THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the Zoning Map of Saint Paul, Sheet No. 11, as incorpor-
ated by reference in Section 60.401 of the Saint Paul Legislative
Code, is hereby amended as follows:
The property bordered by Pierce Butler Route,
Hewitt Avenue and Griggs 5treet, more particularly
described as follows:
"Tract 'A' , Registered Land Survey No. 98, "
is rezoned from R-4 to RM-2.

Dear Madam:
This letter is written in response to the petition of Patricia Gartland
to rezone the triangular site bordered by Pierce Butler Road, Hewitt &
Griggs from R-4 (single family residential ) to I-1 (light industry).
This property is described as "Tract A", Registered Land Survey #98.
This matter was heard before the Current Planning & Zoning Committee on
September 15, 1977 at which time staff recommended that the petitioner's
request be denied. Mr. John Daubney, attorney for Ms. Gartland, revised
the original request from I-1 to RM-2 (a multiple family zone). A motion
to recommend granting the new request to rezone to RM-2 was made by Ms.
Grittner, seconded by Ms. McGinley, and passed on a unanimous roll call
vote of 6 to 0.
On 9-23-77 the Planning Commission passed unanimously a motion made by Mr.
Bryan, seconded by Ms. McGinley, to recommend granting of this petition
to rezone to RM-2.
This matter is scheduled to be heard before the St. Paul City Council on
October 27, 1977.

A meeting of the Planning Comnission of the City of St. Paul , Minnesota, was
held September 23, 1917, at 9:00 a.m. jn the Planning Conference Room at 421
Wabasha, St. Paul , Minnesota.
Present: Mmes. Cochrane, Grittner, Mayne, McGinley, Montgomery, Norton,
Piccolo, and Sumners; Messrs. Bryan, Grais, Hanggi , Humner,
McDonell , Pangal , Stegemoeller, Tabler, and Van Hoef.
Absent: Messrs. Feder, Prifrel , Sherwood, and Willits
Also present: Bob Straughn, City Attorney's office; Maura Kane; E. Bierman;
Jack Fontain, Dayton's; Edw. E. Parranto, PBI; John Kelly,
Dispatch; Jean Berman, Mark Senn, and Jim Bellus of planning

The Planning Commission at its September 23, 1977 meeting took the following
action:
APPROVED the minutes of the September 9, 1977 meeting with a correction on
the first page, third paragraph from the bottom to show that Mrs. McGinley
seconded the motion. Motion to approve the amended minutes was made by Mr.
Stegemoeller, seconded by Mr. Bryan, and carried by unanimous voice vote.
APPROVED a motion by Mr. Bryan, seconded by Mr. Hummer, to recomnend the
rezoning to RM-2 of property on the south side of Grand between Cleveland
and Finn which was requested by the College of St. Thomas. Motion carried
by a unanimous roll call vote.
APPROVED a motion by Mr. Bryan, seconded by Mr. Tobler, to recommend the
rezoning for property on the northwest corner of Kent and Charles to P-1 and
on the southwest corner of Kent and Edmund to B-1 . A rezoning was requested
by Roman Adam. Motion carried by a unanimous roll call vote.
DENIED to recorrnnend the rezoning to B-3 requested by Donald Olson for property
at the northeast corner of Maryland and Danforth. Motion was made by Mr. Bryan,
seconded by Mrs. McGinley, and carried by a unanimous roll call vote.
PPROUED a motion by Mr. Bryan, seconded by Mrs. McGinley, to recommend the
rezoning of a triangular site bordered by Pierce Butler, Griggs, and Hewitt,
requested by Patricia Gartland, to RM-2. Motion carried by a unanimous roll
call vote.
DENIED to recommend rezoning requested by Edward Wiggins for property located
north of Burlington Road and West of McKnight to R-2. Motion was made by
Mr. Bryan, seconded by Mr. Humner, and carried by a roll call vote of 12 to 4.

