THE COUNCIL OF THE CtTY OF SAINT PAUL DOES ORDAIN:
Section 1 . That permission and authority are hereby granted to the
Whi�ipool Corporation, 850 Arcade Street, Saint Paul , Minnesota, to con-
struct, operate and maintain a 1�-inch diameter underground electrical
feeder at a depth of approximately 4�-feet under Wells Street, approxi-
anately 61-feet westerly from the westerly right-of-way line of Arcade
Street.
Section 2. That the Commissioner of Pubiic Works is he�eby
authori=ed to issue a pennit to Whirlpc�ol Corporation for the construction,
operation, and maintenance of said underground electrical feeder upon and
subject to the following terms and conditions:
a. That said permittee shall construct said etectricai feeder
entirely at its own expense, under the supervision and to the satisfaction
of the Commissioner of Public Works and in accordance with the approved
pians of Whi�ipool Corporation on fiie in the Department of Public Works;
such construction shall be made in strict compliance with the City of
Saint Paul Electrical Code and be authorized under a permit issued by
the Department of Parks, Recreation and Public Buildings;
b. That said pera�ittee shall pay the cost of publication of this
ordinance and ail resolutions passed in relatio� to said ordinance;
c. That said permittee shall pay the costs of administration,
enginee�ing and inspection incurred by the Department of Public Works
because of this undertaking; said costs are estimated as a sum of $300.00
to be accounted for under Department of Public Works Project Number E-1115;
d. That said permittee shalt notify the Traffic Bureau of the
Department of Public Works when the co�struction, operation and maintenance
of said electrical feeder shall make necessary the closing of Welis Street
or part thereof; all expenses incurred by the Traffic Bureau in furnishing,
instailing and removing barricades, signs ac�d other control devices, shali
be paid by the permittee and accounted for under the Department of Public
Works P�oject Number E-1115;
e. That said permittee expressly agrees to comply with Ordinance
No. 14568, Chapter 216, of the Saint Paul Legislative Code pertaining
to street obstructions;
f. That said pern+ittee shall notify the Const�uction Engineer of the
Department of Pubtic Works before and when construction begins and �ootify
the same said Engineer when construction has been completed to allow for a
fi�al inspection;

and re�roval of the said electrical feeder. A certificate of this insurance
shail be deposited with the City of St. Paul before the start of construction.
The liability insurance shall be issued by an insurance company licensed to
do business in the State of Minnesota and the premium and all expenses incidental
thereto shall be paid promptly by the permittee initially and on renewal . Before
the expiration, said permittee shail deposit with the City of St. Paul a new
certificate to replace any expiring insurance. The permittee and the City shali
be named as joint insured in an amount not less than the following coverage:
Bodily injary insurance (including death) in an amount of not
less than $100,000.00 for all damages arising out of bodily i�juries
to or death of one pe�son, and subject to the same limit for each
person in a total amount of not less than $300,000.00 on account of
any one accident.
Property damage insurance in an amount of not less than than $50,000.00
for all damages to or destruction of property in any o�e accident.
The coverage shall autanaticalty be restored immediately after the occurance
of any accident or loss from which tiability may thereafter accrue and the
City of St. Paul shall be notified 10 days in advance of the cancellation of
the insurance coverage by the issuing insurance company;
n. That said permittee shali furnish a bond to the City of Saint Paul in
the sum of five thousand dollars ($5,000.00) conditioned to canpiy with all the
terms of this ordinance and to indemnify said City from all liability, costs
and expenses that may atcrue, occastoned by the making of the improvement or
arising out of the sar�;
o. That said permittee shall submit the necessary bond and insurance
documents to the Office Engineer of the Department of Public Works. The Office
Engineer shall submit said insurance documents to the Corporation Counsel
of the City of Saint Paul for review, and if said insurance is sufficient,
said documents shall be filed with the Office of the Comptrolier of the City
of Saint Paul ;
p. That said permittee shali , within thirty (30) days from and after
the passage of this ordina�ce, file written acceptance thereof, specifically
agreeing to all the provisions, terms and conditions herein, with the City
Clerk.
Section 3. That this ordinance shall take effect and be in force
thirty (30) days from and after its psssage, approval and publication.

in the streets, sidewalks and boulevards both day and night so as ta avoid
all damage or injury to persons or property; shall properly fill and tamp
said streets, sidewalks, and boulevards to avaid settling, and shall restore
said streets, sidewalks and boulevards to the�� original condition, all as
per Section 19 of the Specifications for Street and Sewer Construcfiion,
Department of Public Works, City of St. Paul , Minnesota, dated April l , 1959,
under the supervision and to the satisfaction of the Constructian Engineer
of the Department of Public Works;
h. That said pe�mittee shall coordinate all Mro rk involving existing
utility instatlations, public or private, with the affected utility
company or agency;
i . That said permittee shall , during the term of this permit, restore
and repair all property, whether pub) ic or private, damaged or which may
be damaged due to the const�uction, operation and maintenance or presence
of said electrical feeder provided for herein;
j . That said permittee shall remove the electrical feeder or part
the�eof in such manner as is satisfactory to the Commissioner of Public
Works whenever the City Council shall so order;
k. That said permittee shall furnish the Department of Public Works
all documents of �ecord that are a part of the Contract or incidentai to
its execution including, but not limited to, addendums or changes of work
that are approved by the Department of Publit Works, "as bu11t" plans,
and tracings;
1 . That said permittee shali not proceed with construction unless and
until said permittee shall have fully complied with the provisions
regarding insurance a�d indemnification contained in the City of Saint
Paul , Department of Public Works Specifications for Strest and Sewer
Construction, dated April 1 , 1959, Section numbered 1 .44 of said
specifications, as amended, applicable to contractors. For the purpose
of this ordinance, the aforesaid section of said specifications, number
1 .44, as amended, shall be read as though the word "permittee" was
substituted for the word "contractar", wherever the same appears
in the aforesaid Section 1 .44, as amended, �.id Section 1 .44, as amended,
of the Specifications for Street and Sewer Construction in the City of
Saint Paui is hereby incarporated herein by �eference as fuily and as
c4mpietely as if set farth herein verbatim. Proof of compliance with

Counse) of the City of Saint Paul may direct and the documents required
