THE COUNCIL OF THE CITY .OF SAINT PAUL DOES ORDAIN:
Section 1 . That the Zoning Code , Chapters 60 to 64� inclusive,
of the Saint Paul Legislative Code , pertaining to Use Districts ,
Height Districts and Rezoning of certain properties in the City
of Saint Paul , as amended, be and the same is hereby further
amended so as to rezone the following described property from

Dear Sir:
This is written in response to the petition of the Stuart Corporation to rezone
from 'B' Residence to 'C' Residence and Co�nercial, property located between
Youngman, Benson, Rankin, and Alton. The legal descrfption is attached.
The Board of Zoning heard this matter at a public hearing on the evening of
October 3, 1973, and at its regular meeting on October 4 and 18, 1973. The
Planning Courtnission considered this matter at its regular meeting on October 26,
1973, and at a special meeting on November 8, 1973. Copies of the minutes of the
meetings are enclosed. At this date the minutes of the November 8, 1973,
Planning Commission meeting have not been . approv:ed.
The petitioner requests that 22.2 acres be zoned 'C' Residence and 9.3 acres be
zoned Commercial. The petitioner proposes to build approximately 1,000 dwelling
units in walk-up apartment buildings and high-rise apartment buildings; an,
office building; and a recreation building. All of the land �ought to be rezoned
is not controlled, either by ownership or option, by the petitioner; petitioner
co�rols about 23 acres or 69% of the land. Controlled land consists of 23 one-
family homes, 4 two-family homes, and 20 vacant parcels. Land not controlled
consists of 37 one-family homes, 7 two-family homes, and 5 vacant parcels.
The Board of Zoning received reports on the rezoning from the School Board, Public
Works, Fire and Police Departments; a�n affidavit of intent from the developer;
and a staff recommendation. Copies of the reports are enclosed. The Board of
Zoning voted 4 to 0 to recommend that the petition be granted if modified as
follows: the land north of the railroad tracks between Rankin and Springfield
be zoned Light Industry; the land requested to be zoned Commercial south of
the railroad tracks between Rankin and Springfield be zoned 'C' Residence. A
legal description of the land so modified is attached.
On October 26, 1973, the Planning Conrtnission considered the petition and layed the
petition over to its next meeting for a public hearing on the impact of the

proposed development and two other developments in the vicinity on traffic,
schools, environments and energy. On November 8, 1973, the Planning Commission
considered a staff report on the above impacts and an environmental impact
statement by Landmark Development Corporation for the Stuart Corporation.
Copies are enclosed. After hearing all who wished to testify, the Planning
Commission voted unanimously to reaffinn the recommendation of the Zoning
Board to approve the petition to rezone if modified as described.

Dear Mr. Ryan:
A review has been completed by the Department of Public Works in regard
to the rezoning of 332 acres of land to "C" Residential and Cortmercial
at Shepard Rd. between Rankin St. and Alton St.
From the standpoint of sewer capacity and availability, the Sewer Divi-
sion does not object to rezoning this parcel of land. See the attached
map for the available sewer facilities. However, we do want to make
known certain facts and future requirements.
Essentially, this area has separate sewers for sanitary and storm drain-
age. See the attached map for details. The sewers in Stewart, Alton
and Seventh Sts. are in tunnels. The sanitary sewer is about 30 feet
below the surface, and the storm sewer is about 20 feet lower than the
sanitary sewer. These are available for the use of the development.
The individual sewer services and any other sewer construction is to be
done by the developer at his own expense. We plan no new sewers of our
own in this area. The design of the new sewer work is the responsibil-
- -- ity of the developer. However, we request that the developer meet with
the Sewer Design Division as soon as the plans are developed enough to
discuss these matters.
Certain easement rights and sewer ownership rights have to be clarified.
All sewers shown on the map shall be owned and maintained by the City.
All individual sewer connections shall be owned and maintained by the
developer. Service to the recreation building may require a sewer in
Madison St. A sewer of this length in a public street would be buitt

