THE COtlNCIL OF THE CITY E�' SAINT PAUL DOES ORDAIN:
SECTI�N 1
Ttaat per�ission and aut�ority are laereby granted to the Port
Autbority of the City of Saint Paul to furnish and install twin rrn�etal
60" culverts fro� Red Rock Road to Pigs Eye Lake.
SECTION 2
That t�e Co�missioner of Public lrorks is hereby authorized to
issue a pern�it to the Port Authority of the City of Saint Paul for the
construction of said ce�lverts upon and subject to tbe following provisions,
ter�as and cond i t ions:
� f ' a. That said permittee shatl construct said culverts entireiy
�� at its own expense and to the s�tisfactivn of t�e Co�issioner of
Public i�lbrks and tn accordance with the approved plans and
specifications �narked Furnishiag aad Installing twin 60" cdivert
pipes in Red Rock lr�dustrial bistrict_for the Port Authority, City
of St. Paul , Mi�nesota, dated October 15, 1969, said plans are on
f i le in the t)epart�ent of Publ ic Vorks;
b. That said per�ittee shall pay the cost of pc�blication of
this ordinance and all resolutiops passed in relation to tE�is
ordinance;
� c. That s�id permittee shall pay the costs of administration,
engineeriAg and i�spectio� i�curred by the Departr�ent of Public
�lorks because of this u�dertaking. Said costs ta be accounted
for under Department of Public Works Project M�ber S-1�11 ;
d. That said per�ittee shall properly protect all excavatloA,
both day and r�i gh t, so as to avo i d a 11 daQOages or i n j ury to persans
or property, and if the Red Rock Road is adversely affected shail
restore that road to its original conditio�;
e. That said per�ittee expressly agrees and undertakes to fully
inde�nify and hold hara�less the City of Sair�t Paal , its age�ts,
officers and employees fraa any ar�d all damages, claia�s, losses,
,judg�aents, suits or expenses arising out of or occasioned by the
performance of the work copteraplated by this per�ission and authority;

of the Department of Public Works arhen the construction starts and
notify the saate said Construction Engineer when ths p�oject has
been completed to allow for a final. in�pection;
g. That said per�ittee shall turni-sh the Department o�' Public
Works all documents of record that are a part of the Contract or
incidental to its execution ir�eluding but not limited tu addendums,
award of contracts sum_ of contrsct, "as builtR• plans and tracings;
h. That said permittee sha.11 not proceed �rith construction uniess
and until sai.d permi.ttee shall have Fully complied t�ith the provisions
r-egaxding insurance an�"inde�nmr►ificatian contained: in t1i¢ City of
Saint Paul, Department of Public Works 5peci.ficatic�ns for �treet and
Se�aer Construction, dated April 1, 1959, Seetion ntmmbered 1.44 of said
specifications, as amended, applica.ble to contraetcc�xs. For the
purpose of thi.s ordinance, the aforesaid sectian of said specification�,
numbered 1.44, as amended, shall be read. as though the �rair� "peru�ittee"
was substituted for the arord "contractor", �rh�rever the same appears
� I.r in the a.�oresai.d Section I.44, as amended. Said Section 1.44, as
i � amended, af the Specifieativns for Street and Sewer Ca�nstt�ction. in
the City of Saint Paul is hereby incorporated herein b� reference as
fully and as completely as if set forth herein v�rbatim. Proof of
compliance with provisions of the aforesaid section sha.11 be in such
form as the Corporation Counsel of the City of Saint Paul may direct
and the docwnents required by the aforesaid Section 1.44 shall, after
submission to the Corporation Caunsel, be filed in the office o� the
Comptroller of the City of Saint Paul.
SECTION 3
That said permittee shall, within thirty days after the passage of
this ordinance, file a written acceptance thereof arith the City Clerk.
SECTION 4
This ordina.nce sha.11 take effect and be in force thirty da.ys frvm
and aftea� its passage, approval and publication.

reaarding insurance and indemni£icat3on contained in the Git� of
Saint Paul, DePartment o£ Publi.c ��orks Specifications for Stxeet and
Sewer Construction, dated April 1, 1959, Section numbered 1.44 of said
sneci�ications, as �anended, arplicable to contractors. For the
purpose o� this ordinance, the aforesaid section of said specifications,
numbered I.44, as amended, shall be read as though the work "permittee"
was substituted for the work ��contr�.ctar", �aherever the same appears
/. in the aforesaid Section 1.44, as arnended. Sai.d Section 1.44, as
