A. SUFFICIENCY: In a letter dated April 2, 1971, the Commissioner of Finance declared
the petition sufficient with the owners of 7 of a possible 7 (100%) tracts having
signed the petition.
B. HISTORY: A petition to rezone this site received a recommendation for denial from
the Board of Zoning on February 4, 1971. That petition was withdrawn on February 24,
1971, before it was heard by the City Council.
C. PKOPOSED USE: To construct an electrical power sub-station.
D. FRONTAGE AND AREA: The property under consideration is in two parcels separated by
undeveloped West Orange Avenue. The parcel south of West Orange Avenue has a frontage
along Arundel Street of 390 feet with a depth of 170 feet and an area of 66,300 square
feet. The north parcel fronts along Arundel Street for a distance of 170 Eeet. This
irregular parcel has an area of 39,950 square feet and the combined area is approxi-
mately 106,250 square feet.
E. AREA ZONING: The area to the north is zoned "A" Residence but is separated from this
property by the right-of-way of the NP Railway. The adjoining area to the east and
south is zoned "B" Residence. The area to the west is zoned Commercial and "B" Res.
F. COMPREHENSIVE PLAN: It originally recommended low-density residential for all of this
site at 7 dwelling units per acre. In response to an open-space proposal of a citizens
committee, the Planning Board amended the Comprehensive Plan on 4/3/70 to designate
about 13 acres between West Orange Avenue and the NP Railroad as "open space". The
north segment of this site was included in that designation. The Plan recommends
low-density residential for the south segment. The Plan recommends multi-family to
the west and a park area to the north along ttie bluff.
G. SITE CONDITIONS: The site is approximately 5 feet below the grade of Arundel Street;
it is level and vacant.
H. AREA CONDITIONS: The railroad right-of-way separates the residential development on
the bluff to the north and the mixed Commercial and residential area to the south.
The area east of this property is vacant or used for limited agricultural purposes.
Some platted streets are unimproved.

Dear Sir:
This is written in response to the petition of the
Northern States Power Company to rezone from "B" Residence
to Light Industry to construct a sub-station, property
located on the east side of Arundel Street between West
Maryland Avenue and the NP Railway Right-of-Way, and noted
in detail by the legal description on file.
After receiving a recommendation by the Board of Zoning
made before a public hearing, the City Council heard this
matter and referred it back to the Board of Zoning on
May 7, 1971.
At the May 20, 1971, Board of Zoning meeting the letter
dated May 7, 1971, from the City Clerk which referred the
matter back to the Board was communicated to the Board for
disposition.
Mr. Ron Vannelli appeared on behalf of the petition,
stating that NSP had requested that Council remove this from
their agenda during the rate permit application but that it
had been reassigned to the May 7, 1971, Council meeting without
NSP's knowledge, at which date it was referred back to the
Zoning Board. He said he would prefer that this matter go
back to the Council next. He claimed that alternate sites
had already been considered.
After considerable discussion during which a motion to
refer it to the Planning Board and a motion to refer it to a ' �

sub-committee for study both failed of adoption, the Zoning �F,�:..,�'�
Board referred the matter back to the City Council.

Dear Sir:
This is written in response to the petition of the Northern States
Power Company to rezone from "B" Residence to Light Industry to construct
a sub-station, property located on the east side of Arundel Street between
West Maryland Avenue and the NP Railway Right-of-Way, and noted in detail
by the legal description on file.
This matter was first heard at the February 4, 1971, Board of Zoning
meeting, at which time the staff report was summarized describing the
property under consideration, the area conditions and zoning, and the
Comprehensive Plan recommendations. A letter from Commissioner Tedesco
was read which suggested that no rezoning should be authorized until NSP
submits a plan showing the location of the transmission lines to and from
the sub-station. The letter expressed concern over the effect of the
sub-station and of the transmission lines, but indicated that underground
lines could not raise the same objections .
Mr. Vannelli and Mr. Jensen represented the amendment for NSP.
Mr. Vannelli emphasized the need for the proposed facility and the advantage
of its location for servicing the area. He said underground transmission
lines are not economically feasible but that all feeders would be underground
with only the high-voltage transmission lines being overhead on poles about
100 feet tall. The lines would be designed to deactivate immediately if
they were knocked down, he said. Mr. Jensen said that NSP has met with
various groups and officials discussing this proposal.
Other interests were represented. Mr. Bernie Edmonds, appearing on
behalf of the Parks Department, indicated concern over the appearance of the
transmission lines from Wheelock Parkway and over their effect on the Loeb
Lake park site. He noted that there is legislation pending on the State
level dealing with placement of lines underground. Mrs. Irv Deneen, President
of the Willow Reserve Committee, expressed the fear that this type of proposal
might spread to engulf the entire area which her Committee is trying to save
for a wildlife refuge. Mr. Merrill Robinson, speaking for the Association of