by the developer at his expense, but ownership anr� maintenance responsi-
bility would revert to the City. If any street with a public sewer is
vacated, an easement will be necessary. There are two sewers in Stewart
f rom Alton to Rankin. These are turrnels, and underground easements will
be needed. There is an open-cut sew�r in Springfield from Youngman to
Stewart for which a specific easement arould be needed.
All sewer work will require the written approval of the Sewer Engineer.
It will also require permits and City inspection. Therefore, it is es-
sential that the Sewer Division discuss the plans with the developer
before extensive plans are developed. There are certain requirements
we will make. Storm runoff and sanitary sewage will have to remain com-
pletely separated. The sanita ry sewage system has adequate capacity.
However, the sto rtn sewer outlet has been surcharged during heavy storms.
Therefore, the plans should include provisions for restricting storm run-
off. This could take the form of restricted roof drai�s or tempora ry
ponding on open areas or parking lots. Connections to sewers will re-
quire licensed house drain contractors.
We feel all the above items- are necessa ry to protect the interests of
the City.
At the time of the original possibility of vacation request of portions
of Rockwood Ave. and Springfield St. the Maintenance Division requested
the improvement and upgrading of the streets into this area. The pro-
posed rezoning involves a lot of high density housing and the addi-
tional traffic generated on the existing streets in this area, which are
ve ry poor quality oilerl or ungraded streets, will require the improvement
of these streets. Therefore, the petitioner should be required to im-
prove the surrounding streets to include surfacing, curbing and sidewalks
at his expense.
The following table shows the traffic that the Traffic Bureau would ex-
pect to be generated by the proposed development. We feel the present
streets can adequately handle the street volume on the basis of their
widths and the right-of-way widths. However, it would be desirable to
� have structural improvements on many of the surrounding streets.

In addition, it would be highly desirabte to provide adequate street
lighting around the periphe ry of the development. We estimate that this
can be provided for approximately $50,000.00.
The Bureau of Lighting woutd be required to remove four mercury vapor
lighting units, mounted on wood utility poies, at the petitioner' s ex-
pense.

Your letter of October 5, 1973 to Thomas J. Kelley, requestinq our department
to check into the suitability of a playc!round evithin the development proposed
between Rankin and Alton.. south of 6•lest Seventh St. , has been referred to me.
I am sure that a recreation center can be construc�ed within the site area,
hou�rever, there is a serious.question in my mind as to Nrhether the City can
justify operating and maintaining such a facility. Ir!e realize that there are
� no recreation centers in tfiis particular area; however, the area itself is
primarily commerical and industrial and as such, the population does not warrant
the operation and maintenance of a full-time recreation center.
The western edge of the 7th Street area is served by Homecroft Recreation Center
and the eastern edge of the 7th Street area,with the proposed development, could
be served by Riverside or Adams Recreation Centers.
However, it seems that possibly the best solution would be for the developers to
maintain and operate a recreation center to accommodate the tenan�s in the-.pro-
posed development similar to what other developers are doing throughout the
metropolitan area.

A. Backqround
The petition of the Stuart Corporation to rezone land in the Shepard Road
area was heard at the October 26, 1973, Planning Commission meeting. The
Commission decided to consider the petition in relationship to t1��o other
developments in the vicinity at a special Commission meeting on November 8,
1973. Consideration was to be given and confined to the effects on traffic,
schools, environment, and energy by all three developments.
The three developments are:
1 . The Stuart petition to rezone 33.5 acres of '6' Residence land
to 'C' Residence (22.2 acres) and Commercial (9.3 acres). The
petitioner proposes to build approximately 1 ,000 dwelling units
in walk-up apartment buildings and high-rise buildings; an office
building; and a recreation building. The developer estimates
5 to 8 years� before completion of construction. On October 18,
1973, the Zoning Board voted 4 to 0 to recommend approval of
the petition if modified as outlined in the attached memorandum
to -the. Commission.
2. The Speckman property which was rezoned to 'C' residence in
October, 1972. The developer proposes 200 dwelling units in
one 22 story building on 5.17 acres of land. The developer
has stated that, if money is available, construction could
begin in the spring of 1974.
3. Watergate Apartments for which the City Council granted a
special use permit in June, 1972. Phase 1 which is now under
construction consists of 242 dwelling units and 7,000 square
�� feet of comm2rcial space in one 22 story building on 5.8 acres

