Principal uses permitted. 11 12 In a B-3 General Business District, the use of land, the location and erection of new buildings or 13 structures, and the alteration, enlargement and moving of existing buildings or structures from other 14 locations or districts shall conform to the following specified uses, unless otherwise provided in this code: 15 16 (1) All principal uses permitted and uses permitted subject to special conditions and as regulated 17 in OS-1, B-1, and B-2 Districts, except auto service stations and licensed correctional 18 community residential facilities, health department-licensed community residential facilities 19 and emergency housing. 20 21 (2) Mortuary establishments (funeral homes). 22 23 (3) Bus passenger stations. 24 25 (4) New and used car salesroom, showroom or office. The planning commission, or the planning or 118 zoning administrator where delegated, shall investigate the circumstances of each such case �e€e�e 119 , , . When authority has 120 not been delegated to the planning or zoning administrator, the planning commission shall make no 121 decision until after a public hearing has been conducted by the planning commission or the zoning 122 committee of the planning commission. When a specific use is not listed in a district the planning 169 commission shall determine if a use is similar to other uses permitted in each district. DISCUSSION This amendment allows the Planning Commission to grant variances from zoning regulations related to special condition use permits, nonconforming use permits, determination of similar use, sign variances, river corridor modifications, and site plan approvals. Under existing regulations, permits are reviewed and approved or denied by the Planning Commission, and variances are reviewed and approved or denied by the Board of Zoning Appeals. The committee has asked staff to develop additional options for their consideration. This use could be a stand alone business, or it could be combined with brew on premises stores, brew pubs, or any other permitted uses, such as brewing supply stores or grocery stores. TYPE OF USE 1. Staff of the State Department of Public Safety has also informed planning staff that this combination of uses is permitted by state law. State staff has also informed planning staff that Minnesota Statutes, Ch. 340A.301, Sub. 7, does not allow a brew pub to manufacture malt liquor for sale off of the site of the brew pub. Conseyuently, use option 2 can not be put into effect. The State staff has also said that the manufacturing of malt liquor has to be a stand alone business in its own separate space and not combined with other uses (except brew on premises stores as noted above). Staff recommends the first option as proposed. This fixes the problem presented to the commission. TYPE OF USE Staff recommends that the use be a permitted use. There are no apparent special circumstances that need to be considered in a special condition use process before the use is established. IN B-3 ZONIbIG DISTRICTS, ALLOW LIMITED MANUFACTURING OF MALT LIQUOR AT BREW ON PREMISES STORES FOR SALE TO RESTAURANTS, STORES, AND CLUBS Roger Ryan, Planning Division staff, reviewed the staff report and also his July 11, 1996 memo regarding manufacturing malt liquor. Staff recommended that the manufacturing of malt liquor be permitted in a B-3 district provided it is in conjunction with a brew on premises store; that there is fewer than 2, 000 barrels of malt liquor manufactured in a year; and that malt liquor shall not be sold retail to customers on the site where manufactured. Mr. Ryan stated that the amendment as proposed would take care of the situation that the committee was presented by Vine Park Brewir.g, and said he wasn't sure that this would ever be combined with any other us�, nor that any other such situation would ever occur. Commissioner Field asked whether the manufacturer could gratuitously provide their beverage. Mr. Ryan responded that in the case of brew on premises that customers would be renting equipment for persons to come in and purchase the ingredients and brew their own malt liquor, and the malt liquor would belong to those who brew it. Commissioner Field reviewed that the micro-brewery for Vine Park Brewing will brew for sale out of their larger tub that is not being utilized, and will have a product for sale. He questioned whether any sale, distribution, consumption will be allowed on premise. Mr. Ryan said that no sale, distribution or consumption will be permitted and that the brew must be wholesaled off. Commissioner Field suggested an amendment be made to the language to prohibit not only sale to retail customers on the site, but also prohibiting the serving of brew on site as well. Commissioner Field moved approval of Zoning Amendment No. 1, with the amendment that: ,�_ malt licTUO=• shall not be served to customers on site where it is manufactured. Commissioner Gurney expressed concern over making the language overly restrictive so as not to allow customers, i.e. bar owners, to come in and haye � ���_ ra�-� the opportunity to sample the product before they purchase it. Commissioner Wencl said that such a buyer would not likely come to the brew pub, but rather the brew pub would have a distributor who would distribute the product off-site. Commissioner Field said such language would prevent a tour of the premises or a party to promote the micro-brewery beverage which will not be allowed. The motion carried with a unanimous voice vote of 7 to 0. In response to request by commissioners, staff will address the issue of potential micro-wineries as well as other non-alcoholic beverages with the August Minor Zoning Text Amendments. 2. ALLOW THE PLANNING COMMISSION TO GRANT VARIANCES RELATED TO ZONING PERMITS AND SITE PLAN APPROVAL Mr. Ryan reviewed the staff report and recommended the proposed amendments as outlined in the staff report. Commissioner Chavez asked how the proposed changes would affect the current fee structure. Mr. Ryan referred to page 5, no. 2, where it states that: "ADalicants shall be charged only the fee for the special condition use permit. " He reiterated that there will be only one staff review and public notification. Commissioner Gurney questioned if the same amount of staff time would be required as in the past, but with less fees to cover it. Mr. Ryan responded that would not be the case, that as it is now the staff work is duplicative as it is necessary to support two different bodies, the Board of Zoning Appeals and the Zoning Committee. The proposed amendments would only require the addition of the findings for the variGnce which would not justify requiring both fees. Commissioner Field moved approval of Zoning Amendment No. 2.
