' "�` � � � ORbINANCE 2��8��' ' COUNCIL FILE NO PRESENTED BY ORDINANCE NO An Ordinance amending the Saint Paul Legislative Code by adding thereto Chapter 378 which provides for regulating the installation, construction, alteration, management, operation and maintenance of public steam baths, heat bathing rooms, massage parlors and saunas, and regulating the employees of such establishments. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 . That the Legislative Code of the City of Saint Pa�l is hereby amended by adding thereto Chapter 3'78 which shall read as follows: .O1 Definitions (a) City Health Officer shall mean the Health Officer of the St. Paul Bureau of Health or his agents. (b) Steam bath, heat bathing room and sauna shall mean a room or rooms used for the purpose of bathing, reducing body weight orr�laxation, which utilizes steam or hot air as a cleaning, weight reducing or relaxing agent. (c) Sanitize shall mean adequate treatment of surfaces by a process that is effective in destroying v�getative cells of pathogenic bacteria and in substantially reducing other micro-organisms. (d) Sanitary shall mean free from the ve�tative cells of pathogenic micro-organisms. (e) Adequate or approved shall mean acceptable to the City Health Officer following his determination as to conformance with public health practices and standards. (f) Mt��sage parlor shall mean any room or rooms wherein a person for a fee may receive from another person a massage. .02 License. Any person or corporation engaged in the operating, conducting or keeping of the business of steam baths, heat bathing rooms, massage parlors and saunas shall obtain, from the Council of the City of Saint Paul , a lic�nse before engaging in the operating, conducting or keeping of such business. The annual fee for �.ch license shall be �100. All persons engaged in the operation, conducting : or keeping of steam baths, heat bathing rooms , massage parlors and saunas either as an owner or employee or volunteer, shall , in addition to any other license required by this chapter, obtain an individual license from the Commissioner of Public Safety before engaging in such work. The fee for the individual license shall be �3.00. All persons engaging in such work shall submit, before the granting of a permit, to being fingerprinted and photographed at the St. Paul Public Safety Building. Fingerprints and photographs shall be kept on file at the Public Safety Building. .03 Construction Requirements. (a) Al1 public steam baths, heat bathing rooms , massage parlors and saunas shall be constructed of materials which are inpervious to moisture, bacteria, mold or fungus growth. The floor to wall and wall to wall joints shall be constructed to provide a sanitary cove with a minimum radius of one. inch. (b) A minimum of 15 foot candle of illumination shall be supplied in all work areas. A hand washing sink equipped with hot and cold running � water under pressure, and a sanitary towel dispenser shall be provided for personnel . (c) All other equipment used in connection with public steam baths , heat bathing rooms , massage parlors and saunas shall be of sanitary design and construction which will permit frequent and thorough cleaning and sanitizing. .04 Plumbin�, Gas and Electrical Installations. (a) Public steam baths, heat bathing rooms and saunas shall be equipped with a floor drain. (b) Public steam baths , heat bathing rooms , massage parlors and saunas shall conform to all applicable city codes and ordinances relating to gas , electrical and plumbing installation. � , • , . . /.+��V�� ���� � Page 3. .05 Health and Disease Control. No person while affected with any disease in a communicable form, or while a carrier of such disease, or while affected with boils, infected wounds , sores, or an acute respiratory in- fection, shall work in or use the services of any public steam bath room, heat bathing room, massage parlor, or sauna in any capacity in which there is a likelihood of such person contaminating surfaces with pathogenic micro-organisms, or transmitting disease to other individuals; and no person known or suspected of being affected with any such disease or condition shall be employed or permitted in such an area or capacity. All employees shall wear light colored outer garments, maintain a high degree of personal cleanli- ness, and conform to approved hygienic practices while on duty. They shall wash their hands thoroughly in an approved handwashing facility before starting work and as often as may be necessary to remove soil and contamination. Linen shall be clean and laundered, handled, and stored in an approved manner. All linens shall be white with no markings or names thereon. .06 Maintenance of Facilities. (a) Floors, walls, ceilings, water closets, hand washing sinks and urinals shall be in good repair and maintained in a clean, sanitary condition at all times. (b) Sanitary hand cleaning agents, sanitary towels and toilet tissue shall be provided at all times. (c) Adequate refuse receptacles shall be provided and emptied and cleaned as required. .0'7 Submission of Plans and Specifications. All persons who hereafter construct, extensively remodel or convert buildings or facilities for use as a public steam bath, heat bathing room, massage parlor or sauna shall conform and comply in their construction, erection or alteration with the requirements of this ordinance. PRESENTED BY ORDINANCE NO '/ Page 4. layout, arrangement and plumbing and construction materials of the bathing areas, and locations, size and type of equipment and facilities shall be filed by the owner in the office of the City Architect. The City Architect shall not issue a building permit for any such construction, remodeling or alteration until such permit shall have the approval of the City Health Officer. .08 Business hours; inspection. All steam baths, heat bathing rooms, massage parlors and saunas shall open for business no sooner than 8;00 a.m. and clo��,,� for business no later than .��Ifi�Zring business hours all steam baths, heat bathing rooms, massage parlors and saunas shall be open to inspection by officers of the City Bureau of Health and Bureau of Police. .09 Rules and Re�ulations. The City Health Offic� shall make such rules and regulations as are reasonably necessary to the safe and sanitary operation of public steam baths, heat bathing rooms. Such rules and regulations shall be effective when filed in the • office of the City Clerk and amendments thereof shall _ be effective twenty (20) days after being so filed. Violations of such regulations shall be a misdemeanor and upon conviction shall be suffieient grounds for revocation of any and all licenses issued pursuant to this chapter. .10 Penalty. A violation of any section of this ordinance shall constitute a misdemeanor. The licenses mentioned in this chapter may be revoked by the Council for any � violation of the provisions of this chapter. Section 2. This ordinance shall take effect and be in force thirty (30) days �rom and after its passage, approval and publication. All employees shall wash their hands thoroughly in an approved hand- washing facility before starting any body massaging. � 3. A11 massage tables are to be provided with single use linen or a single use disposable pap�r sheet covering that is widQ and long enough to cover the complete table top. A11 towels are to be laundered in an approv�d manner after each use. A]1 used linen and towels are to be stored in an approved recepticle. 4. On1y single set•vice disposable drinking cups shall be allowed within the establishment. 5. All custamers sha]1 inform the operator of any medical disabilities prior to use of facilities. , 6.