5 years. .
B. Traffic � "
The Tra-Ffic Engineer estimates the additional traffic which will be
generated by the three developments as follows:

"Based on the projected .traffic volumes and the present traffic
volumes, the proposed complexes will result in an increase in the
traffic volume on Shepard Rd. near 35E of approximately 27% and
an increase west of Davern Ave. of about 10�. On W. Seventh St.
the traffic volume will increase by about 14� just west of
Montreal Ave. and by about 4% just east of Davern Ave.
8oth Shepard Rd. and W. Seventh St. in the vicinity of the
proposed development have the capacity to handle the estimated
increases. It may, however, become necessary to initiate inter-
section improvements such as the installation of traffic signals
at some of the intersections such as Elway St. and Shepard Rd. to
facilitate primarily traffic movements onto Shepard Rd. or Seventh
St. The traffic volumes at the present time on both W. Seventh
St. and Shepard Rd. are of the magnitude that it is difficult to
handle any significant cross street volumes attempting to enter
during the peak traffic hours of the day. In addition, as was
mentioned in a letter dated August 28, 1972, from Robert Peterson

to Noland Heiden, it would be desirable to construct a roadway
along the Elway St. alignment between Montreal Ave. and W. Seventh
St.
It should be pointed out that whi7e the expected traffic increases
on Shepard Rd, in the vicinity of the proposed developments can
probably be handled, it is doubtful that they can be adequately
facilitated on Shepard Rd, toward downtown, particularly from
Randolph Ave. and downtown. The degree of difficulty expected on
this section of Shepard Rd. is, of course, related to the future
of I-35E, whose status is unfortunately at this time, unknown."
The difficulty of handling traffic increases on Shepard Road from Randolph
Ave. to the downtown is due .to:
1 . The present inadequate design of the Shepard Road roadway which
..
' has narrow lanes, sharp, unbanked curves, and no interchange
tr at Chestnut Street; and
---- -2. —�'he use of Shepard Road by traffic going between the completed
section of 35E and the downtown.
An interchange will be built at Shepard and Chestnut; further acquisition
is programmed for 1974. Construction of the interchange awaits a decision
on 35E so that the level of design can be determined.
The amount of traffic using Shepard Road between 35E and the downtown
depends upon whether 35E or an alternate route is built through the
corridor. One alternate route, Shepard Road upgraded to freeway design
standards, has been referred to the Planning Corrmission by the Mayor

C. School Impact
Unless the population of the three developments differs greatly from
that projected by the developers or that which would logically be
anticipated� from this type of development, potential impact upon
school facilities and services does not appear to be significant.
The Watergate building proposed is a high-rise structure with luxury
units not designed to accommodate children. The building proposed at
Shepard and Elway is planned for adults and the builder anticipates
enforced restrictions which would limit the occupancy to adults. The
developer of the largest complex anticipates perhaps 35 children in
the total 1 ,114 dwelling units which will be designed for an adult
population. As rental units in the proposed rental range,it is not
anticipated that they would have wide appeal to families with children.
Nevertheless, it may be important to consider the possible impact of
the developments if the restrictions should prove unworkable or the
market attraction differs considerably from what is anticipated. A
theoretical maximum number of children can be established by assuming
one-child �families for 50°6 of all of the two bedroom units and one
child per each three bedroom unit. These ratios �are very close to
city-wide averages for all non - subsidized apartments. On this basis,
the apartments could generate 660 children and young people under 19
years of age. Assuming an age breakdown similar to the city population
this would mean 185 elementary school children and 158 secondary school
children.

