That Chapter 311 of the Saint Paul Legislative Code is ;hereby amended by striking therefrom Section 311. 06 ,'in its _ entirety and substituting in lieu and in place thereof the following : 311. 06. Consent of Nei hborin Pro ert . At leas� thirty (30) days e ore a pu lic earing on an applicati�n for a tavern license, the Department of Finance and M�.nage- ment shall notify by mail a11 owners and occupants who own property or reside within three hundred (300) feet of �he main entrance of the establishment to be licensed and a11 community organizations that ha�� previously regi�tered . _. _���_. with said department, of the tima, place and }�urp�s.e of such h�axing. �aid three h�xnd�ed (�00) ��et b�ing calculat�d and computed as the distance mea�ured in a straight line from the nearest point of the bu�.lding wher� intoxicating liquor is sold, consumed or ��p� for sale to the nearest point of the property line own�d, ,�eased, or under the control of the resident. The requirements set out in this section shall apply only where the application is for a tavern license, in which tavern it is proposed that liQuor will be sold and instrumental music with dancing for the guests therein, or singing or vaudeville entertainment is to be provided. A tavern license only becomes effective upon compliance with this section and consent of the Council by resolution. The failure to give mailed notice to owners or occupants residing within three hundred (300) feet, or defects in the notice shall not invalidate the license provided a bona fide attempt to comply with this subdivision has been made. A bona fide attempt is evidenced by a notice addressed to "owner" and to "occupant" of the listed address . Only one notice need be mailed to each house or each rental unit within a multiple family dwelling regardless of the number of occupants . The notification requirements of this section shall not be applicable where the license is to be held in a place located within the Downtown Business District. For purpose of this section, Downtown Business District shall include all that portion of the City of Saint Paul lying within and bounded by the following streets : Beginning at the intersection of Shepard Road with Chestnut Street, Chestnut Street to Pleasant Avenue, Pleasant Avenue to Kellogg Street, Kellogg Street to Summit Avenue, Summit Avenue to Tenth Street, Tenth Street to Interstate Freeway 94,� Interstate Freeway 94 to Lafayette Bridge, Lafayette Bridge to where the bridge crosses over Warner Road, Warner Road to Shepard Road, Shepard Road to Chestnut Street. Section 2 . This ordinance shall take effect and be in force thirty days after its passage, approval and publication.
