THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORD�iIN:
Section 1. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts and Rezoning of certain
properties in the City of Saint Paul, as a.mended, be and the
same is hereby further amended so as to rezone the following
described property from "B" Residence District to Gommercial
District, to—wit:
The easterly 100 feet of Lot 60,
Wilkin & Heywards Out Lots to St.
Paul;
situate on property loeated on the southwest corner of Maryland
Avenue and A�rundel Street in the Git.y of Saint Paul.
Seetion 2. This ordinance shall take effect and be in
force thirty (30) days from and after its passage, approval

Dear Sir:
This is written in response to the netition of James P. C�iley to
rezone from "B" Residence to Commercial, property located on the
southwest corner of P�I�,ryland Avenue and Arundel Street. This property
is further described as the easterly 100 feet of Lot 50, 6dilkin and
Heyward's Outlots.
The �etitioner proposes to use this nroperty as a site �or an
off-sale l.iquor store. Such a use is not� permitted in zoning districts
more restrictive than Commercial.
This '�matter was considered at the January 16, 1969 Bo�rd of Zoning
meetin�;. The staff reportec� that the site includes over 10,000 square
feet and has a fronta�e of ].00 feet alon� Maryland Avenue. Presently
occupyins? the property are an older, small single-family residenca and
an illegal siQn advertisins� a nearby �katin��� ri:nk., It was reported
that the proposal constitutes spo�C zonin�, the Comprehensi,ve Plan
recommends sin�le-family use for this site, vacant commercial land
exists in the area, and the pronosed use would have a detrimental effect
on the residential uses south of i�Iaryland Avenue.
Mr. I�Si1ey, speaking in behalf of the petition, said there is an
older sin�le-family dwel.ling in a state of poor ret�air on the site. The
people who live next door have joined in the petition for the rezoning
and were favorably impressed by the proposed construction. He mentioned
the commercial pro�erty across the street, and the "C" Residerice ta the
west. Ha and his client wanted to move her "on sale" liquor store from
the downtown at the request of the City. She thought it could be moved,
but she has been unable to secure a gobd si.te. He showed a picture of
the proposed buil.din�?. Reverend Almquist, Chairman of the idorth End
Community Or�anization and churches in the area, spoke in onposi�ion.
He said a letter of opposition had been sent to the P4ayor. He said there
was no need for any additional liquor stores. There are agartments across
�rom the proposed site occupied mainl.y by s�ounp adults and this close
proximity to a liquor store might be a problem and that Maryland Avenue
at this point has a residential atmosphere. He also noted tl�at there is a

sale" liquor store, it mi�ht become an "on-sale" establishment.
Mr. Ed Hartman, President o� the idorth End Business ��Ten's Club, with
a 100 members in the district, also spoke in oz�positi.on. He said
they object to this "off-sale" store because they feel there are enou�?h
liquor places in the idorth End eammunity. He said they do not object
to the north side of T4aryland Avenue bein� commercial, but they do
object to any commerc�.al zonin? �n the sout� side. They wa-nt to keeA
the people who live there in the neip;hborhood and they may move if a
].iquor store is placed thare. He felt that if this pro�erty were
rezoned, additional property mi�?ht also bE rezoned.. �Ie said the Tiorth
rnd Improvement Club had intended to have scmeone in attendance, but
they had �one on record Monday night in opposi.tion to the rezonin�.