The meeting was chaired by Mr. James Bryan.
PATRICIA A. GARTLAND #8203 : A petition ta rezone from R-4 to I-1 property
whichis a triang e bor ere by Pierce Butler Road, Hewitt, and Griggs.
The petitioner was present. There was opposition.
Ed Warn read the staff report and showed slides of the site.
John Daubney, attorney for Mrs. Gartland, indicated the property in question
was purchased 10 years ago for $22,000 by Mr. Gartland who intended to use it
for business. It was zoned light industrial at the time. Mrs. Gartland had
attempted to sell it as part of the estate and found a buyer who wanted it
for an electrical contracting business office and warehouse. At that time it
was discovered the property had been rezoned to single family R-4 without
notice because it was part of the general city zoning. He distributed photo-
graphs of industrial usage in the area. He indicated the buyer had been lost
so there is no definite proposal but they are requesting a zoning change now
because October 25, 1977 is the deadline for short form rezoning. He stated
a competent appraiser indicated the property as it is zoned--single family--
is valued at 51Q per square foot but the value for light industrial is $1 .25
per square foot and there is a market. Mrs. Gartland is faced with a loss
of about 50 percent by the zoning change. He requested a resolution from the
community council be read.
Mr. Warn read the resolution from District 1] Coalition which indicated that
District 11 favored an appropriate zoning but not necessarily to I-1 .
Mr. Daubney indicated the committee could recomnend intermediate type of zoning
and suggested that since there is an existing 18 unit apartment building on
the south side of Hewitt, Mrs. Gartland could probably find a buyer for apart-
ment development if they could have RM-2 zoning which would permit approximately
22 units, and the interests of the neighborhood would be protected. He
recorrrnnnended the comnittee rezone to the RM-2 classification.
Testifying against the rezoning, Ray Devine, 1200 Hewitt Avenue, stated that
while he was not against something truly light industrial , if it would not
use Hewitt Avenue, they should know what was going in there.
Mr. Bryan pointed out that they were now considering changing to multi-family,
not light industrial . .
Mr. Devine indicated he had no objection to multi-family provided access was
on Pierce Butler rather than Wewitt.

Mr. Daubney said his client agreed and access would be from Pierce Butler.
Ms. Lorraine Waldron, 1216 Hewitt, testifying against the petition, indicated
that an apartment dwelling might be better, particularly if the entrance was
from Pierce Butler, but none of this would add to the neighborhood and she
would not like property used in this manner.
Ms. Margaret Lange, 1246 Hewitt, stated her home was 17 years old and she
would like to keep the neighborhood as it is. She expressed concern about
where the traffic would be going if they build apartments and stated that if
they don't use Pierce Butler it would not be too good.
Mr. Gerald Opp, 1231 Hewitt, stated he was not f�r : RM-� zoning, that the
apartment down the street has created excessive traffic with no restriction
on traffic speed, and it tends to be a one-way street which channels traffic.
He said he could see the possibility of having access from Pierce Butler if
there were enough parking space. He also stated that if he knew what was
going in he would consider changing his view.
Mrs. Grittner moved that the committee recorrrrnend an RM-2 zoning. Mrs.
McGinley seconded the motion, and it carried by a roll call vote of 6 to 0.

A. SUFFICIENCY: The petitioner's request to rezone was filed on a short form
petit�on subscribed and sworn to before a notary public on August 9, 1977
and received by the City Planning Office on August 17, 1977.
B. PROPOSAL: The request is to rezone this property from R-4 to I-1 .
C. FRONTAGE & AREA: This triangular site has approximately 400 ft. of frontage
on Pierce Butler Road, 369 ft. along Hewitt, and 148 ft. along Griggs Street.
The site contains 0.63 acres.
D. SITE CONDITIONS: This undeveloped, triangular site is bordered by Pierce
Butler Road, light industry and railroad land on the north and east, and
single family, residences on the south and west.
E. AREA CONDITIONS: Pierce-Butler Road generally divides the area between
light industry on the north and residential on the south. The residential �
area contains a variety of new and older well maintained single family homes. '
F. FINDINGS:
1 . The area is one of residential and light industry separated by Pierce
Butler Road.
2. The site in question is on the residential side of Pierce Butler Road.
3. Pierce Butler access would not be desirable for single family residences.
4. Certain business or light industry, with access only to Pierce Butler,
might be developed and be compatible with surrounding residential uses.
5. In the absence of a definite plan for the site, a change in zoning to
allow any legal light industry use may be detrimental to the neighborhood.
G. STAFF RECOP�MENDATIONS: Based on Findings #2 and #5, Staff recommends that
the petitioner's request be denied.

