today almost 55% of the Ifrontage between Sta Peter and Sibley Streets is -8- r either vacant or used for automobile parking or related uses. How- ever, the demolition of the Ballard buildings for the Hilton Hotel and other announced and tentative plans for the frontage is rapidly changing this situ�tion, 30 years after the Kellogg Mall development. While it has taken many more years than had probably been anticipated, the total concept of the Kellogg Boulevard scheme is now on the verge of being realized. To reiterate, the original concept, valid today, envisions a highly developed Kellogg Boulevard frontage, fronting on a park setting on the edge of the bluff, and with an unobstructed view across the Ri�er and up and down its banks. This concept.has guided and formedi basis for existing development and is guiding, and forming a basis for the recent redevelopment plans in the area. It is this concept that the proposed amendment seeks to preserve. 2. Finding: that,the proposed rezoning is reasonably related to the over -all needs;of the community The proposed rezoning is intended to protect the aesthetic and eco- nomic amenities ofl the City as a whole. The aesthetic benefits of an unrestricted and' unobstructed park setting overlooking the River on the edge of the - C.B.D. are apparent. Such a development is bene- ficial to people within the C.B.D., whether they be employers, em- ployees, or any other citizen who visits the C.B.D. for any purpose whatsoever. From an economic standpoint, it is intended to protect the economic investment and economic potential of the C.B.D. The City services provided for all the citizens of the City are paid for to a very substantial degree by the tax - yield of the Central Business -9- r ' District. The amount of this tax -yield is dependent upon the in- tensity and nature of development and the resultant value of C.B.D. properties. A proh,bition of unrestricted development south of Kellogg, Boulevard it intended to prevent dilution of C.B.D. core development. At the same time, it is intended to protect those values of the C.B.D, that contribute to its desirability and economic worth to the City al a whole. 3. Finding: that the proposed rezoning is reasonably related to a plan for future land use Page 28 of the City Planning Board's Community Plan Report #14, "Saint Paul's Central Busin I 6ss District" discusses proposals made for the Kellogg Boulevard frontage and are shown on several maps and a sketch contained in the report, The r1eport makes land use proposals for the Kellogg frontage from the Ci�y Hall and Courthouse to the proposed site of the new Federal Courts Building,, and concludes the discussion with a para- graph containing the following: "Kellogg Boulevard is the front porch of the Central Business District, and the magnificent vista of the Cen- tral Business District that is available is evident to any one who has ever approached the City from Highway 61 or the Robert or Wabasha Street Bridges." Further, 'The redevelopment proposed in the Plan is intended to capitalize on the atural magnificence of the sites along Kellogg and to enhance the skylina of the Central Business District." The proposals of this plan for future development reiterated and reinforced those that have been put forth over the years. Dear Mr. Sheahan: of Law November 18, 1963 This is written as a follow- through of our conversation of last week con- cerning height restrictions and an amendment to the Zoning Code to cover the area south of Kellogg Boulevard between said street and the River. At the last regular Planning,Board meeting on November 8, 1963, the Board unanimously passed a motion that the Corporation Counsel be requested to prepare an amendment to the Zoning Code establishing a restricted height district between Kellogg Boulevard and the River from the Seven Corners area to the Post Office building and any other areas which the Corporation Counsel and Planning staff deem appropriate. The concensus of the Board was that any building or structure to be erected on the southerly side of Kellogg Boulevard should be restricted in height to the established grade of Kellogg Boulevard. This would not preclude vehicular and pedestrian access to the property from Kellogg or to developing the roof of any build- ing in the area with a roof - garden and appropriate landscape treatment comparable to the Mall. During the discussion, the possibility of acquir- ing air rights over the railriad property was mentioned. The Planning Staff is of the opinion that other areas within the City that should be considered within this new height district are those a ;ong Warner Road, Shepard Road, and Mississippi River Boulevard. Although much of this property is in public ownership, the staff feels that adequate height -regu- lations should be prepared to! assure the continuation of this river - front, park -like character. We shall be happy to work with you on this matter. I assume that you will proceed, as you indicated last week, in introducing the matter at Council so proper proceedings are initiated.
