31g. 12 CITY DEPARTMENT MAY COLLECT SOLID WASTE
The Department of Public Works shall collect solid waste
from property located within corporate limits of the
City of Saint Paul from such property owners as shall
request such service . For the purpose of carrying out
this authority, the Department of Public Works may
prepare rules and regulations applicable to city
collection and collection by private haulers . Said
rules shall govern the collection of solid waste ,
and the Department of Public Works shall submit such
rules and regulations to the City Council for approval .
If approved, the rules and regulations and any amend-
ments thereto shall be enforced by the Department of
Public Works . A copy of all approved rules and regula-
tions and amendments thereto shall be maintained on
file in the Office of the City Clerk and shall be
available for public inspection during normal business
hours .
319. 13 OWNERS MAY REQUEST CITY COLLECTION
Owners may make written request to the City to have
solid waste collected and removed from their property.
Such written request shall be made on forms prepared
by the Department of Public Works and be filed with
the said department . The Department of Public Works
will mail said forms to home owners upon written or
telephonic request . Such forms shall be prepared and
made available within 15 days of the date of this
ordinance . Said forms will be automatically mailed,
within 30 days of the date of this ordinance , to each
household receiving garbage pickup by the City as of
June l , 1971 .
319. 14 R.ATES FOR SOLID WASTE COLLECTION
It is the intent of the City Council that the City' s
solid waste service shall be operated on a finan-
cially self-sustaining basis . However, until such
service is financially self-sustaining, funds shall
be provided by the Council to maintain city waste
collection service at the level as of June l,, 1971
for a period of 90 days from and after July l , 1971 .
The City Council shall establish rates for solid
M.,�,.._..._.� waste collection by ordinance within 60 days of the
date of this ordinance . The proposed rate ordinance
and amendments thereto shall be published in the
official newspaper of the City at least 30 days
prior to public hearing to be held for the purpose
of considering and establishing such rates . Rates
for solid waste disposal shall be charged against
the premises from which solid waste is collected
and the owner of the premises served shall pay such
rates within the time specified in the rate
ordinance . The Depar-tment of Public Works may
certify unpaid�-c-ollection charges to the County
Auditor with the taxes against the property served
and in that event the rates shall be collected as
other taxes are collected.

There is hereby established a fund to be known as the
"Solid Waste Collection Fund (Rubbish Disposal Fund)"
which fund sha.11 be a continuing fund to which sha.11
be credited all receipts and to which sha.11 be cha.rged
all costs incurred incident to such activities. This
fund shall be kept as a separate and distinct fund
from any and all other city funds and sha.11 be used for
the purposes set forth in Section 319. 14 and sha.11 be
used for no other purpose.
319.16 SOLICITATION OF NEW ACCOUNTS
The Department of Public Works shall notify each house-
hold, within 30 days from the date of this ordina.nce�
in the City of Saint Paul� advising each household as
to the provisions of this ordinance and the availability
of City combined garbage and trash pickup services.
319.17 SOLID WASTE REVIEW BOARD
There is hereby created a Solid Waste Review Board made �
up of five citizens of the City of Saint Paul appointed
by the Mayor and approved by the City Council. Such
board sha.11 serve for a period of two years except tha.t
the first board sha.11 consist of two members who sha.11
be appointed for a one-year term and three members who
sha.11 be appointed for a two-year term; and thereafter
all members sha.11 be appointed for a two-year term.
The cha.irman of the Solid Waste Review Board sha.11 be
appointed by the Mayor and approved by the City Council.
The board sha.11 hear citizen complaints and make recom-
mendations to the City Council concerning solid waste
matters .
Section 2.
Th,i�s ordina.nce sha.11 take effect and be in force thirty (30) days
from and after its passage, approval and publication.