At this meeting the Board heard a motion to recommend denial, with a
comment that the proposal is unreasonable in a residential neighborhood
and that the area is not suited for this type of development. The motion
was seconded and passed by a 4-1 vote.
The petition was subsequently withdrawn before it went to the City
Council, but it was later resubmitted and heard by the Board of Zoning on
April 15, 1971. At this meeting the staff reported the history of this
matter. A Board member suggested that it should be referred to the Planning
Board since the Planning Board has a plan for some of this property and
should be given ample opportunity to review it.
Mr. Thomas Connelly, representing NSP, explained that this proposal has
been under consideration for about two years and has been shown to various
organizations and agencies. He noted the increased demand for electricity
and said the supply for the area under consideration is in a near-critical
state. He stated that 115 kilo-volts cannot be p�aced underground but that
the proposed poles are aesthetically designed. He said he is definitely
against having this laid over.
Opposing views were presented. Mr. Todd Jeffery Lefko argued in favor
of referring the matter to the Planning Board. He said that the Zoning Board
last considered this matter before this site was placed in the Metropolitan
Open-Space Program. He listed a number of points against the rezoning.
Mr. Stanley Fishman.said he felt people should object more to power lines on
aesthetic grounds. He noted the open-space proposal and urged that this
matter be referred back to the Planning Board. Speaking for MECCA was
Mr. Ernie Willenbring who claimed that technology is available to bury
power lines. He noted the legislative bill regarding placement of lines
and claimed that Minnesota is the only state that doesn't regulate their
placement.
As the Board considered this matter, one member argued that it should be
acted upon since it is a reasonable request presented for the welfare of the
people. Another member expressed concern over the power poles and suggested
the lines should be buried but claimed they won't be if proposals such as
this gain acceptance. A motion to refer the matter to the Planning Board
for discussion and recommendation was made and seconded. It failed by a
3-2 vote. A motion to recommend approval was given the comment that people
need better service, that other sites don't appear to be feasible, and that
costs to the consumer should be held down. The seconding motion also noted
that cost factors should be considered. The motion failed by a vote of 3-2,
thus constituting a recommendation of denial.

Northern 5tates Power Company has recently acquired the following described
property in the City of Saint Paul for the purpose of constructing an electrical
substation thereon to serve the electrical needs of the community:
The W 1/2 of Lot 28, except railroad and except that part North
of the railroad, and the North 390 feet of the W 1/2 of Lot 41,
Cottage Homes, Ramsey County, Minnesota.
In previous discussions with the Saint Paul Zoning Staff and a meeting with the
City of Saint Paul Planning Commission, we were advised that this property,
which is presently zoned "B" Residential must be re-zoned to "Light Industrial"
to permit the operation of a substation under the City Zoning Code.
The signatures of all property owners whose real estate is situated within 100
feet of the property to be re-zoned have been obtained and are submitted herewith
on the appropriate re-zoning petition.
Northern States Power Company, therefore, respectfully requests that the �ubject

NORTHERN STATES I'OWER C(�NIPANY: A petition to rezone from "B" Residence �o
Light Industry to construct a sub-station, property located on the east sfde
of Arundel Street between West Maryland Avenue and ttle NP Railw�y Right-of-Way.
Mr. Rosetter su�narized the ataff repart, a part of the file, stating that the
property under consideration is in two parcels separated by uredeveloped Weat
Orange Avenue. The parcel south a£ West Orange Avenue has a frontage along
Arundel Street of 390 feet with a depth of 170 feet and an area of 66,300
square feet. The north parcel fronts along Arundel Streee for a diatance of
170 feet, This irregular parcel has an area of 39,950 square feet, and the
combined srea is approximately 106,250 aquare feet. The area to the north
is zoned "A" Residence but is separated iErom �his property by the right-of-
way of the NP Railway. The adjoining area to Che e�st and south is zoned
"B" Residence. The area to the west ia zoned Caaanercial snd "B'� Residence9
The Comprehensive Plan originally recommended Zow-density residential for
all of this af�e at 7 dwelling units per scre. In reapons� to an open-space
proposal o£ a citizen's coum�ittee on April 3, 1970, Che Planning Board adopted
the report of its snb-co�ittee which requested an amenciment to the Comprehensive
Plan desigaatiag abont I3 acres betwee�a West Orange Avenue and th� 1VP Railroad
as "open space". Mro Rosetter presented a site plan to the Board. He noted
that the Paxks Department was noti�ied of this rezoning, �nd read the answering
Ietter from Commiss£o�eer Tedesco, which pointed out that no rezoning should be
authorized until a plan has been presented by N5P which would show the location
of the transmission lfnes to and from Che sub-stationo Coacuissioner Tedesco
noted that h� is concerned about the effect of the sesb-atation on property
immediately surrounding the site, and about the effect of the transmissfon
lines on the neighborhoods through which they pass. However, the letter noted
that the same objection could not be raised if NSP is proposing to place the
transmission lines undergrouced. Mr. Rosetter noted that this proposal could
be termed "spot zoning" since there is no other LighC Zndustrial zonfng in
the iumediate area; nor is it presented in the context of a plan which prvposes
this more general area to be an industrial park. The proposed use would be
incompatibie with adjacent residentiel uses.
Representing the petitfon were Mre Ron Vannelli �nd Mr. W, E, Jensen,
Mr. Vaazie113 explained that the proposed sub-statf�n unit is raeeded tas service
all customers in the area, since tt�ey �re in an acute stage of need for

