THE COUNCIL OF THE CITY OF SAINT PAUL DDE� ORDAIirT: -
Section 1. That Seetion 329. 16 of the Saint Paul
Legislative- Code, entitled, "De.struction of V.icious Dogsr' �
is hereby amended by striking the same in its entirety
- and substituting in lieu and in plac+e thereof the following:
329. 16 Destruction of Dangerous Dogs. The
City Health Officer sha.11 have the power to order
the destruction of any dog which he may deem
dangerous.
. A dangerous dog is a can.ine animal who has
bitten two or more persons. ,

The City Health Officer or �his appointee
from within the Division of Environmental
Protection, after .having been advised of the
existenee of a dangerous dog,:��may�proceed in
the followir�.g manner:
a) The City Health Officer shall cause the
apparent owner '�'o �be notified in writing or in
person that his dog has bitten two or_more
persons and a�pears �o be dangerous. The .
apparent owner shall be noti�ied as to dates,
times,; places, and parties bitten, and shall
be given ten (10) days to request a hearing ^--

1) If the apparent owner does
not request a hearing within
ten (10) days of said notice,
the health officer shall make
such order as he deems
proper. The City Health
Officer may order the dog
warden to take the dog into
custody for destruction.
If the dog is ordered into

The records of the Bureau
of Health shall be adu�issible
for consideration by the Git3z- -�
Health Officer without further
foundation. After considering
all evidence pertaining to the
temperament of the dog, the
City Health Officer sh�.11 make
determination as to whether or
not the dog is dangerous. If
the dog is found to be danger-
ous , the City Health Officer
shall make such order as he

destruction. If the dog is
ordered into custody for destruc-
tion, the owner shall immediately
make the dog available to the dog
warden and failure to do so shall
be a misdemeanor.
b) If a dangerous dog is running at large,
the dog warden shall apprehend the dog and if, _
upon apprehension, the dog bears no identification
which reasonably reveals its ownership, the Gity
Health Officer shall impound the dog until the
quarantine period is completed. If the dog has
not been claimed, it shall be immediately destroyed.
If the dog is claimed, upon payment of kennel fees�
__ it shall be released and the City Health Officer
shall proceed as in number 1 above.
_ c) Any person who harbors a dog after it has
been found by the City Health Officer to be danger-
ous and ordered into custody for destruction shall
be guilty of a misdemeanor.
d) The City Heal�th Officer may, upon
application, apply to municipal court for sub-
poenaes for hearings under number 2 above. -
Section 2. This ordinance shall take effect and be in
force thirty (30) days from and after its passage, approval
and publication.

Section 1 entitled "Destruction of Vicious Do�;s"
Dear FIonourable Council members:
I v✓a.sh to commend Mrs. Ruby Hunt and Cquncil President Mrs.
Rosalie Butler for introducing this piece of legislation. I
feel very strongly that the present law of the city of St. Paul
is �at� adequate to our cities needs. �Ne are well behind tne times as in
such�State as California, where people who own dogs are really
held responsible for their dogs. I highly ,recommend the passage
of the legislation before you with two (2) slight amendments
and one addition.
Change I. Definition of Dan�erous dog to read '�A dangerous
dog is a canine animal who has bit�en one (1 ) person:"� Because
after a dog has bitten once no chances should be taken to a11ow
him to bite again.
Change II. in part a The City Health Officer shall cause
the apparent owner to he notified in writin� and in person
that the dog has bitten one person:� Because notification
than would be done in a proper manner.
Addition: on page 3 part cpIf a dangerous dog is running
at large, the dog warden shall apprehend the dog and if, upon
apprehension� the dog bears no identification which reas��nably
reveals its ownershi,, the City Health Officer shall take blood
samples for analvsis and impound the dog until the quarantine
period is completed.� Because a dog without Rabbi's shots can
be a Carrier of this disease but not receive it. It's outward
appearance shows no tendencies of the disease� and what I call
the Statute of Lirnitations for human beings� is seven (7} years
to contract the disease. If no warnin� is �iven Rabbi's sho�s
can not be given in time tU save that life.
I urge the adoption of �his measure� and thank you all
for your concern for the People of St. Paul.