Elementary Schools
Four elementary schools serve the general area of the projects.
Only the smallest of the four schools, Edgecumbe, presently has
an enrollment higher than its designed capacity (enrollment 230,
capacity 175). For the four schools together, the existing
population of 1 ,533 pupils is less than total capacity by 217.
A declining enrollment is projected which indicated that this
number of "available spaces" will increase to 275 in 1974, 494
in 1979 and 557 in 1982. Capacity of the present elementary
school facilities is therefore more than adequate to accommodate
the 185 elementary school children which can be projected for the
completed developments. '
Secondary Schools
Monroe and Highland Junior and Senior High Schools serve the
secondary school population of the area. Both of these schools
are present7y overcorwded. Monroe has a capacity of 1 ,053
students and a present enrollment of 1 ,118. Highland facilities
are designed to accommodate a maximum of 2,619 students and
present enrollment is 2,905. A potential of 158 additional
secondary school children might indicate a problem; however,
again a declining school population projection indicates that by
188Q enrollment will be less than capacity by 172. Thus by the
time all of the apartment complexes are complete, "available" space
in present secondary school facilities will likely be greater
than the theoretical maximum number of secondary students pro-
jected for the apartments for the sake of analysis.

Conclusion ���'c�s
There is no indication that the proposed developments would cause
a serious problem for school facilities especially considering:
1 . The number of children projected in theoretical and not
anticipated. �
2. Given the rental range of the units, it can be anticipated
that a significant proportion of any school chi7dren would
be in private schools.
3. A new high school nearer the center of the City will
likely serve some of the present Monroe and Highland
population.
4. More open enrollment policies which are anticipated will
likely change the school/population relationship on a
city-wide basis at the secondary level .

placed on various types of fuel it is possible that certain classes of
interruptible gas service may not be available and interruptible
curtailment will increase in the future." The report is enclosed.
In conclusion, N.S.P. can furnish electrical service but gas will be
on an interruptible basis. If priorities change, some classes of gas
service may be curtailed and alternate types of energy, such as propane
gas, oil , or coal , may have to be increasingly or entirely used.

E. Environment
1 . Sewers
The Public Works Department reports there are public sewers avail-
able for a11 three devplopments but requires that sanitary and
storm sewage be separated and that all extentions be financed by
the developers. The Sewer Design Section of Public Works states. . .
"generally, there are sewers available to all three [developments],
but considerable expense will be needed to connect to these sewers.
We consider these sewer connections to be private matters and are
very interested that [the City does] not face unwarranted costs. . ."
and goes on to require that. . . "storm water and sanitary sewage
are to be strictly separated. This is a requirement for all
extensions and the potential facilities for separation are present."

2. Air � -
The addition of 1 ,800 new dwelling units and accessory commercial
uses will increase the amount of auto exhause in the air in the
area. "; However, impairment of air is not anticipated. The air
quality in the downtown, which is much more densely built and
which has peak auto use at the rush hours has been tested and is
expected to meet federal air standards. The development in the
Shepard Road area will be less densely built and not have the
peaks of auto use of the downtown.
3. Water
The construction of structures and paved, open parking lots may
increase the amounts of pollutants, s�= as suspended solids,
�nitrate, etc. , carried by storm water run-off to the river.

