widen, and extend Burns Avenue from Ruth Street
to MeKni�ht Road, City Pro�ect P-o55�x.
THE COTJAiCIL OF �IiE CITY OF SAINT PAUi, �OES ORZaAIN:
Section l. That �he Coa�nis�ioner of Public Works, having reported
to the Council that ea�semen�s �'or street and h3.ghway p�,rposes on, over,
and across the �ollow3ng d�scribed lands;
The north 20 feet of Lots 1 through 8 inclusive,
Block 21, Battle Creek Heights Plat 3, also those
parts of` Zots 1 throu�h g inelusive and I,ot 1�+,
Block 20, Battle Creek Heights Plat 3, lyin� north
of a line 50 feet distance south of and paxallel to
the North line of Section 2, �.28PT., R.22W.; also
eas�ments in the land necessarg for slopes, cuts,
and fills including right of removal of lateral
support from subjeet lands or re�ainder thereof
occasioned by excavationa thereoP c,r cons�ruction
of slopes in the grading and paving of Buri�s Aveisue
frarn Ruth Street to McK�night Road,
are requ3red for aper�ing, widenin� and extending Burns Avenue f9rom �iu.th
S�reet to MeKnight Road, C3.ty Pro�ect P-o55�+x; that the estimated cost
of the acqui�ition of said easements is $6,400.00, and that the Co�aiptroller
has certifYed to the Courieil the manner in which the fl�nds may be made
available; that the Council hereby approves the project for the acquisition
of the s aid easements for th� aforesaid purpose a�d directs that the s� be
aeqaa.3.red for such pu.rpose by the Cc�mnittee on �,ands con�i�tin� of the Mayor,
the Purchasin� A�ent, Co�i.ssioner of Pu.blie Work�, and the Co�nnn.issioner of
Finance, if th� same can be acquired by purehase at a reasonable pri.ee, and
it sha11 so report �o the Cc�aneil the cos� thereof, provid�d, howe�r, that
in ease the Coaunittee on Lands eannot procure any or all cf said easements
at a reasonable price, th�n i� sha11 so report to the Council, and 3.n tha�
event, the Cauncil hereby orders and directs that condemna�ion proceedings
be instituted pta.rsuant to law to secure said easements.
Scetion 2. That this ordinar�.ce sha11 take effect and be in force �hirty
(30) days f�om and after its passage, approval and publication.

TO THE MAYOR AND MEMBERS OF THE CITY COUNCIL:
Re: Acquisition of real estate and easements
for (City Project P-Q554R) Burns Avenue
, from Ruth Street to McKnight Road.
For the purpose of openinq, widening and extending Burns Avenue from
Ruth Street to McKnight Road, City Project P-0554R, the Department of
Public Works require the acquisition of the lands and easements described
as follows:
The North 20 feet of Lots 1 through 8 inclusive, Block 21 , Battle Creek
Heights Plat 3, also those parts of Lots 1 through g inclusive and Lot 14,
Block 20, Battle Creek Heights Plat 3, lying North of a line 50 feet distance
South of and parallel to the North line of Section 2, T.28N. , R.22W. ; also
easements in the land necessary for slopes , cuts, and fills including right
of removal of lateral support from subject lands or remainder thereof
occasioned by excavations thereof or const 'ruction of slopes in the grading
and paving of Burns Avenue from Ruth Street to McKnight Road.
Funds for the above acquisition were approved in the 1971 Municipal
State Aid, Fund No. 64-216-08 in the amount of 526,000.00.
It is requested that the Council take the necessary action to authorize
the acquisition and easement of above said tands for said improvements on
Burns Avenue between Ruth� Street and McKnight Road.
