viding procedures for the conduct
of the collective bargaining proc�:ss.
WHEREAS, it is the stated policy= of the City of Saint Paul
to promote orderly and constructive labor-mana.gement relations,
establish a system of uninterrupted bperations at the highest
performance level and create an orderly system within which the �
collective bargaining process can function; now therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: °
Section 1
Unresolved disputes, fragmented negotiations and the abs�G� _
of clear guidelines for settling disag�eements are injurious to
good labor-management relations and th� well being of City employee�.
With the foregoing in mind, the Council hereby establishes the -�
follo�ing guidelines and procedures to iY'isure the collective bar-
gaining process will function in a free and non-political atmosph��e:
A. Le islative Res onsibilit . The final responsibility ,
for the co ective argaining process rests with the City Council.
Accordingly� the Council sha.11:
(1) Recognize by resolution exclusive representatives
of employee organizations in accordance with state
law.
� (2) Approve and ratify by resolution the selection of
labor consultants to aid and assist in labor

(3) Approve and ratify by administrative ordinance,
collective bargaining agreements negotiated
between the designated representative of the City
and the exclusive representative of an employee
organization.
(4) Approve as submitted final positions for arbi-
tration when required by state law.
B. Executive Res onsibilit . The administrative duties
connecte wit an atten ant to the collective bargaining process
are hereby delegated to the executive branch of government, pur-
suant to the provisions of the City Charter. Accordingly, the
office of the Ma.yor� through the City Administrator, shall:

(1) Select with the approval of the City Council
labor relations consultants to assist in the
collective bargaining process when �deemed
necessary by the City Administrator to carry
out the City' s responsibilities in an efficient
and competent manner. :
(2) Carry on the day to day collective bargaining
process including, but not limited to, the
planning, scheduling and conducting of nego-
tiation sessions; the drafting and preparation
of necessary documents and agreements in coordina-
tion with the office of the City Attorney.
(3) Administrate collective bargaining agreements in
accordance with their terms and provisions as
approved by the City Council.
(4) Process grievances under collective bargaining
agreements in coordination with the office of
the City Attorney.

(5) Ma.ke periodic reports to the City Council
on the status and progress of the collective
bargaining process.
C. Res onsibility of Labor Re resentatives and E�m lo ees.
To insure armonious la or-management relations and t e�air
and efficient conduct of the collective bargaining process, it
is essential that employees and their exclusive representatives
comply with outlined procedures. Accordingly, they shall:
(1) Conduct discussions and negotiatioris concerning
terms and conditions of employment only with
the designated representative of the City.
(2) Submit written demands concerning desired changes
in the terms and conditions of employment in
accordance with a timetable to be established by
the City A�ministrator and approved by the City
Council.
(3) Present grievances concerning terms and conditions
of employment only in accordance with procedures
outlined in the collective bargaining agreements
or by other grievance procedure established by
administrative ordinance of this Council.
Section 2.
Su ervision of Consultants. Labor relations consultants
selecte in accor ance wit ection l herein and approved by
the City Council shall take direction and be under the super-
vision of the office of the City �ldministrator. The specific
duties and responsibilities of consultants shall be set forth
in an agreement to be approved by resolution of the City Council.

To the Honorable Council
of the City of Saint Paul :
Pursuant to your request I am enclosing an administra-
tive ordinance relating to labor relations , providing
an outline of procedures for the conduct of the col-
lective bargaining process .
Section 1 of the ordinance attempts to separate legis-
lative and executive responsibilities and provide
some basic guidelines ior labor representatives and
employees .
Section 2 places the supervision and direction of labor
consultants selected in accordance with Section 1 under
the office of the City Administrator.
At the meeting of your hanorable body on July 10,
1g'73, a question was raised regarding the status of
an agreement pertaining to a labor relations consultant
for the city. We have reviewed the resolution authoriz-
ing consultant ' s services and the agreement . It is
fundamental municipal law that no public funds may be
expended �or contractual services until such time as
the proper dacuments have been fully executed.