However, some of the increase will be mitigated by Speckman vacating
1 .2 acres of streets and the Stuart Corporation vacating 3.4 acres
of existing and platted streets and leaving 55% of the site in open

The Stuart Corporation petitibns to rezone 33.5 acres of 'B' Residence
land to 'C' Residence (22.2 acres) and Commercial (9.3 acres). The
petitioner proposes to build approximately 1 ,000 dwelling units in
walk-up apartment buildings and high-rise buildings; an office building;
and a recreation building.
The petitioner does not control all of the land sought to be rezoned;
he controls about 23 acres or 69%. Controlled land consists of 23 one-
family homes, 4 two-family homes, and 20 vacant parcels. Land not con-
trolled consists of 37 one-family homes, 7 two-family homes, and 5 vacant
parcels.
The Land Use Plan proposes Limited Industry for the area north of the rail-
road tracks and townhouses for the remainder of the site.
The Board received reports on the proposed rezoning from the School Board,
Public Works, Fire and Police Departments and an affidavit of intent from
the developer which pledges to adhere to integrity of the project, to adhere
to the zoning regulations, to make firm offers of purchase to all remain-
ing property owners, and to donate 2 acres of open space to the City.
The Board heard -the petition on October 3, 4, and 18, 1973. The staff
recommended the rezoning be granted if modified as follows: the land
north of the railroad track between Rankin and Springfield be zoned
Light Industry; and the land proposed to be cort�nercial south of the rail-
road tracks between Rankin and Springfield, be zaned 'C' Residence. The
Board voted 4 to 0 to recommend approval of the rezoning as modified above.

The attached figures are an estimate of the amount of Electric and Gas
utility service which wil�� be required at the three proposed apartment
developments on Shepard Road in St. Paul.
Northern States Power Company is prepared to serve these developments
subject to our rules and regulations as specified in our franchise.
These estimates were prepared without the aid of detailed specifications
and therefore are based on averages obtained from other similar devel-
opments. Other than normal construction (such as increased insulation,
large glass areas, etc.) could cause considerable variations in the es-
timated utility use. In addition it was assumed that interruptible gas
would continue to be available in the same quantities and classes as it
is now. With the energy problem and use priorities being placed on var-
ious types of fuel it is possible that certain classes of interruptible
gas�:service may not be available and interruptible curtailment will in-
crease in the future. Cost estimates are based on present utility rates.
By way of comparison, if the Speckman and Stuart projects were to develop
as single family - two family areas�energy use would be as follows:

Dear Mr. Schnarr:
We have reviewed your map and notes regarding three developments labeled
"Watergate", "Stuart Corp" and "Speckman". Generally, there are sewers
available to all three, ..but considerable expense will be needed to connect
to these sewers. We consider these sewer connections to be private matters
and are very interested that we do not face unwarranted costs in this matters.
Before making specific comments we would like to make some statements common
to all three cases. Storm water and sanitary sewage are to be strictly
separated. This :is a requirement for all sewer extensions and the potential
facilities for separation are present. For the new connections to the sewer
system a S.A�.C. Charge will be imposed by the Sewer Board. For apartments,
this is 80 percent of the single family house charge. The 1973 S.A.C. Charge
is $275 and in 1974 it wil ) be $300. For apartment buildings this would amount
to 80 percent or $220 in 1973 and $240 in 1974. Subsequent years will no doubt
be more. In large complexes like these, this amounts to a considerable expense.
Assuming 197�+ rates, this would amount to the following:
l . Watergate: 230 units at $240, total $55,000.
2. Stuart Corp: 1114 units at $240, fotal $267,000.
3. Speckman: 200 units at $200, total $40,000.
In our view this should be paid by the developer and certainly not by the city.
We have not programmed any money for these projects. Public sewers are available
and the necessary connections should be built under the assumption that these
are used for private purposes and should be financed by the developer. Finally,
Sewer Design would have to approve in writing the plans for all sewer connections.