319.02 Definitions - For the purposes of this ��iapter the following terms

Compostina - is the controlled biological c�ecomposition of selected
solid waste in a manner resulting in an innv�uous final product.
Coltectinct and Transportinq Service - is an a$ency, business, or
servtce, either governmentalty or prtvately op�rated, for collecting,
transferring, compaeting, and/or transporting s�lid waste for
disposal purposes. �
Garbaqe - is discarded material resulti�g from th handiing,
processing, storage, preparation, serving, and con umption of food.
Incineration - is the process of burning wastes for the purpose of
volume and weight reduction in facilities designed f r such use.

kind.
Sanitarv landfill - is a thod of disposing of solid wastes on land
without creating a nuisanc or hazard to the pubtic health, safety,
and general welfare, by utii zing the principies of engineering to
confine the solid waste to th smatlest practical area, fio reduce it
to the smeliest practical votu e, and to cover it with a layer of
earth at the conclusion of each ay's operation or at such more fre-
quent intervals as may be requir in order to comply with this
definition. �
Solid Waste - is garbage, refuse, a�id other discarded solid mafieriai ,
or other organic waste, except anima� wastes used for fertilizer,
including solid materials resulting f�im residential , industrial ,
commerciai , and agriculturai operation , and fran community activi-
ties but does not include earthen fiil ,��oulders, rocks, and other
material normally handled in constructio operations, solid or dis-
solved mater�als in domestic sewage, or o� er significant pollutants
such as siit or suspehded solids in indust al waste water effluents,
dissolved roaterials in irrigation return fl s, or other canman water
pailutants.
5olid i�ste Collection - is the gathering of sa�lid waste from public
or private places.
Solid Waste ,Di�. s�osal�Operations - are the site o sites, factlities,
operating practices and maintenance thereof for t e utilization, pro-
cessing, treating, or final disposal of solid wast s, including, but
not limited to, land disposal , incineration, compos ing, reductian,
shredding, compressing, milling, baling, and salvage f such solid
wastes.
Solid Waste Storaqe - is the holding of �olid waste ne�,r the point of
generation.
Solid Waste Transportation - is the conveying of solid w te from one
place to another by means of vehicie, ra� l car, water ves el , convey-
or, or other means.
Toxic or Hazardous Wastes - are waste materials including, ut not
limited to, pesticides, acids, caustics, pathotogical wastes� radio-
active materials, flarnmable or explosive materials, and simil r
chemicais, and other harmful wastes which ��quire special hand ing
and must be disposed of in a manner so as to protect the pubiic�and
conserve the environment. �

319.03 Solid Waste Licenses
�' a. Licenses Required - No person, firm, or corporation shall collect,
� transport, transfer, treat, handle, salvage, utilize, compact,
`� shred, compost, incinerate, mill , bate, or dispose of, or any com-
\,bination thereof, any solid w�ste within the city limits of
�5.t. Paul , except as ofiherwise provided herein, without firsfi ob-
tay,ning a license so to do. This provlsion shall not appty to
govarnmental agencies engaged in such activities nor to private
owne�'s or occupants invoived in such activities in connection
with fiheIr own solid waste, including the incineration of solid
waste generated at the same pr�nises or location when reduced in
an approv�d incinerator, composting of leaves, grass� and similar
material by� individual owners or occupants utilizing materials
from their n premises, and the disposing of garbage on the same
premises or 1 afiion as generated with a proper garbage grinder.
Licenses issue pursuant to the provisions of this chapter shali
be issued for a riod of one ye�r comnencing January 1 , and
expiring pecember 1 .
b. Appiication and Fee - Applications for such ticense shall be
obtained �From the Ci Clerk, and when completed shall be sub-
mitted together with t e required license fee fio the City Clerk.
The City Cterk shail tr smit said application to the Department
of Public Works. The Dep rtment of Public Works after review a�nd
inspection of the appticat on, plans, site, facility or equipment
shall report to the City C1 k regarding the applicant's compti-
ance with the applicable stat statutes and city ordinances. If
found to compty, the City Cl�r shalt issue the ticense; or, in
the case the application, plans, site, facilities, or equipment
do not comply, the City Cierk sha 1 notify the applicant of the
reason for such noncompliance.
The annual fee for the iicenses requi ed under this chapter shall
be $500.00 for each site, location, fa ility, or piece of equip-
ment except that for each coliector ar uler of solid waste, the
license fee shall be $100.00 for each tru k.
c, insurance Required - No license shall be g anted under this chapter
or shall become effective until the license shall have filed with
the Department of Public Works a copy or cer ficate of insurance
protecting the licensee from claims for damage and bodily injuries
inctuding accidental death as well as for claim for property
damage which may arise from operations involving Il phases of
sol �d waste disposal nperations as herein defined ithin the City
of St. Paui . The minimum amounts of such public ti bility shall
be as fottows:
Bodily injury insurance (including death) in an amo nt not
less than one hundred thousand dollars ($10�,000.00)� for all
damages arising out of bodily in�uries to or death of one
person, and subject to the same limit for each person n a
totai amaunt of not less than two hundred thousand doll rs
($200,000.00) on account of any one accident.

