WHEREAS, The Council, pursuant to the provisions of Section 12 . 09 of the Saint Paul City Charter and the Public Employees Labor Relations Act of 1971, as amended 1973 , recognizes District Council 91 of the American Federation of State, County and Municipal , Employees as exclusive representative for those classes of positions within the City of Saint Paul certified by the Bureau of Mediation Services under Case No. 74-PR-61-A for the purpose of ineeting and negotiating the terms and conditions of employment for ali full-time personnel in the classes of positions as set forth in the agreement between the City and the exclusive representatives hereinabove referenced; and , WHEREAS, The City through designated representatives and the exclusive representatives have met in good faith and have � negotiated the economic terms and conditions of employment for the calendar year of 1974 for such ' personnel, as are set forth in the Memorandum of Agreement between the City and exclusive representatives ; now, therefore `� THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. State, County and Municipal Employees on file in the office of the City Clerk is hereby approved and the authorized administrative officials of the City are hereby authorized and directed to execute said agreement on behalf of the City. Section 2 . That all of the terms and conditions set forth in said Memorandum of Agreement shall take force and effect retro- actively to the first pay period for the City employees for the year of 1974 in accordance with the expressed intent and agreement of the Council contained in Council File No. 262768 and 262851. Section 3 . That any other Ordinance , rule or regulation in force when said agreement takes effect, inconsistent with any provision of the terms and conditions of said agreement, is hereby repealed. Section 4. That this Ordinance shall take effect and be in force thirty (30) days after its passage, approval and publication. The parties hereto have agreed that the following salary and fringe improvements shall constitute the economic settlement between the parties for the year 1974: 1. A salary increase of 5. 5% (Five and one-half per c�nt) applied t�o all grades. 2. An improvement in the vacation schedule in the following ca:�,egories: (a) For tho�e emg,lo}rees with at least fifteen (15) years, but less than twenty-five (25) yearst service, add one day paid vacatioxi to present schedule. (b) r or those employee� witlY twenty-five (25) years or more of service, adcl twv �lays' paid vacation to presen* �chedule. 3. Modify the sick leave conversion to vacation policy, to allow eligibi.lity for conversion when 180 day� hav° been accuinula�ed. (Replaces pres�nt 200-day requirement. ) 4. Add $500. 00 to severance pay allowance. (Severance allowance will now become $3, 500. 00. ) 5. Provide paid health insurance (same as for active employees except for life insurance) for those who retire prior to age 65, to be continued to age 65. This provision shall be applicable to any employee who retired on or after July 1, 1973, except that prior to January 1, 1974 the City will not be responsible for premiums. , . _1_ �� �`- ... � � . r ,, ..i � _ � , 2�3 _ � - �29. .. 6. Add one paid floating holiday. It is understood that the above improvements will be incorporated into a collective bargaining agreement between the parties, and that the non-economic provisions of such agreement, as well as problems relative to clerical and special service employees previously raised, shall con- tinue to be bargained. Attached you will find a Memorandum of Agreement between the City of Saint Paul and District Council 91 of the American Federation of State, County, and Municipal Employees and a proposed ordinance approving this Memo- randum of Agreement. You will note that item 4 of the attached Memorandum of Agreement increases the severance pay allowance from $3 ,000. 00 to $3, 500. 00. However, Minnesota Session Laws 1971 , Chapter 599, limits the maximum amount of severance pay allowable to $3, 000 . 00, Neither of the parties to this agreement were aware of this provision at the time that this agreement was reached . We have discussed this issue with representatives of the City Clerical and City special service employees, and all parties have agreed that we should seek council approval of this Memorandum of Agreement subject to the following: 1. ) That this agreement be subject to all existing state and local laws, and City Hall, Saint Paul, Minnesota 55�02 O a � � � � , �` t � � . � �s�o��► Hon.