Listed below are specific statements concerning the individual developments:
1. Watergate: Since this is located on the River it should be a
simple matter to build drainage structures to the River. This
would be a private drain and no public sewer would be
involved. �or sanitary sewage the nearest sewer is located at
Davern and Norfolk. A se�,�age pump station woutd be needed at
Watergate and a f�rce main up to tne se���er. Since only 1latergate
is involved, this would be built, financed and maintained as a
private sewer. Sewer Design will have to approve the plans in
writing and city inspection is necessary.
2. Stuart Corp: There is a storm sewer in Stewart Avenue and a
sanitary sewer in Stewart to Alton to Seventh. Both sewers are
built as tunnels and are located 30 feet below the surface for
sanitary and 50 feet below for storm water. Storm connections
will be allowed to the storm sewer. Sanitary sewage connections
will be allowed to the sanitary sewer, but each building will
require an individual sanitary sewer service. All these storm
and sanitary connections will be private sewer facilities and
will be subject to written approval of the Sewer Engineer and
to Sewer Department permit and inspection.
3. Speckman: There is a meandering free flowing ditch from Highland
Park through this property. This will have to be enclosed in a
pipe and probably require an easement. The storm water outlet
sewer is in operation located under Elway Street. Pdew connections
will be considered as connections to a public sewer. The nearest
sanitary se��er is in Seventh Street. To get sewage there, a pump
station and force main will be needed. We are aware of a building
permit for another apartment building on Stewart Avenue near 1 . 35E.
They face the same pumping problem. We suggest a cooperative effort
between all interested developers in order to develop a pump station
adequat� for al ) possible development in this area. We have no
funds allocated for this project and due to the private nature of
the� development, the developers should bear the costs of the project.
If there is more than one user, the pump station will have to become
a public facility.
We cannot make a competent estimate of costs involved without further plans.
However, we do know that very expensive costs will be incurred. The total S.A.C.
Charge will be at least $360,000. The cost of pump stations starts at about
$10,000 and have a continual operation and maintenance expense. Each case will
involve a considerable amount of pipe installation and there witt be manholes ,
catch basins and perhaps other speciat structures. It would not be unreasonable
to expect costs in excess of a half-million dollars. The city has no funds
allocated to this work and the financing should be done by the developers. The
attached map shows the existing situation and possible future requirements.
Wherever public sewers exist where streets are vacated, easements will be
needed.

estimates from those outlined in a letter to Mr. Schnarr dated
November l, 1973.
If the proposed Watergate development located near Davern
and Shepard Rd. is doubled in size, the expected total increase
in the traffic volume on Shepard R, and 35E would increase
by approximately 27% as opposed to the expected increase of 23%
as previously indicated. Also, we would expect the increase in the
Shepard Rd, traffic west of Davern to be 10% rather than 9P/o.
No significant increases in fraffic would occur on Seventh St.
in the vicinity. �
We do not feel that the doubling of the size of the Watergate
development would have a significant impact on the area over that
indicated in the letter of November 1 .

impact of the above project. In an attempt to secure
and follow some guidelines for this analysis , we are

A. Pollution:
This project will generate no adverse sewerage
or waste pollution beyond the normal waste and
sewerage loads which are generated in a residential
area containing 1,000 living units. It is our
understanding the city is analyzing the anticipated
loads for this project and making a determination
as to the ability of the system to carry the
anticipated capacity.
B. Impairment or destruction of air:
There is no anticipated impairment or destruction
of air quality no� unusual or extraordinary infringe-
ment on air rights. The height of the apartment
towers is approximately 120 ' lower than the radio
towers in the immediate vicinity, and will have no
adverse effects on air traffic or violate any FAA
regulations.
C. Impairment or destruction of water:
Shepard Park Housing is not on a body of water and
will have no adverse effect on water quality. All
surface runoff will be handled by city storm sewers.
D. Impairment or destruction of land:
The Shepard Park Housing will not significantly alter
the land from its present residential usage or its
present condition. The proposed development will
dedicate 55� of the site to open, green and planted
areas thereby returning this portion of the property
to a parklike environmer.t.
E. Impairment or destruction of other natural resources:
Shepard Park Housing will have no effect on natural
resources other than tree population. The 55� of
the site dedicated to open space will preserve all
possible existing trees and will incorporate a
landscaping plan for replanting of the construction
site.

