Section l. That permission and authority are hereby granted
to Hanover Apartments, a limited partnership consiating of Flonover
Apartments, Inc. , its general partner, to construct a pu�lic sewer
� and private water main in the public utility easement described as

An easement for utility purposes in, under,

cribed land: the South thirty (5.30) feet
of the North one—hundred sigty—one and

Thousand Dollars (�10,000.00) , conditioned to
comply with all the terms of this� ordinance and �
� to indemn.ify and save harmless the City of Saint �
Paul and the Board of Water Commissioners of the ,
City of Saint Paul from. all liability, loss ,
judgments, suits, costs, charges and expense
that may accrue to persons or property occasioned
by the making of the improvement or arising out�'

g. ,That said permittee shall not proceed �
to construct said water main and said public sewer
unless and until said permittee shall have fully
complied with the provisions regarding insurance
and indemnification contained in the City of Saint •
Paul Department of Public Works Specifications for '
Street and Sewer Construction dated April l, 1959,
Section numbered 1. 44 of said Specifications, as � .
� ._ . amended, applicable ` to contractors. For the _ " � 4
purpose of this ordinance, the aforesaid section
of said specifications, n�.mbered 1.44, as amended,
shall be read as ' though the word "permittee" were
substituted for the word "contractor" wherever the
same �appears in the aforesaid Section 1.44, as
amended. Said Section 1. 44, as amended, of the
Specifications for� Street and Sewer Construction
in the 'City of Saint Paul is hereby incorporated '
herein by reference as fully and as completely as
if s.et forth herein verbatim, proof of ' compliance
with provisions of the aforesaid section shall be
in such form as the Corporation Coun.sel of the
. City of Saint Paul may direct, and the docu.ments
required by the aforesaid Section 1.44 shall,
� after submission to the Corporation Counsel, be
filed in the Office of the Comptroller, of the
City of Saint Paul; ,

Corporation Counsel, and upon approval shall
file said documents with the Office of the
Comptroller of the City of Saint Paul.
Section 3. That permission and authority are hereby
granted to Hanover Apartments; a l.imited partnership consisting
of Hanover Apartments, Inc: , its general partner, to maintain a
private water main in the easement described in Section 1 above,
subject to all of the terms and conditions imposed by the Board
of Water Commissioners o� the City of- Saint Paul and further
subject to the permittee, by its acceptance� of this permission and �
authority, expressly agreeing to indemnify and hold harmless the
City of Saint Paul, the Board of Water Commissioners of the City
of Saint Paul, its agents, officers and employees, from any and all
claims, loases, judgments, suits or expenses arising out of or
occasioned by the maintenance, operation or replacement of the said
private water main. �
Section 4. That said permittee shall, within thirty (30)
days after the passage of this ordinance, file a written accaeptance
thereof with the City Clerk.
Section 5. That this ordinance shall take� effect and be in
force thirty (30) days from and after its passage, approval �and publi-

Attached hereto please find ordinance requested by you
authorizing and granting permission to Flanover Apartments , a
limited partnership, to construct a public sewer privately within
an easement to be conveyed to the City of Saint Paul. The ordinance
has been approved as to form by me and a copy of the same is being
transmitted to the Board of Water Commissioners for their informa-
tion.
If the ordinance appears proper in form and substance, the .
same should be introduced to the Council for passage.
Attached hereto please also find a copy of easement con-
veying the utility easement to the City of Saint Paul by Flanover
Apartmen.ts , a limited partnership, and also a copy of consent to
easement egecuted ' on behalf of H. and Val J. Rothschild, Inc. ,
mortgagee. The easement and consent have been placed on record in
the Office of the Registrar of Titles , and the City is now in
possession of a utility easement.
