An ordinance granting permissiori to the
Minnesota Office Building to construct a
three inch steam line and a 3/4 inch con—

the public alley in Block 24, City of Saint
Paul. �
THE COIINCIL OF THE CITY OF SAINT PAUL DOES HEREBY ORDAIN:
Section 1. That, permission and authority are h:�reby granted
to the Minnesota Office Building for the construction, maintenance,
operation and repair of a three inch steam line and a 3/4 inch
- oondensate return pipe in, un.der and across the public alley in
��. �. Block 24, City of Saint Paul, also ]�.own. as Saint Paul Proper,
,y ,� ���aid pipes to be installed in �he alley six feet east and paraIlel
• . to the east line of Cecl.ar Street at a dept� of not less than
=�`� � three feet.

, Section 2. The Commissioner of Public Works is hereby
authorized to issue a permit to the Min.nesota Office Building
for the aforesaid purposes, aubject to the following terms and

, a. Said permittee shall construct all. said lines entirely
at its own egpense under the inspection and supervision and to
the •satisfaction of the Commisaioner of Public Works in accord-»
ance with plans and specifications to be filed with an.d approved
by said Commissioner.
b. Said permittee shall pay- the cost of any necessary
, engineering and inspection of_s.aid work by the •City of,,..Saint . ,
Paul, and shall pay the cost of publication of this ordinance:� "

c. Said permittee shall properly protect all egcavations� �
made in the subject alley, both day and night, so as to avoid
all damage or injur� to persons or property, and shall properly .
' fill and tamp all subject alley or other areas affected to avoid
settling. . �
d. Said permittee, after the inception of said work, shall
prosecute 'the same continuously with diligence and fully complete
said work to the satisfaction and approval of the Commissioner of
� ' Public Works at the earliest possible date. ,
e. Said permittee shall restore all alley surfaces to their
original condition in conformi�y with the standard specificatiorj.s
of the City of Saint Paul.

losses, judgments, suits or expenses arising out of or occasioned
by the performance of the work contemplated by this permission
� and authority. Said permittee shall not proceed to construct
said stea,m and condensate lines un.til said permittee shall fully
comply with the provisions regarding insurance and indemnification
contained in the City of Saint Paul Department of Public Works
Specifications for Street and Sewer Construction dated April 1,
1959, Section 1.44 of said specifications, as amended, applicable
to contractors. For the purposes of this ordinance, the afore—
said section of said specifications, numbered 1.44, as amended,
shall be read as though the word "permittee" was substituted for
the word "contractor. " Said 9ection 1.44, as amended, is hereby
incorporated herein by reference as fully and as completely as
if set forth herein verbatim.�- Proof of compliance with the pro—
visions of the aforesaid section shall be in such form as the'�'
Corporation Counsel of the City of Saint Paul may direct and the
documents required by the aforesaid Section 1.44 shall, after
submission to the Corporation. Counsel, be �iled in the office
of the Comptroller of the City of Saint Paul.
d. Said permittee shall furnish a bond to the City of Saint
Paul in the sum of Ten Thousand Dollars (�10,000.00) conditioned
' upon compliance with all the terms and conditions of this ordi—
nance and to indemnify and sa�r.e harmless the City of all liability, '
loss, judgments, suits, costs, charges and expenses that may
arise out of tYie granting of this permit and the removal of the
steam line and�condensate return pipe of the said alley. _
e. Whenever the Council of the City of Saint Paul, by its
' � resolution, shall determine the discon.tinuance and removal of the
said three inch steam line and 3�4 inch condensate return pipe
neces�sary in the public interest and accordingly order the dis—
continuance and removal of the same from the said location, the
said steam line and condensate return pipe shall be d�iscontinued
and removed from the stzbject public all�ey area which shall be
removed and the area restored by the permittee at the permittee' s
sole cost and expense.
f. Said permittee shall, within thirty days after the pass—
age of this ordinance, file with the City Clerk a written accept—
ance of this ordinance, its terms and conditions.
Section 3. This ordinance shall take effect and be in
, force thirty days from and after its passage, approval and publi—
cation.