F. Direct or indirect adverse employment effects:
Shepard Park Housing will have no adverse effects
on employment of the neighborhood; on the contrary,
this project will provide additional jobs in the
nature of management for both the housing units
and the recreational facility.
G. Visual Pollution:
Shepard Park Housing will enhance the aesthetic
quality of the existing area. This project will not
destroy aesthetic views of existing structures to
the north since t�ie majority of the structures are
one story industrial, and are unable to view the
river valley under the present conditions. Residential
structures on the bluff farther to the north will not
have their views impaired.
H. Noise:
-Shepard Park� Housing will not generate unusual
or concentrated noise levels. It is not anticipated
that blasting will be required in the excavation of
rock in foundation construction.

STATEMENT TO THE CITY COUNCIL
In Regard To
The Rezoning Application
for
SHEPPARD PARK
by
The Stuart Corporation
The Stuart Corporation, represented by Mr. Stuart Nolan,
at a Zoning Board hearing on Wednesday�, October 3rd, t�ras
asked by Chairman Rupp whether or not the Corporation would
be interested in a partial rezoning of the 33. 5 acre tract unr
der petition. Mr. Nolan repla�ed, iri effect, that the Corpora-�
tion would not be; that it was interested in rezoning the en-
tire tract - or none. The residents of the area who were
present heard this statement with relief - because we inter-
preted it to mean that the Corporation would not begin con-
struction until title to all, or nearly all , of the necessary
land was acc{uired. Each property owner should he wish to sell ,
would be able to negotiate the sale of his land on an ec{uitable
buyer-seller basis , without pressures against eitfier side.
On November 12th, the St. Paul Pioneer Press published an
article stating as follows : "Company spokesmen have said if
rezoning is granted, development will begin on land already
owned and continue over a long period of time. If hoMeowners
refuse to sell, 'We will just build around tFiem to the degree
that we can' , a company� spokesman has commented. " �

� Here is where the pressure begins against the individual small
owner. Now, he must think in terms of getting out before the
character of the neigh'oorhood undergoes radical change and his
property depreciates in value. Let' s face the fact that a
home in a c�uiet, A-residential neighborhood is worth substan-
tially more than the same home sandwiched in among a group of
apartments . This fact is borne out by the Zoning Board itself- -
in rec{uiring that the Stuart Corporation make written offers
to the residents of the area, "in order to protect the holdouts
for a limited period should their property� values decline
while apartments are built near them. " (Oct. 5, St . P. Disp.) .
, We maintain that this petition to rezone is premature.
Each member of this council is certainly aware that th.e Stuart
Corporation controls nowhere near enough contiguous land in
the 33. 5 acre trac�t to be able to plan for its total develo�--
ment - phased or otherwise. The beautiful "Master Plan" sub-
mitted to the zoning board is, in this sense, no more than an
enticement, with a thirty-two million dollar tax base figure
as the carrot.
If the Council should rezone tlze area at this particular
time, the Stuart Corporation find itself in possession or �
'I control of a hodgepodge of land parcels zoned commexcial - '
free to do with the pro�erty pretty much as it saw fit, in-
�
cluding totally unplanned construction and �ossible resale of
parcels to other developers .
The Council has the power to prevent such a situation - in
either of two ways :

Dear Members of the St. Paul City Council,
After much consideration and information gathering at the various aoning Board
hearings the West 7th Federation stands, in a vote of over 350 residents, strongly
opposed to any rezoning of the eight (83 block Steward Avenue area and the
development of this land under the rezoning.
The West 7th Federation is not opposed to developing the city and buildinq up the
tax base, quite to the contrary, but we find it irrational to destroy one good
neighborhood of homeowners to replace it with anbther neighborhood.
The ramifications of rezoning this land at the present time are especially critical.
Presently it is next to impossible to obtain home mortgage financing. Your vote
to rezone would be direetly responsible for making most of the residents of the
area in question homeless - yes - in the true sense of the word - homeless; for
like you and I ownership of our own home provides countless benefits, phonomically,
physically and psychologically.
For these reasons, I urge you all to turn down the rezoninq of this eiqht (8) block
area.