to rezone the triangular site bordered by Pierce Butler Road, Hewitt &
Griggs from R-4 (single family residential ) to I-1 (light industry).
This property is described as "Tract A", Registered Land Survey #98.
This matter was heard before the Current Planning & Zoning Committee on
September 15, 1977 at which time staff recommended that the petitioner's
request be denied. Mr. John Daubney, attorney for Ms. Gartland, revised
the original request from I-1 to RM-2 (a multiple family zone). A motion
to recommend granting the new request to rezone to RM-2 was made by Ms.
Grittner, seconded by Ms. McGinley, and passed on a unanimous roll call
vote of 6 to 0.
On 9-23-77 the Planning Commission passed unanimously a motion made by Mr.
Bryan, seconded by Ms. McGinley, to recommend granting of this petition
to rezone to RM-2.
This matter is scheduled to be heard before the St. Paul City Council on
October 27, 1977.

The Planning Commission at its September 23, 1977 meeting took the following
action:
APPROVED the minutes of the September 9, 1977 meeting with a correction on
the first page, third paragraph from the bottom to show that Mrs. McGinley
seconded the motion. Motion to approve the amended minutes was made by Mr.
Stegemoeller, seconded by Mr. Bryan, and carried by unanimous voice vote.
APPROVED a motion by Mr. Bryan, seconded by Mr. Humner, to recommend the
rezoning to RM-2 of property on the south side of 6rand between Cleveland
and Finn which was requested by the College of St. Thomas. Motion carried
by a unanimous roll call vote.
APPROVED a motion by Mr. Bryan, seconded by Mr. Tobler, to recommend the
rezoning for property on the northwest corner of Kent and Charles to P-1 and
on the southwest corner of Kent and Edmund to B-1 . A rezoning was requested
by Roman Adam. Motion carried by a unanimous roll call vote.
DENIED to recorr�nend the rezoning to B-3 requested by Danald Olson for property
at the northeast corner of Maryland and Danforth. Motion was made by Mr. Bryan,
seconded by Mrs. McGinley, and carried by a unanimous roll call vote.
PPROVED a motion by Mr. Bryan, seconded by Mrs. McGinley, to recommend the
rezoning of a triangular site bordered by Pierce Butler, Griggs, and Hewitt,
requested by Patricia Gartland, to RM-2. Motion carried by a unanimous roll
call vote.
DENIED to recommend rezoning requested by Edward Wiggins for property located
north of Burlington Road and West of McKnight to R-2. Motion was made by
Mr. Bryan, seconded by Mr. Humner, and carried by a roll call vote of 12 to 4.

