'. SECT I ON ;L •
That permissi`omY�amd authority are hereby granted to the University
of Minnesota Plant Ser•vices �to jack a 3 inch steel conduit under and
across Cleveland Avenue, "25 feet south of the centerline of Hoyt Avenue
produced easterly and in and under Noyt Avenue, 25 feet south of the
centerline of Hoyt Avenue, f rom the westerly line of Cleveland Avenue
westerly 130' +, for,�the installation of an underground electric service.
� ` SECTION 2
� � The Commissioner of Public Works is hereby �authorized to issue a
� permit to the University ofi Minnesota Plant Serv.i:ces for the construction
of said 3 inch steel conduit upon compliance with, the following terms and
conditions:

. a. Said permittee shall file plans and specifications for said
3 inch steel conduit with the Cortmissioner of Public Works '
,-' which shall be satisfactory to him, and said 3 inch steel
" conduit shall be constructed in accordance with sajd plans

� ' b. That the permittee pay the cost of publication of this

harmless the City of Saint Paul from all damages which it may �
in any way sustain in consequence of the construction and
' � maintenance of the said 3 inch s.teel conduit.
e. That said permittee shall �require of ' its contractor that said
contractor file with the Department of Public Works a certificate
of insurance uncancellable during the term of the work required
- in construction of the aforementioned 3 in�h steel conduit,
� wherein ,the City of Saint Paul shall -be designated as the co-
:insured, said insurance coverage to be in the following amounfis:

for personal injuries, including death, in an amount not
less than $250,000.00 for each person, $500,000.00 for each
occurrence; property damage in an amount not less than
'"s�150,000.00 for a single accident and not less than $200,000.00
in the aggregate during the policy period. Said permittee shall
carry out no work pursuant to the permit hereby granted in the
absence of such policy of insurance being in effect.
f. That said permittee shall furnish and deliver to the City of _
Saint Paul a surety bond in the sum of $10,000.00 conditioned
upon the permittee complying with all the terms and conditions
• of the ordinance, and to indemnify, defend and save �he City
harmless from all loss, liability, judgments, suits, costs, `
charges, damages or expense that may accrue to person or property
or arising out of or growing out of the construction, maintenance
and repair of the 3 inch steel conduit, the said surety bond to
remain in force `and effect as lorrg as .the 3 inch steel conduit
or any part tt�ereof i s ma i nta ined. �
g. That said permittee shall restore sidewalks, curbing and paving
to its original condition after the installation of the 3 inch
, steel conduit and if the purpose for which the 3 inch steel con-
duit is constructed ceases to exist, the permittee sfiall , at the
� reguest of �he, Council of the City of Saint Paul , at its own cost
' anc� 'expens'e, remove said 3 inch steel conduit and restore the
� streets, sidewalk and curbing to approxir�ately their original
state or condition. � � '

. r h. The Council of the City of Saint Paul reserves the right to revoke
this permit whenever, in its opinion, the public necessities or �
public interest wnuld be served by such revocation. _
i. That said permittee shall , within thirty (30) days after the
passage of this ordinance, file a written acceptance of the terms
hereof with the City Clerk in such form as may be approved by the
Corporation Counsel . .
SECTION 3
This ordinance shall take effect and be in force thirty (30) days '
from and after its pas�sage, approval and publication. .

I acknowledge your letter of August 28th and the attached documents
relative to Ordinance Number 13681 granting �the University permission
to place a steel conduit under Cleveland Avenue, and the construction
of a three inch steel conduit in Hoyt Avenue for the installation of
underground electric service as it relates to the Saint P'aul Campus.
I am transmitting herewith University of Minnesota check number 374317
in the amount of $25.93 to cover the cost of the publication of the
ordinance. I am also attaching hereto a signed acceptance of the
ordinance provisions.
I am taking action to have our Insurance Department provide the required
insurance and bond'as outlined in paragraphs "e" and "f" of Section 2.
However, there may be some delay in delivering these to you within 30
days from August 28th, the date of your letter. In this case, I hope
it will be possible for you to extend the time.
I appreciate the attention that you and your staff have given to this
matter.
