This is written in response to the petition of Douglas M.
DeCoster to rezone from "A" Residence to Commercial property
located in the block bounded by East Idaho Avenue, 35E, vacated
Sloan Street, and East Wheelock Parkway, and noted in detail by
the legal description on file.
This matter was heard at the January 7, 1971, Board of Zoning
meeting. The staff report indicated that this particular case
represents a challenging decision from a planning standpoint. Two
factors recommend the rezoning of this site: 1) the fact that it
is adjacent to a freeway exit, and 2) the fact that it is just
across Wheelock Parkway from another Conanercial establishment.
Also, two factors recommend against the rezoning of this site:
1) the fact that the triangular area bounded by Wheelock Parkway,
the Soo Line Railroad, and the freeway is zoned exclusively
residential except for a Light Industrial District at the south
corner of this area, and 2) the fact that Wheelock is a parkway.
The staff reviewed the zoning along other parkways, concluding
that those streets designated as parkways have very little
Commercial or less-restrictive zoning except for Ford Parkway.
Wheelock Parkway itself usually has Commercial frontage only
where it crosses other arterial streets and then the use is
oriented toward those other streets. The staff report stated
that the Commercial use across Wheelock Parkway from this site
could be considered as being oriented toward Larpenteur Avenue.
The report said that the subject site could similarly be considered
as being oriented toward the freeway. With this in mind, it could
be said that a rezoning would not set a precedent for rezoning
other Wheelock Parkway frontage.
Mr. Tony Danna, attorney for the petitioner, explained that
the proposed use of the site is a filling station, and that it
may be considered as being oriented toward the freeway, but that
direct access from the exit ramp itself is not possible.

Mr. Wayne Zuehlke represented those appearing in opposition.
He presented a petition of those opposing the rezoning. He said
these people feel the character of their neighborhood is residential
and that this proposal would be incompatible with it. He noted the
�arge sign that would be required for freeway advertising. He claimed
that the station across Wheelock Parkway is oriented toward Larpenteur
Avenue with only a narrow frontage on Wheelock Parkway.
In discussing this matter, the Board noted that a former petition
to rezone this site had received a recommendation of denial by the
Zoning Board and was withdrawn prior to the Council hearing. The
suitability of this site for single-family dwelling development was
discussed. Traffic at the frontage road and Wheelock Parkway inter-
section, as well as through the neighborhood, was considered.
Subsequently, a motion to recommend approval was made and
seconded. The motion lost by a vote of 3-2, thus determining a
recommendation of denial.

Mro RoseCter summarized the staff report, a part of the file, staein� that

Wheelock Parkway to the north. To the staff, there seems to be some

He noted that Wheelack Paskwsy is a parkway and the Zoning Board may w�nt
to give some consideration as to how parkway frontage in the City should
be used. He poin[ed out thst on Lexington Parkway there is a strip
running from I-94 to Ua£versity Avenue �:hat is zoned C.omnexcial. Ford
Parkway has about 50% of its frontage zoned Coa�nercfal Ar 1es8 restrictive,
but it doesn't have a parkway character ei.the�e. Most other pa�kways in tne
City have very little Cacena�rcial use on them. On Wheelock Parkwny most
Commercial use ie orien�ed toward the streets which it crosses, such as
Rice Street. Mro Rosetter sta�ed that it c$n be argued that this site Coo

Parkway. The Tra£fic Engfn�eer suggested �hat the petitioner keep fn mind
the fact that signalization is plsn�ed and that driv�ways for �he fi3ling
atation would have to be the right distance� etc�

stated that this does not necessarfly mean ehat of the 5 tracts, there
were 5 different ownera.
Mr. Danna asked i£ the 18 families represented on Che petition in opposition
live within 200 feet, and Nr. Zuehlke said not all di them do.
In response to Board discussion relati�g to a former rezon�ng petition in
1964 for this property, Mr� RosettQr pointed aut that the minutes from the
Zaning Board meeting on Ch�t matter did not presen� a stated �eason for
the Board's recommendation of deniala He noted that the geCition was
withdrawn prior to the public hearing before �he City Cou�cil�
Mr. Maietta said he doesn't feel a gas station increases traffic to any
great degree since peaple of the neighborhood woald use �he f�cility.

Nrse Cochraae, Mr. McPartlin, and Mre Ames voted aga�.nst the motian for

A. SUFFICIENCY: The Commissioner of Finance, in a letter dated December 4, 1970,
with the ownerSof 5 of a possible 5 (100%) tracts having signed the petition.
B. HISTORY: A petition to rezone to Commercial Lots 12-15, Block 2, Kavanagh and
Dawson's Addition was heard by the Board of Zoning on March 19, 1964. The
proposal wae to install a filling station on this property with eventual
development of Commercial uaes along the freeway. The Board of Zoning recommended
that the petition be denied. On April 1, 1964, the Cit_y Council granted the
petitioner's request to withdraw the petition.
C. PROPOSED USE: Develop the site with a filling station.
D. FRONTAGE AND AREA: The property has a frontage of 164.83 feet along Wheelock
Parkway with a depth of 160.5 feet, resulting in an area of 26,455.22 square feet.
E. C(7NIPREHENSIVE PLAN: The Comprehensive Plan reco�nended a diagonal freeway to the
northeast to align with Interstate 35E at Highway 694. Recent area studies tend
to indicate rezoning in the Area to limit development to multi-family use.
F. SITE CONDITTONS: The site is vacant and slopes down to the south. The property
is approximately 5 feet below the grade of Wheelock Parkway and the off-ramp of
35E. There is no acceas to the property from the off-ramp.
G. AREA CONDITIONS: To the west is the freeway; north a service station oriented
toward Larpenteur Avenue, and single-family residences; to the east are single-
family residences; and vacant to the south.
