Saint Paul Legislative Code, pertaining

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts and Rezoning of certain prop-
erties in the City of Saint Paul, as amended, be and the same
is hereby further amended so as to rezone the follov�►ing des-
cribed p�operty from "A" Residence District to "C" Residence
District, to-wit;
South '� of Lots 16 and 17, Block 2,
Cruickshank's Garden Lots except
south 10� feet thereof=
situate on property located on the North side of East Seventh
Street between Birmingham and Hazelwood Streets in the City
of Saint Paul.
Section 2. This ordinance shall take effect and be in
force thirty (30) days from and after its pas5age, approval
and publication.

A. SUFFICIENCY: In a letter deted July 15, 1971, the Commissioner of Finance
declared the petition sufficient with the owners of 7 of a poasible 8 or
872% parcela having aigned.
B. HISTORY: There ie no zoning fiitta�y for this site.
C. PROPOSED USE: The petition aCates the propoaed uae to be the conetruction of
an apartment building.
D. FRONTAGE AND AREA: Thia property ham • width of 200 feet parallel to East 7th
Street wfth a depth of 243 feet for an srea of 48,600 square feet. This area
combined with the correspondis�g 20fl feet of CotQnercial frontage along East 7th
Street makes a totel area of 68,600 square feet.
E. AREA ZONING: Co�►ercial zoning eaiste along both eides of East 7th Street,
for a depth of 100 feet. "C" Residence Districts exiat adjacent to the subject
property to the weat; in a 62-foot lot on the south side of York at Barclay
and on both sidea of Birmingltani Street at Cese. "B" Residence zoning exists
west of Birmingham. The remaiader of the area ia "A" Residential.
F, AREA PLANS: In the viainiLy of thie site ther� are propoaed plans for two
highweys. These highw�y pleut have been in existence for some time, but
studies are being conducted to find alternete routea. The Comprehensive Plan
for the area recommends highway plana and multi-family development.
G. SITE CONDITIONS: The aite ie vacant and in somewhet of a depression.
H. AREA CONDITIONS: An extenaive area between Johnson Parkway and Hazelwood Street
is not developed to any extent beceuse of aevere topographical conditions.
Three apartment buildings with e total of 45 dwelling units exist on the north
side of East 7th near Birnsinghem. Some aingle-femily homes exist on both sides
of the sub�ect eite and onZy scattered ones exiet along the south side of
East 7th. Most of the remaining lend in the area�ie vacant. Five streets are
open from Johnson Parkway to White BeBr Avenue, East 7th Street, Case Avenue,
East Minne�hahe Avenue� Reaney Avenu�� and East 3rd Street. Flandrau Street
is the only improved etreet �rthu Bast 3rd Street to Case Avenue. �

Dear Sir:
This is written in response to the petition of Richard J. Coverdale to
rezone property from "A" to "C" Residence in order to construct a new
apartment building located on the North side of East 7th Street between
Birmingham and Hazelwood Streets, and noted in detail by the legal
description on fi1e.
This matter was heard at the August 19, 1971 Board of Zoning public
hearing. The staff report on file was read and facts both favoring and
opposing noted,
Mr. Richard J. Coverdale represented the petition saying the site is
undeveloped and exists in a depression requiring fill. He stated that he
proposes the buildings to be toward the rear of the property and that he
does not intend to develop adjoining streets but use only the East 7th �
frontage for access.
A resident of the area appeared in opposition, expressing concern for in-
creased traffic and overcro�ading, She further stated that apartment develop-
ment leads to assessments to adjoining property owners for improvements.
As the Board discussed this matter, it was argued that other apartment
developments are located on unpaved streets, and that this site probably
could not be used for anything else. It was further noted that the East 7th
frontage of this site is already Commercially zoned.
Subsequently, the Board heard a motion to reco�end approval. The motion was
seconded and carried by a vote of 3 to 1. The descenting vote was cast with
an expression of reservations about "piece-meal" zoning and about the lack of
evidence showing that the property is unsuitable for anything but apartments.

pie�ce of property in question i� unc�eveloped and hss a Eevere depression
of 25 f��t aloag �ast 7th Sereet. T"he property mus� be filled and compacted
ia. order to build upon it; tre�s do exist on the property. Ia Mx. Coverdale` s
o��inion, it would be to the city`s best i�terest to develop the property
according to his Pronosal.
I�. Maietta asked Mr. Coverdale if he inttnded to fill ths pruperty to which
hc replied h� did. Mr. Coverd�l� no�c�d upoa a question trom the �udience

A woman from th� audienc� asked ia the frontsg� for the building and the

driveways from th� parking lot would be on Bast 7th Street, to which
Mr. Coverdals replied that they would. Mr. Coverdale also noted he dces
not iatend to ask for sereet develop�ent.
Mr. Rosetter noted that Stillwater Avenue is vacsted between the cul-de-
sacs,
A womaa from the neighbozhood spoke in opposition to the proposal. She
noted that aay apartme�� g�nerates a lot of traffic and children. Iiazel
Park Junior High School and Harding High School are overcrowded now aad
the advent of more children would make the situation impossible. Also,
whea an apartiment buildiag is puC in, it is usually necessasy to bring ia
assessments which the other neighbors do aot want and will end up peying for.
Mr. Msietta seid haviag �he stre�ts paved should be ao problem as there
are maay other apertment buildings in St. Paul that are on uapaved streets
with ao curbs or siaewalks and there are no problems. He said the Board
should not be coacerntd with this proble� at this tisae. In his opiaion,
the site probably could not be used for anything other than arartmeat
buildings aad it is right next �o existing commercial noca.
It wss moved by Mr. Mai�tt� and seconded by Mr. �enshoof to approve the
rezoning petition. The motion earried by a �-1 vote with Mrs. Cochrane
casting the �gative vote because she has sev�re reservations about re-
zoniag vacant property in this area snd she does not like "piece-no�al"
zoning. There i� no evidence which shows tha�: this property is unsuitsble
for Anything other than apartments,
