THE COUIVCIL OF `I'I� CITY OF SAINT PAUL DOES ORDAIN: SECTION 1 That permission and authority are hereby granted to the Minnesota State Bank of Saint Paul, 4'78 South Robert Street� Saint Paul, Minn�scta to perform removals and reconstruction in the Public Right-c>f Way of Plato Boulevard between Robert Street and Eva Street incidenta]. to the construction of a left turn lane in the �center) island of Plato Boulevard. _ SECTION 2 That the Commissioner cf Public W�rks is hereby authorized to i+ssue a permit to the Minnesota State Bank of Saint Faul for the reconstruction of the tr�ffic channalizAtion island on Plato Boulevard between Robert Street and Eba Street� subject to compliance with the following eonditions. a. That sai.d permittee shall reconstruct said traffic island entirely at its own expense, under the supervision and to the satisfaction of the Commissioner uf Public Works and in �,acordance with the plans and specifications prepared by and on file with the Department of Public Works. Construetion arust be performed by a Centractor approved by the Department of Public Works. b. That sa.id permittee shall pay for the publication of this ordinance and pub- licatian of all resolutions related thereto. c. That said permittee shall pay the cost of administration� engineering� and inspection of said work� and said costs to be accounted for under Departarent of Public Works Project Number E 11�8 ' d. That said permittee shall properly protect a11 excavations made in the streets� sidewalks and boulevards both day and night so as to avoid all da.mage or in�ury to persons or property. e. Said permittee, after the inception of said work, sha7.1 prosecute sai.d work continuously, with diligence, and fully complete said work to the satisfaction and approval of the Commissioner of 1'ublic Works as directed in the special pro- visions of the prepared plans. f. That sai.d permittee shall furnish � bond to the City �f Sa�int Paul in the sum of Ten Thou+�and Dollara �$10,000.00) conditioned to comply with all terms of this ordinance and to indemnify and save harmless said City from all liability� loss, 3u�wents, suits, coats, eharges and expenses that may accrue to persons or property occa+#sioned by the making of the improvement or arising ,out of the same. i. For the purpose uf thi� ordinance the aforesaid section of said specifications, aumber 1.44, aa amended, shall be read as thou�h the wor:d "permittee" was �ub- stitu�ed for the word "contractor", wherever the same appear� in the aforesaid Seetion 1.44, as amend�d. Said Section 1.44, as amended, of the Specification� for Street and Sewer Cc�nstruction in the City of Saint P�u1 is her�by incorporated herein by reference as fully and as completely as if set forth herein verbatim. Proof of compliance with provisions of the aforesaid section shall be in such form as the Corporation Counsel of the City of Saint Paul may direct and the documents required by the aforesaid �ection 1.44 shall, after submission to the Corporation Couns�l� b� filed in the office of the Comptroller of the City of Saint Paul.. 1.