Property damage insurance in an amount of not less than
fifty thousand doilars ($50,000.00) for ali damages to o�
destruction of property in any one accident.
Insurance policies shall run concurrentiy with the license
period and copies or certi�Ficates of such policies shall be
filed with the Department of Public Works prior to the
issuance or reissuance of such license.
d. Revo ation or Sus ension of Licenses - The City Council may
suspe or revoke such license when the licensee neglects or
faiis t comply with the provisions of applicabte Minnesota
statutes, city ordinance, and the rules and regulations of
the Depar ent of Public Works with reference to solid waste.
e. License to e Dis la ed - A1l ticenses issued in accordance
with this ch ter shall be disptayed where fihey can ba readily
seen in or on he site, facility, or equipment for which such
license is issu and in accordance with Public Works aepart-
ment rules a�d re ulations,
f. Re uirements of Li ensee - Each licensee shall submit a list of
maximum advertised arges in connection wtth his operations or
service to the Public Works Department at the fiime of the initial
application for licens and such charges shall not be increased
except by submitting a vised list of charges to the Public
Works Department at least thirty days prior to the effective date
of such changes. The Pubtt Works Department shatl report such
revised charges to the City ouncil prior to the effective date
of such proposed inerease. A licensee who shatl increase
charges prior to the above proc dure shall have his license sus-
pended immediately and shall be equired to appear before the
City Council for consideration of evocation of his license.
g. General Reaulations - In connection with solid waste d�sposal
operations licensed under this secti , the entire operation
shall be carried on in such a manner at it does not create
excessive noise, dust, or odors.
Adequate fire protection shalt be provide in loading, unloading,
storage, and handting areas.
An adequate, continuous rodent and insect co trol program shalt
be carried on at the site.
Such facilities shall be located in areas that re properly zoned
for the purpose and shall be equipped, operated, nd maintained
in such a way as to minimize the interference wit other activi-
ties in the area. Adeguate sanitary facilities sha 1 be provided
in the facility for employees. a
h. Identifyina Siqn - A sign shatl be posted at the entr ce to the
facility identifying the operation and indicating the rmal hours
of operation, and access to the facility shali be provi d only
during such hours. The sign shali be such as to comply ith the
requir�nents of the Minnesota Poltution Control Agency as eli as

