Dear Mr. Marshall:
This is written in response to the petition of Mamie P. Greer to rezone from
"B" Residence to "C" Residence certain properties located on the north side of
Hubbard Avenue between Fry Street and North Snelling Avenue. This property is
further described as:
Lot 14 and the east 2 feet of Lot 13, Block 1, and the
south 20 feet of Lot 7; and all of Lot 8, except the
north 124 feet thereof, Block 1, College Place West Division.
This matter was considered by the Board of Zoning at its regular meeting on
October 2, 1969. The staff reported that the several descriptions contained an
area of 15,224.68 square feet with a frontage of 62 feet on Hubbard Avenue. The
report noted that the existing structure contained 10 units and provided parking
for 5 cars in a garage located on the rear portion of the property. The staff
concluded that the requested rezoning would be "spot zoning"; that the property
adjoins six properties that are zoned "B" Residence and that under current zoning
regulations the property could be used as a duplex and the rental of rooms. It
was also noted that to provide the additional required off-street parking much of
the rear yard area would be used for this purpose. According to the Building
Department, rezoning the property will still require successful appeals of the
Building Codes to be a legal 10-unit structure.
Mr. Fred Kueppers, Jr. , representing the petitioner, stated the petitioner has
resided on the premises since 1939 and that the building has 10 units, including two
on the third floor. They are also under the assumption that legal fire escapes do
exist for the building. Most of the neighbors signed the petition to rezone the
property.
Mr. Merrill Robinson, president of the Hamline Community Association, noted the
property has been well maintained under its present ownership but expressed fears
that in the future, under different ownership, a slum could develop.
The Board of Zoning considered the matter and it was moved that the Board recommend
approval of the petition. The motion did not receive a second, and failed.
Subsequently, a motion was made to recommend denial of the petition because it represents
"spot zoning". This motion carried by a vote of 3-2.

A. SUFFICIENCY: The Commissioner of Finance, in a letter dated 8/28/69, declared
the petition sufficient with the owners of 10 of 14 (71%) tracts having
signed the petition.
B. HISTORY: None for this property. The second lot to the west, however, was rezoned
to "C" residence in 1941 after having received a recommendation of denial
from the Board of Zoning.
C. PROPOSED USE: Although no proposal is stated, it is assumed that the purpose is
to continue the present apparently illegal use as a ten-unit building.
If rezoned, this site would allow a maximum of 12 units.
D. FRONTAGE & AREA: The site hasi frontage of 62 feet on Hubbard Avenue and contains
several portions total ��,224.68 square feet.
E. AREA ZONING: The area is zoned "B" residence except the second lot to the west
which is "C" residence. Snelling Avenue frontages are zoned "C" residence
in this area.
F. COI�REI�NSIVE PLAN: This block is recommended for reaidential use, medium
density at a maximum of townhouses at 15 dwellings per acre.
G. SITE CONDITIONS: The site ia level and' about 4 feet above the street grade.
The structure on the site is older, but in good condition. Five garages
exist on the north portion of the site and have access to Hubbard Avenue
by means of a driveway less than eight feet wide.
H. AREA CONDITIONS: This area has mixed residential uses but primarily older single-
family and duplex structures. Hancock School andyard occupy the entire
block across Hubbard Avenue.