Dear Mr. Nolan; -
In response to your inquiry regarding the feasibility of bui�ding-
multiple dwel7ings versus single in the� above mentioned area, I
would like to make the following comments. �
My present position is Director of Engineering for Harry S. Johnson
Companies and I am a registered engineer in the State of Minnesota.
Preceding my employment here, I was Director of the Solid Waste
Division for the Minnesota Pollution Control Agency and was in-
volved i:n land disposal facilities through the state which in-
volved geological review of the sub-surface stratus. Also on
my staff, I employed a geologist to assist in the review.
Prior to that, I was Assistant Maintenance Engineer for the
City of St. Paul employed by the Department of Public Works and
was ,involved in sewer, street and utility maintenance for ten
years and ten years in design.
I am familiar with the area under consideration and realize the ���
high construction costs of basement excavation that would be �
involved and also utility construction cost in the surface
rock that exists.
Because of these concerns, I would foresee a much lower unit cost
per dwelling in an apartment, townhouse or commercial complex.
Sandrock tunneling which must be done in this area for sewer
service is just about prohibitive for single dwelling and
joint serviee for multiple swelling is possibly the only

8. STAFF INVESTIGATION & REPORT: Date: September 27, 1973 By: DGW
A. ZONING HISTORY: An extension of a permit to run a lumber yard at the corner of
Madison and Benson Streets was granted in 1930. A permit was granted to the same
applicant to erect a temporary structure in 1925, as was a permit to run a lumber
yard in 1928. The site was also included in a 40-ecre rezoning study conducted
_ in 1969 bv the Planning Board.
B. PROPOSAL: The applicant .proposes to develop the rezoned area as a combination
apartment and office complex. See attached sketch.
C. SUFFICIENCY: In a letter dated September 25, 1973, the Director, Department
of Finance and Management Services, declared the petition sufficient.
D. FRONTAGE AND AREA: With street vacations as projected in site plan, the
total site area is 1,734,844.9125 sq. ft. The site plan submitted
' indicates that the intention is to vacate all streets except Madison.
Without street vacations, the total area of the site is 1,457,565.62 sq. ft.
The site has frontages on Youngman Avenue, Alton Street, Benson Avenue,
Springfield Street, and Rankin Street.
E. COMPREHENSIVE PLAN: The Comprehensive Plan calls for medium density residential,
� maximum density 15 units .per acre. In the area roughly bounded by Rankin,
j Springfield, Rockwood and Youngman, the plan calls for limited industry,
and the retention of the railroad in its present condition.

F. AREA ZONING: With the exception of a 'portion northeast of the site which is
zoned for light industry and a small area directly north of the site on
Benson between Alton and Madison which is zoned comcnercial, the immediate
area is zoned for "B" Residence. Further north of the site on West Seventh,
the area is also zoned co�ercial. F�irther to the west in the Maynard Road
area, _there is a large section -zoned "C" Residence. A small section of
"C" Residence zoning also exists on the northwest corner of Rankin and Benson.

G. SITE CONDITIONS: The area is developed in single and multiple family dwellings.
A railroad right of way separates the 'area roughly bounded by Madison,
Springfield, Rockwood and -Benson from �the rest of the site.
H. AREA CONDITIONS: A part of the area to the north of the site is occupied by
Torit Manufacturing. The W. Seventh Street area is developed as a mixed-use
. retail sales facilities and office buildings. Youngman Avenue fronts on
Shepard Road, a traffic artery, and also overlooks the Mississippi River valley.