PATRICIA A. GARTLAND (#8203) : A petition to rezone from R-4 to I-1 property
which is a triangTe o-6 rdere�c by Pierce Butler Road, Hewitt, and Griggs.
The petitioner was present. There was opposition.
Ed Warn read the staff report and showed slides of the site.
John Daubney, attorney for Mrs. Gartland, indicated the property in question
was purchased 10 years ago for $22,000 by Mr. Gartland who intended to use it
for business. It was zoned light industrial at the time. Mrs. Gartland had
attempted to sell it as part of the estate and found a buyer who wanted it
for an electrical contracting business office and warehouse. At that time it
was discovered the property had been rezoned to single family R-4 without
, , notice because it was part of the general city zoning. He distributed photo-
graphs of industrial usage in the area. He indicated the buyer had been lost
so there is no definite proposal but they are requesting a zoning change now
because October 25, 1977 is the deadline for short form rezoning. He stated
a competent appraiser indicated the property as it is zoned--single family--
is valued at 51� per square foot but the value for light industrial is $1 .25
per square foot and there is a market. Mrs. Gartland is faced with a loss
of about 50 percent by the zoning change. He requested a resolution from the
community council be read.
Mr. Warn read the resolution from District 11 Coalition which indicated that
District 11 favored an appropriate zoning but not necessarily to I-1 .
Mr. Daubney indicated the committee could recomnend intermediate type of zoning
and suggested that since there is an existing 18 unit apartment building on
the south side of Hewitt, Mrs. Gartland could probably find a buyer for apart-
ment development if they could have RM-2 zoning which would permit approximately
22 units, and the interests of the neighborhood would be protected. He
recommended the committee rezone to the RM-2 classification.
Testifying against the rezoning, Ray Devine, 1200 Hewitt Avenue, stated that
while he was not against something truly light industrial , if it would not
use Hewitt Avenue, they should know what was going in there.
Mr. Bryan pointed out that they were now considering changing to multi-family,
not light industrial . ,
Mr. Devine indicated he had no objection to multi-family provided access was
on Pierce Butler rather than Wewitt.

Mr. Daubney said his client agreed and access would be from Pierce Sutler.
Ms. Lorraine Waldron, 1216 Hewitt, testifying against the petition, indicated
that an apartment dwelling might be better, particularly if the entrance was
from Pierce Butler, but none of this would add to the neighborhood and she
would not like property used in this manner.
Ms. Margaret Lange, 1246 Hewitt, stated her home was 17 years old and she
would like to keep the neighborhood as it is. She expressed concern about
where the traffic would be going if they build apartments and stated that if
they don't use Pierce Butler it would not be too good.
Mr. Gerald Opp, 1231 Hewitt, stated he was not f�r . RM-2 zoning, that the
apartment down the street has created excessive traffic with no restriction
on traffic speed, and it tends to be a one-way street which channels traffic.
He said he could see the possibility of having access from Pierce Butler if
there were enough parking space. He also stated that if he knew what was
going in he would consider changing his view.
Mrs. Grittner moved that the committee recommend an RM-2 zoning. Mrs.
McGinley seconded the motion, and it carried by a roll call vote of 6 to 0.

A. SUFFICIENCY: The petitioner's request to rezone was filed on a short form
petition subscribed and sworn to before a notary public on August 9, 1977
and received by the City Planning Office on August 17, 1977.
B. PROPOSAL: The request is ta rezone this property from R-4 to I-1 .
C. FRONTAGE & AREA: This triangular site has approximately 40Q ft. of frontage
on Pierce But er Road, 369 ft. along Hewitt, and 148 ft. along Griggs Street.
The site contains 0.63 acres.
D. SITE CONDITIONS: This undeveloped, triangular site is bordered by Pierce
Butler Road, light industry and railroad land on the north and east, and
single family residences on the south and west.
E. AREA CONDITIONS: Pierce-Butler Road generally divides the area between
light industry on the north and residential on the south. The residential
area contains a variety of new and older well maintained single family homes.
F. FINDINGS:
1 . The area is one of residential and light industry separated by Pierce
Butler Road.
2. The site in question is on the residential side of Pierce Butler Road.
3. Pierce Butler access would not be desirable for single family residences.
4. Certain business or light industry, with access only to Pierce Butler,
might be developed and be compatible with surrounding residential uses.
5. In the absence of a definite plan for the site, a change in zoning to
allow any legal light industry use may be detrimental to the neighborhood.
G. STAFF RECOP�MENDATIONS: Based on Findings #2 and #5, Staff recomnends that
the petitioner's request be denied.