other facility intended to store, handle, treat, utilize, or dispose of
olid waste, plans and specifications shatl be submitted to the Public
W ks Department for appraval . In addition to approval by the Pubiic
Wor s Qepartment, approval wiii be required by the County of Ramsey,
Metropolifian Council , and the Minnesota Pollution Control Agency.
319.05 Solid Waste Storaqe
,
a. Respon�ibilitv - The a�vner and/or occupant of any premises, business
estabtis'#�ment, or industry shalt be responsible for the sanitary
storage o'F all solid waste accumulated or stored at that premises,
business e��ablishment, or indastry.
b. Containers -�.,Soiid waste containing garbage and putrescible wastes
when stored o�.,t of doors shali be stored in durable, rust resistant,
nonabsorbent, v�atertight, rodent proof, easily cleanable containers
with close fittiiog, fly-tight covers. The maximum capacity for
storage container�, intended to be handled manually during coitection
shall be thirty twd,�(32) gallons. Rubbish shali be stored in dur-
able containers with`�proper covers. In no case shall the storage of
solid waste in plasti�. bags be allowed except for materials such as
leaves, lawn clippings;��1and similar materials. Other types of con-
tainers which may not me�t all of the requirements above but which
wiil facilitate solid was$e storage, handling, and cotlection in a
safe and sar�itary way may � approved by the Department of Public
Works. ,,
All containers for the storag�of solid waste shall be maintained
in a manr�er which will prevent he creation of a nuisance or menace
to the public health, safety, an generat welfare. Containers
which are damaged, broken, or oth ise create a nuisance or menace
ta public heaith, safety, and gene 1 welfare shatl be replaced with
an acceptable container.
c. Stora e of Toxic or Nazardous Materia s - Toxic or hazardous materi-
als or substances to be disposed of sh 11 not be stored with regular
solid waste but shali be stored in a sa locafiion in accordance
with appiicable provisions of the regulat'ons of the City of St. Paul
and the State of M�nnesota.
d. Location of Containers - Containers for sol waste storage shail be
kept in locations that do not create a nuisa e and such location
shall be maintained in a manner acceptable to he Public Works
�epartment. In no case shall the containers be kept in alleys or
on boulevards except on the day of collection. en so approved
by the Fublic Works Department, such containers m be placed at
the alley line or on the boulevard at the curb at e front of
the property.
e. Solid Waste Not Suitabte for Storaqe in Containers - ees, tree
limbs, wood chunks, cardboard, and similar rubbish shal b� stored
in a manner so as not to create a nuisance or a rat harb rage.

b . Operations and facilities - Vehicles or containers used for the
col�,ection and transportation of solid waste containing garbage and
putrescible waste shall be durable, rust resistant, leakproof, and
easily`•.�cleanable with tight fitting covers of a type approved by
the Dep�r-tment of Public Works. Such vehicle or container shall be
maintained in good repair and shall be properiy cleaned to prevent
a nuisance\or insect breeding. Vehicles and containers used for the
coliection and transportation of all solid waste shall be loaded and
moved in sucFi�.a manner that contents witi not fall , spill , or leak
therefrom and ��iall be covered to prevent blowing of mafierial . Where
spillage does oc�ur for any reason, the material spilled shail be
picked up immedia�,ely by the coliecfior or transporter and returned to
the vehicle or contatner and the area properly cleaned up.
Where garbage and otFit�r putrescible wastes are included in the
solid waste from any pt,emises, business establishment, or industry
such solid waste shall 6� collected at least once every seven cal-
endar days unless due to ��onditions acceptable to the Public Works
Oeparfiment and the Bureau b�f Health, a longer time is approved.
c. Toxic or Hazardous Materials��,- Toxic or hazardous materials to be

disposed of shall not be coll�cted or transported with other solid
waste unless such combined col�,ection and transportation is
approved by the Public Works �ep�artment and shail be in accordance
with the state and local regutati'a�ns.
d. Containers for Collection - Where cQllection or pickup is by manual
means, containers for collection shayl be of a maximum size of 32
gallons. For the purpose of handling�,solid waste during collection,
all solid waste may be contained in pl�.�stic bags when such arrange-
ment for collection has been approved byti,the Public Works Depart-
ment. In no case shall piastic bags cont�ining solid waste for
collection be piaced exposed out of doors 'f�or periads of more than
twetve hours except under conditions beyond`�reasonabie control by
the owner, occupant, or coilector. l��

