THE COUNCIL OF THE GITY OF SAINT PAUL DOES ORDAIN: Section 1. That Chapter 54.07 - DEFINITIONS of the St. Paul Legislative Code is hereby amended to include the following definition, which shall appear in Chapter 54.07 in proper alphabetical order: LET - Let shall mean to lease or to grant the use and possession of real property, whether or not for compensation. Section 2. That Chapter 54.0'7 - DEFINITIONS of the St. Paul Legislative Code is hereby amended by striking the definition OWNER in its entirety and substituting in lieu thereof the following: OWNER. - An Owner shall mean owner or owners of the freehold of the premises or lesser estate therein, holder of an unrecorded contract for deed, a mortgagee or vendee in possession, assignee of rents, receiver, executor, trustee, lessee, other person, firm, or corporation in control of a building. Section 3. KLAS �o�e:ti9ecor CorpontionCoun�al February 16, 1971 The Honorable Mayor and Members of the Saint Paul City Council A problem has arisen in the prosecution of persons, sometimes referred to as slum landlords, for Housing Code violations. The definition of the word "let", for addition to the list of definitions in Chapter 54.07, is intended to alleviate a legal teehnicality that confronts prosecutors in the enforcement of our Honsing Code. No definition is currently in the Code and in the past, prosecutors were bound by the word' s normal legal meaning, which put the burden on them of proving up the existence of a lease. In many situations faced by prosecutors there was no lease in writing. Also, restricting prosecutors to only those situations where a lease existed hampered Housing Code enforcement in the multitude of situations where an informal agreement existed between the occupant and the real owner in interest without a lease. The definition proposed in the ordinance is expansive enough to include almost any kind of relationship between an owner and occupant of the premises. The ordinance also includes an expanded definition of �'owner". The defintion is the same as currently exists with the exception that it now includes the phrase "holder of an unrecorded contraet for deed". Many owners of property either through ignorance or intentional avoidance do not record their contract for deeds. Such a person can obviously exercise a great deal of control over the buyer of a particular premises, and the inclusion of such a person in the Code will assist the City with the enforcement of our Housing Code. Many situations have arisen in the last few years where criminal prosecution for the enforcement of otzr Housing Code have been stymied because the only person we could hold accountable was the "holder of an unrecorded contract for deed".
