AN ORDINANCE AMENDING CHAPTER 354 OF THE SAINT
PAUL LEGISLATIVE CODE� AS AMENDED, PERTAINING
TO PUBLIC BENCHES.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: ~
Section l.
Tha.t Section 354.03 of the Saint Paul Legislative Code, as
amended, be and the same is hereby further amended by deleting
the sa.�e in its �e�.tirety and substituting in lieu and in place
thereo£ the following:
"�54.03 Separate License for Each Bench. A

at each location, and each license sha.11 be
� valid only for the bench and location to which

be issued for any one year. No person, firm or

� Section 2 .
This ordina.nce shall take effect and be in force thirty
(30) days from and after its passage, approval and publication.

Dear Mayor Cohen:
The attached amendment to Chapter 354 of the St. Paul Legislative Code
would permit the issuance of a total of 450 licenses to one corporation
and in addition it would still reserve 10 licenses to be used by other
persons or organizations who apply for a license to install a courtesy
bench on city right-of-way adjacent to their property.
In 1970 this chapter was amended to permit a total of 425 licenses to
any one firm with 25 benches held in reserve for other individuals who may
want to apply. Since that time we have not issued any licenses to any firm
other than U. S. Bench Co. who now hold 425 licenses.
Chapter 354 of the Legislative Code provides among other things that
the applicant shall post and maintain a bond and public liability insurance
to hold the city harmless as a condition for the granting of said license.
Even though U. S. Bench Co. has received many requests from various people
and organizations for installation of courtesy benches at new locations, the
Department of Public Works has not received any applications for lfcenses
from any individual or organization other than U. S. Bench Co. because of
the cost of installation, maintenance, bonds, insurance and other incidentals
as required by this Chapter of the Legislative Code.
Since the advertising that these benches carry are the means of financing
the costs incurred in their installation, it is doubtful whether an
individual or firm would be able to sell advertising on a limited number of
bences such as one to twenty-five. On this basis it is the Department's

staff opinion that granting U. S. Bench Co., by an amendment to Chapter 354,
an additional 25 licenses would place an additional 25 benches at various
locations throughout the city where a need may arise. Yet at the same time
10 licenses can be reserved for the use of churches, community organizations
or others should they apply for a license.
