THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section l. That permission and authority are hereby granted to Quality Metals Company to construct a public water main in Doswell Avenue from 120 feet west of Huntington Valley Road to _ _ the west__property line of Berry Street, said public _water main,,.._�__.... _ to serve Lots 2 through 23, Block 3, Lots 2 t}irough 23, Block 4, Lots 2 through 23, Block g, and Lots 2 through 12, Block 10, St. An.thony Park West. Section 2. That the Commissioner of Public Works is hereby , authorized to issue a permit to Quality Metals Company for the � construction of said public water main. upon and subject to the following provisions, terms and conditions: a. That said permittee shall construct said public water main entirely at its own expense, under the supervision and to the satisfaction of the Commissioner of Public Works and the Board of Water Commissioners, and in accordance with the plans and specifications on file with the Department of Public Works. �� b. That said permittee shall pay the cost of engineering and inspection of said wor� and for the publication of this ordinance. c. That said permittee shall prope��y pro— � tect all excavations made in the streets both day and n.ight so as to avoid all damage or injury to persons or property; shall furnish all egcavation and shall properly backfill and tamp such streets to avoid settling and shall restore such streets to their original condition, all in accordance with plan's and specifications on file with the i � Department of Public Works. That said permittee shall provide an 18" casing pipe under the Minnesota Transfer Railroad Tracks in accordance with the Railroad' s requirements. e. The Water Department� shall furnish and assemble the necessary pipe and related appur- tenances for said water main. The permittee shall deposit with the Water Department in advance a sum of money equal to the estimated cost of the � work to be performed by the Water Department herein. Upon completion of the work by the Water Department, the permittee shall receive an invoice for the actual cost of all material, labor and equipment furnished by the Water Depart- ment; and if the actual costs exceed the advanced , deposit , the permittee shall pay the balance thereof to said Water Department. , f. That said permittee shall not proceed to construct said water main unless and until said permittee shall have fully ,complied with the � provisions regarding insurance and indemnification contained in the City of Saint Paul, Department of ' Public Works Specifications for Street and Sewer Construction dated April l , 1959, Section numbered 1. 44 of said specifications, as amended, applicable �-� _�- :..�, to _contractors. For the purposes of this ordi- nance, the aforesaid section of said specifications , numbered 1. 44, as amended, shall be read as though the word "permittee" was substituted for the word "contractor" , wherever the same appears in the aforesaid Section 1. 44, as amended, Said Section 1. 44, as amended, of the Specifications for Street and Sewer Construction in the City of Saint Paul , is hereby incorporated herein by reference as ' • fully and as completely as if set forth herein verbatim. Proof of compliance with provisions � � of the aforesaid section shall be in such form as the Corporation Counsel of the City of Saint Paul may �direct, and the documents required by the aforesaid Section 1. 44 shall, after submission to the Corporation Counsel, be filed in the Office of the Comptroller of the City of Saint Paul. j . That said permittee shall submit said . bond and insurance documents to the Office Engineer o� the Department of Public Works. The Quality Metals Company has recently petitioned the Water Department to prepare plans and construct a water main on Doswell Avenue from 120 feet west of Huntington Dalley Road to the west property line of Berry S treet paralleling the above mentioned sewer. To facilitate construction of the water main the Quality Metals Company has proposed to do the excavation, backfill and restoration, under a permit from the Commissioner of Public Works. i The Water Department approves of this project and has agreed to perf orm this work at the expense of the Quality Metals Company, subject to the company obtaining a permit from the Commissioner of Public Works. In addition to the normal conditions and specifications of the Commissioner of Public Works, pertaining to permits, the Board of Water Commissioners requests that the f ollowing be added to the conditions of the permit: 1. The Water Department will furnish and assemble the pipe and related appurtenances f or said water main at the permittees - sole expense. The permittee shall furnish all excavation, , backf ill, and street restoration, in accordance with plans and specifications on file with the Department of Public Works. , The permittee shall also provide a 18-inch casing pipe under the Minnesota Transfer Railroad tracks, all in accordance with Railroad requirements. r �� `i � ' 1 ='� � • � � � � ._ _2.. The Water Department will invoice the permittee f or the actual cost of all material, labor and equipment necessary to assemble the water main.
