THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts and Rezoning of certain prop-
erties in the City of Saint Paul, as amended, be and the same
is hereby further amended so as to rezone the following des-
cribed property from "C" Residence District to Commercial,
to-wit:
Lots 8, 9, 10, and 11, Block 29,
Robertson and Van Ettens Addition;
situate on property located on the south side of Sherburne
between Galtier and Marion in the City of Saint Paul.
Section 2. This ordinance shall take effect and be in
force thirty (30) days from and after its passage, approval
and publication.

Dear Sir:
This is written in response to the petition of R. and N. Corporation to rezone,
from "C" Residence to Commercial, property located on the south side of Sherburne
between Galtier and Marion. This property is further described as follows:
Lots 8, 9, l0, and 11, Block 29, Robertson and Van Ettens Addition.
This matter was heard by the Board of 7oning at its December 6, 1973, public
hearing. The staff recommended approval of the rezoning provided that the
petitioner and adjoining land owners enter into a written Declaration of
Restrictions in which the petitioner agrees to place a covenant on his deed to
the effect that this property be used only for off-street parking and not for
display or sale of used cars. He then read letters from the Thomas-Dale
Development Council, one of which requested some landscaping,
The representative for the petitioner said most of their ingress and egress
would be from Galtier. He said they would be parking customer and employee cars
on this lot.
A motion to recommend approval of the rezoning subject to the Declaration of
Restrictions being filed carried unanimously.
This matter was heard by the Planning Commission on December 14, 1973, and the
motion to recommend approval carried unanimously.

Dear Mr. Trudeau:
The Thomas-Dale Development Council, Inc. , recommends to the
City Council that the petition of the R and N Corporation to
rezone from ��C�� Residence t0 ��Commercial�� � LOtS $� 9 � l�� and
11, Block 29, Robertson' s and Van Etten 's Addition (the south
side of Sherburne Avenue between Marion and Galtier Streets) ,
be approved for a conditional use permit, restricting the
use of that land for employee and off-street parking only, as
was stated the intent of the petitioner when he appeared before
the Development Council in request of support for this rezoning.
Since it is the desire of the residents and property owners
in the immediate area that the R and N Corporation be granted
permission to use the land for off-street parking, thereby
hopefully easing the parking problems the property owners are
now experiencing, we do agree with that use; however, we feel
it would be most unfortunate if the petitioner is enabled to
later expand the parking��to allow for a used car lot or more
structures, thereby beginning the invasion of commercial on
the residential environment to the north.

approved February 20; T974 , and published in the official
newspaper of said City of Saint Paul on the 23rd day of :
�'ebruary, 1974 , amending said Zoning Code, as amended, so
that said hereinabove described real estate was thereby and there-
under rezoned and reclassified from "C" Residence to f1Commercial" ,

WHEREAS, the first party, for itself and its successors ,
assigns, and lessees does hereby bind itself, its successors ,
assigns , and lessees unto the second parties , that said real estate
has been effectively restricted and limited in respect of its use
and employment and shall henceforth be restricted and limited in

(1) That, subject to any further reclassification of the

FURTHER, this Declaration of Restrictions shall run with