to Couanisaioner Tedesco's correspondence, 1�P has spent r_he last two yesrs

environmental and conservation groups, etc. to convey information on what
they are proposing. He noted there have been n�eetings wfth the Planning
Board ataff, the �'ort Authority, MECCA, the Willow Reseave Committee �
Federal Aviation, etc. He explained there is a need to develap two sub-
stations. One of those (�he western sub-sta�ion� is the propasa3. be£ore
the Zoning Board nowo He noted that a Letter scunmarizing all of their
contacts c� these projects along with route alignments was mailed to
Dro Heiden of the Planning Board staff on D�ce�mber 16, 1970o He said this

discuss the proposal, or to make any type of recommendation. Afr, McParzlin
said that this was discussed un a general basis at the Planning Board

be back before the Zoning Board at �his t�me.

opposition might wish to be he�rd at this public hearing.

a member of the Planning Boarci and would agre� to this being sent back to the
Planning Board for review and reconan�ndation. He noted that when this mat�er
first came up, it was before the time that this si*e was placed in the

space program might be pas�ed soon. The N�F proposa� would ruin any chance
for open space in the area. It has been a bird reserve for years, and now
when the residents are so close to seeing this kept for open space, it could
be lost because of the sub-•station propasalo He reiterated that he would
prefer seeiug this retiurned to the Plannin� Board.
Appearing also in opposition was Mr, Ez-�xie Willenbring, speaking for the
Minnesota Environmentsl �ontrol.o He said NS� wants to embark on a program
f�r burying iir�e� �nd �nr�ybe some sut�-s�:atiazt c��� be elinin�t¢�d< `Ttier� is a
bill before the I,egislature regarding placem�nt of transmission lines. He
noted that Minnesot� is the only s��te ica the unicsn tchst doesn't regu�.ate the

placement of power linesa There is technology that makes it possible to
place lines in shallow trenches so that they woulda't be harmful to either
humans ar animals. For this reason, A�ir. Willenbring said he feels people's
feelings shouldn't hav�e to be compromised. Since other things besides
mortey sre important, people should tiave open space.
Mr. Stanley Fishman, another member of the I'lanning Board, spoke in opposition
to this proposal� He said he regrets the fact that people don't voice their
objections to power poles and don't seem tio be aesthetically inclined. Ae
stated that the Willow Reserve Comsnitte� has spent a great deal of time
attempting to ssve this for open snace, �nd he feels the NSP proposal should
be referred back to the Planning Boarde
Mro Mansur questianed when NSP first scquired the subject site. Mro Connelly
replied that it has been under op�.ion to buy for the past four months, and
noted they tried to acquire another location bu� that was to be transformed
into ?�oeb Lake e
Since his feelings a�e far peopl�, Mr, MaiEtta said t�xis NSP proposal would
serve a 3-mile rgd�us, giving IRO�E' power for their n�eds. He said he feels
it would be a �uperfluoa�5 move to seitd this matter back to the Planning
Board� He feels th� Zs�nin� IIa�rd should take decisive action on the proposal
since NSP has � time problem.

Since he feels this is an "open b�d of weeds", Mr. Maietta said he thinks this
land should be used for so:�iething wosthwhile.
Mrs. Cochrane moved tha� this m�ttex� be referred back to the Planning Board
for f�rther discussion and a recoaattendation. The motion was seconded by
N:r. N!cPartlin, but faiLed by a 3°2 voCe. T�Irs, Gochrane snd Mro McPartlin
voted for the motion, but Messrs, Ames, Maietta, and N;ansur opposed ito
Subsequently, Mr� Maietta moved rox a�provsl of the petition to rezone, stating
that people need better service, aeher site loc�tions don't seem to be feasible,
aad the cost to the consuiner should be held downo �he motion was seconded by
Mr, Mansur, who commen*eri that the cost factor must be considered, and if needs
of the people ar�e urgents im�ediate action is justi£ied. He said the City
Council should make a r�lin� an this rezoning, and the Zoning Board should not
just blindly appose triis� A� th� �o€�ncf_1 level sufficient documentstion can

for placing the lines underground, The motion was seconded by ATrs. Cochrane.
However, Mr. Ames noted that the motion for denial could not be heard since
A'r. P;aietta's motion for approval. had been recognized as a valid motion.
Therefore, a vote was takea on the motian for approval; this failed by a
3-?_ decision, imposing a recommendation of denisl to rezone the land.
r�essrs. r;aietta and Mansur voted for aPprovr�l, but N;rs. Cochrane, Mre Ames,
and Z°r. r;cPartlin voted against the motion.