a. Responsibilitv - The owner and/or occupant of any premises, busi-
ness establishment, or industry involving a facility operated for
1 the transfer, treatment, salvaging, composting, shredding, c�n-
�� pacting, or otherwise handling solid waste shall be responsibie
for the maintenance of such facii �ty in a manner which is not
'��. detrimental to the health, safety, and general welfare of the pub-
`�lic and is in accordance with the provisions of this chapter and
ths rules and regulations of the Department of Pubtic Works.
b. Opexations and Facitities - All operations and facitities for the
tranifer, treatment, salvaging, composting, compacting, shredding�
or otf�,erwise handling solid waste shall be carried on in facilities
design�l for the purpose approved by the County of Ramsey, the
MetropoT��tan Council , and the Minnesota Poltution Control Agency,
and liceri�sed by the City of St. Paul .
All solid �aste involved in the operation of the facii �ty shall
be confined '�o adequate, enclosed areas for dumping, storage, and
handling. Ac�ess to the facility shall be provided only at times
that are approited and when authoriaed employees are on duty at
the facility.
Adequate equipmen�t and facilities shall be provided to clean the
loading, unloading�, dumping, storage, and handiing areas; and iC
is required that the entire facilifiy be maintained in a sanitary
condition at ali times.
Solid waste which is tb be finally disposed of at a sanitary land-
fili or other disposal 's,ite is to be removed daily to such site.
319.08 Incineration
a. Responsibilitv - The owner �d/or occupant of any premises, busi-
ness establishment, or industw•y involved in the operation of an
incinerator for the reduction `'�of solid waste by incineration shall
be responsible for the operation and maintenance of such facility
in a manner consistent with the `�ealth, safety, and genera1 wel-
fare of the public and in accorde?�ce with the provisions of this
chapter and in compitance with the`�:,provisions of the Minnesota
Pollution Control Agency. `�
b. �acitities and Oaeration - Atl faciii��ies and operations for the
reduction of solid waste by incinerati�bn and any attendant opera-
tion as listed in 319.07 that may be ca�ried on in conjunction
with incineration at the same premises s`�ail be carried on in a
facility designed for the purpose and app�oved by the County of
Ramsey, the Metropolitan Council , the Minn�sota Paltution Controt
Agency, and as approved end licensed by the City of St. Paui.
Ail solid waste invotved in the operation o�he facility shatl

a. Res,ponsibititY - White it is not anticipated that there wiil be
any public or priva�e sanitary landfill operation within the city
limits of fihe City o�., St. Paui after the closing of the Pig�s Eye
landfill operation, thl�se provisions are included in the event that
the availability of sit�s in other iocations makes it necessary to
utilize relatively small�`,areas that may be available. Such sitss,
with certain specific var�i•a�ces from the Minnesota Pollution Control
Agency, the County of Ramsc�, the Metropolitan Council , and the
City of St. Paul , may be req'�ired for the disposal of solid waste
within the City of St. Paui . '',The owner and/or occupant of any
premises to be utilized for th�, purpose of a sanitary landfill dis-
posal area shail be responsible`�for the operation and maintenance
of such facility in a manner consYStent with the heaith, safety,
and general welfare of the public �and in accordance wfth this
chapter and in eompliance with a11 applicable state laws.

any public or private sanitary Zandfill ape�-ation within the city `
limits af the City of St. Paul after the closing of the €'ig's Eye }
lancifill c�peration, these provisions are included ir. the event �hat `
the availabiiity �f site.s in other locations makes it necessary to , �
utilize relatively small areas that may be avaii�ble. Such sites, �
with certa�n spe�ific variances fram the Ptinnesota Poliution Control
Agency, the County of R�?msey, the Nie.tropolitan Cauncil , and the �
City of St. Paul , may be required for the disposal of solid waste �
within the City of St. Paul . The owner and/�r occupant of any
premises to be utilized for the purpose af � sar�itary landfill dis- �
�osat area shall be respo�sible for the operation and maintenance �
af such facility in a manner consistent with the health, safety,
and genera3 wetfare of the pubiic and in accordance with this � �
chapter and in comptiance with all a�plicable state laws rke �
