Early Notification System Policy and Procedures 14 15 WHEREAS, the Early Notification System Policy and Procedures as set forth in Appendix Chapter A-11 of 16 the Administrative Code have been substantially revised for clarity and simplification; now, therefore, be it 17 18 RESOLVED, that the Council of the City of Saint Paul does hereby adopt the "Early Notification Policy and 19 Procedures," a copy of which is attached hereto and incorporated herein by reference, and that this policy 20 and procedure be substituted for the previous "Early Notification Policy" approved by Council Resolutions 21 C.F. 274957 and C.F. 273465 found in Chapter A-11 of the Administrative Code. 22 23 EARLY NOTIFICATION SYSTEM POLICY AND PROCEDURES 24 25 26 The Saint Paul City Council recognizes the needs of area residents and neighborhood organizations 27 for timely information concerning local development and change which may have an impact on the 28 communiry. Further, the council finds significant value in the views and concerns of local residents and 29 groups as input for the decision-making process involved in granting or denying approval of applications 30 for various licenses, permits, land use changes, and building or zoning variances. To facilitate the 31 necessary information exchange between various city departments, boards, committees, commissions, task 32 forces, the city council (city agencies) and affected neighborhood organizations, other agencies and 33 individual residents, the city council has established this early notification system (ENS). By separate 34 resolution, the city council has requested the port authority and HRA to follows the ENS. Operation of the 35 ENS shall be in conformance with the following policies and procedures. 36 �� r� � � �� � qC- 1��� f . . � 1 POLICY 2 3 City agencies shall use the ENS to inform neighborhood organizations and concerned citizens of all 4 considered, and proposed, planned or implemented developments, legislative and policy changes, and 5 enforcement actions (city actions) which may potentially impact the neighborhood and/or area residents. 6 Notification through the ENS shall be in addition to, and not as a substitute for, notices required by 7 federal, state, county and city rules, laws and ordinances. 8 9 In addition to notices regarding actions on proposals brought before a city board, committee, 10 commission, task force or council, these bodies shall provide meeting notices and agenda to addressees on 11 the early notification system (ENS) list, as outlined in procedures below. City departments and divisions 12 shall provide notices for various activities as detailed in procedures below. 13 14 To assure that this policy is carried out in a manner which provides adequate notice of proposed 15 changes and activities, and to provide a suitable system for monitoring notifications which occur through 16 the system, the following procedures will be used in the operation of this ENS. 17 18 PROCEDURES 19 20 1. A listing of names and complete addresses of contact persons arranged in district number 21 order shall be maintained and updated at least quarterly by the citizen participation 22 coordinator (CPC); this is the "district" portion of the ENS list. 23 24 2. Representation on the ENS list shall be limited to: 25 26 a. Community organizers; 27 28 b. Two (2) persons from each planning district council; 29 30 c. Two (2) persons from each community organization within a planning district; 31 32 d. Neighborhood newspapers; 33 34 e. Elected state officials representing districts or portions thereof; and 35 36 f. District liaison planners. Selection of persons representing planning districts and 37 communiry organizations is the responsibility of the body to be represented. 38 39 3. A listing of names and complete addresses of contact persons for all city departments, 40 divisions, city-wide agencies and organizations shall be maintained and updated at least 41 quarterly by the citizen participation coordinator; this is the "All" portion of the ENS list. 42 43 4. Additions, deletions or address changes on the ENS list shall be referred to the CPC, who 44 will issue updated lists to each city department, division, board, committee, commission, the 45 port authority, HRA, etc., on a quarterly basis, when changes to the list occur. City staff 46 working with newly formed committees, commissions, task forces, etc., shall report to the a �...i a".. � '�a � e � � � ��; °Ic.- ���� 1 citizen participation coordinator regarding the date of formation, type, function, name and 2 expected duration of the new body (e.g. January 18, 1988; task force to study increased 3 school age populations; School Population Task Force; work to be completed and task force 4 dissolved by January 1990). 5 6 5. A copy of each notice, agenda, questionnaire, plan, information packet, etc., sent out using 7 the early notification system shall be furnished to the citizen participation coordinator at the 8 time of sending. Notations on the CPC's copy shall clearly indicate addresses, such as 9 "District #," "ENS List." 10 11 6. Each notice, agenda, plan, information packet or questionnaire, etc., sent through the ENS 12 shall contain the name of a responsible city contact person, a phone number at which the 13 contact person can be reached, and a notation indicating which district(s) will or may be 14 affected by the action proposed. 15 16 7. For regularly scheduled meetings, the CIB Committee, City Council, Housing and 17 Redevelopment Authority Board, Planning Commission and Port Authority shall send meeting 18 notices and agenda to the addressees on the ENS, as far in advance of the meeting date as 19 possible. 20 21 8. For meetings that are not regularly scheduled, all committees, commissions, council and 22 boards shall send meeting notices and agenda to addressees on the ENS list sufficiently in 23 advance to provide a minimum of three (3) days' notice of the meeting. 24 25 9. A 45-day advance written notice shall be furnished to the affected district(s) for any public 26 hearings to consider the following: 27 28 . . 29 30 . . 31 32 . - . 33 34 . . 35 36 e. Street and alley vacations, replattings and lot splits. 37 38 f. Special assessments affecting more than two (2) properties within a single city block. 39 40 g. Development/redevelopment advertisement. 41 42 h. Changes in city policy which affect neighborhoods. 43 44 10. To provide optimum notice for zoning matters, the zoning staff shall provide written notice to 2 affected neighborhoods according to the following schedule: 3 4 a. Appeals, within two (2) working days of receipt of application. 5 6 b. Change of nonconforming use, within two (2) working days of receipt of application. 7 8 c. Determination of similar use, within two (2) working days of receipt of application. 9 10 d. Special condition use, within two (2) working days of receipt of application. 11 12 e. Rezoning, immediately following determination of sufficiency. 13 14 f. Variances, within two (2) working days of receipt of application. 15 16 g. Forty-acre studies, at least thirty (30) days prior to formal public hearing. 17 18 i� ��. A thirty-day advance written notice shall be furnished to the affected district(s) for public 19 hearings to consider any of the following: 20 21 a. Housing or building condemnations. 22 23 b. Housing or building demolitions. 24 25 c. Requests for building code variances which: 26 27 1. Change occupancy load for a building. 28 29 2. Include cellar dwelling units. 30 31 3. Include shared bathrooms. 32 33 4. Affect the exterior appearance of the building. 34 35 -i� 13!. Affected district councils shall be notified of any significant fire code variances and of the 36 denial of any business license based on a fire code violation. 37 38 �-3 �4. Other notices to district council(s) shall include: 39 40 a. Availability of public lands for development/redevelopment. 41 42 b. Availability of tax forfeited and surplus properties suitable for reuse. 43 44 � ��,. Obtain training, if needed to use the system, from the citizen participation coordinator. 5 6 b. If you are not a regular user of the ENS system, notify the citizen participation 7 coordinator of your intent to use the system so that mailings can be consolidated 8 whenever possible. 9 10 c. Good verbal communications with the community organizer will help to assure timely 11 community feedback for your proposal. 12 13 d. Obtain updated listings for the ENS from the citizen participation coordinator. 14 15 e. Notify only the district(s) which is (are) affected by the item. Whether sending a 16 notice to all districts (city-wide) or a certain district (district-specific), the mailing is 17 always combined with the "All" portion of the ENS list. 18 19 f.
