We aze in receipt of CPMI's 07 October 1996 correspondence regazding rype "B° skylights, wherein you reject our
position that these skylights are not included in Mortenson's scope of work, and maintain that tf�ey are to be
provided by the Contractor at no additional cost to the Owner. We do not agree with your statements, as you cite
Specifications out of context.
You refer us to plan A270, detail 1/7-8, and Specification 8950, which, in your opinion, is all inclusive of the
information necessary to determine that pyramid skylights are included in the Work; and, how pyramid skylighu are
to be constructed. Reviewing this information, we futd:
• Plan A270 indicates only that there aze nine squaze openings in the roof.
• Detail I/7-8 illustrates only a curb detail, buc does refer to a single black line as a"translucent skylight system.°
• Specification 8950 addresses only the barrel skylight over the Special Exhibit azea.
No further design criteria is provided in the Contract Documents for pyramoidal "translucent skylight systems.°
Also, no assignment of pyramid skylight responsibility is provided in Specification 1010. [t may have been your
intent to include pyramid skylighu in Mortenson's Contract Documents, but that did not occur.
W e have been informed that the Owner would like a pyramid skylight at each area indicated as a rype `B° skylights.
Our 29 April 1946 corcespondence requested a Specification for type "B" skylights. To date, we have not

received this informa[ion. Ou� barre{ skyli�ht supplier graciously provided a proposed submit[al for ppramid
skylights, which was accepted by CPMI/HGA. Our supplier, however, will not provide pyramid skylights �vrthout
issuance of an appropriate chan�e document.
Our obligation, according to Generai Conditions paragraph 1.1.3, is to provide the Work, compnsed of the
construction required by the Contract Documents. Urtfortunately, pyramid skyliahts, to the exten[ required 6y the
Owner, aze not included in the Contract Documents, and therefore, are not included in the Work.
We suggest that this issue be immediately considered by the next level of our partnered conflict resolution
hierarchy, so as to mitigate any possible impact to the enciosure of our project.

CPMI and HGA have reviewed your recent letter regarding skylights and offer the following:
1. Per General Conditions of the Contract, A201/CM-1980, Paragraph 1.2.3: "The intent of the
Contract Documents is to include ail items necessary for the proper execution and completion
of the work; in proper operating condition. The Contract Documents are complementary, and
what is required by one shall be as binding as if required by all. Work not covered in the
Contract Documents will not be required unless it is consistent therewith and is reasonable
inferable therefrom as being necessary to produce the intended results." In addition per Section
01010, Paragraph 1.3.2: "The work is generally described and is to include everything
necessary to make a functionaliy complete Project."
The basis of your letter is "pyramid" skylights are not specitied. They are shown on Sheet A270
in plan and Detail 1l7-8 shows a cut through them. Detail 1/7-8 is titled "Pyramid Skylight
Curb Section" and points to the skylight with the designation"Translucent Skylight System".
Section 08950 Translucent Skylight provides information on skylights.
3. In your letter you indicated Section 08950 consists of the furnishing and installation of only a
custom barrel-vaulted skylight, as listed under Paragraph 2.1, A, 1. If you want to be
absolutely literal with the specifications, this paragraph describes the skylight as "Type '1 ". All
references to skylights on the roof plan, Sheet A270 and Details 1 and 2/7-8 are to skylights
"Type A and B".
Based on the above, it is reasonably inferable the translucent skylights, both Type A and B; as shown
on Sheet A270 and Details 1 and 2/7-8 and specified in Section 08950 are part of the project.
Without them, the project would be functionally incomplete. Since Section 08950 is assigned only to
CP4.09 Curtainwall/Glazing and windows, glazing, skylights are not assigned to anyone else, it is
reasonably inferabie the CP4.09 contract, which is a part of M.A. Mortenson's contract, is responsible
for the work. If you have additional comments, piease advise. Thank you.

Dear Allen,

CPMI received your letter dated 27 September 1996 regarding the above-referenced telephone
enclosures. We discussed this on 20 September 1996, per the attached Communication
Verification, and also have the following comments.
Telephone enclosures are specified in Section, 10990. In addition, per the General Conditions of
the Contract, A2�1/CM-1980, Paragraph 1.2.3: "...The Contract Documents are complimentary,
and what is required 6y one shall be as binding as if required by all..." Addendum #3 was issued
7 September 7995 with new information about the telephone enciosures. Four pages, 5/10-5
through 8/10-5, were issued. They were very detailed and showed exactly the three items for
which your subcontractor has requested payment:
Stainless steel perforated dividers: You indicated the sub said these are "optionai
accessories" and the spec cafls for "Standard as provided by manufacturer". This is
clarified in Addendum #3 and are listed on afl pages 5/10-5 through 8f10-5.
2. Width of end units: You indicated the sub said these are custom. The specification call
out the model number and style, but dimensions were claritied in Addendum #3 and are
listed on all pages 5/'10-5 through 7/10-5.
When this was discussed previously, it is noted all the telephone enclosures were shown with
specific widths. In the spirit of partnering, we aliowed the contractor to provide aIl except the
end units with their proposed widths and shelves, with no request for cost reduction. We had
hoped this was fair to aN parties and sfiown the good faith effort we are taking to work with you
and your subcontractors.
Based on the above, the Construction Manager, after consuitation with the Architect, has
determined the stainless steel perforated dividers and width of end units are the responsibility of
the contractor. If you do not agree with the detemination by the Construction Manager, you may
pursue your claim as allowed for in the Contract Documents. Thank you.

2. MAM to send information on stored steel items. Insurance certificate is not correct: certificate
holder should be City of Saint Paul, and amount should be S 1 M.
3. Owner wiil be tearing down 3M stage and other decorations in Wilkins Auditorium Monday
morning, 23 September 1996. Steel workers can start welding at about 10:00 a.m.
4. Per Paul Asp, bearing plates fir Skyway (which are being refabbed) must be hot-dipped
galvanized. Scott Houdek had asked if galvanized paint was okay, but it ' .

5. The telephone enclosures should reflect shop drawing information. Allen indicated the supplier
thought perforated stainless steel divider panels are not base bid. They are shown on the ;
Addendum, as well as specific dimensions for widths of the enclosures. In the interest of �
partnering, the Architect will allow the 35+\- heighth dimension in lieu of the 48" dimension
shown in the Addendum.
