The Hungry Mind Press intends to purchase the property from the applicant and establish a business office. The company has one full-time and one half time employee. The office is used for editorial work which involves correspondence with authors, editors, • agents and booksellers, weekly editorial meetings and telephone activity. They state that there is no desk top publishing, production, sales or order fulfillment activity. The office would be used from 9:00 a.m. to 5:00 p.m. Monday through Friday. The house on Snelling Avenue has been on the market since October, 1995, and has seen very little activity. Hungry Mind Press is requesting a rezoning to B-2C, Community Business Converted. 2. The proposed rezoning is in conformance with the comprehensive plan for the city. The Land Use Plan identifies this stretch of Snelling Avenue as a mixed use strip. One of the recommendations of the Selby Snelling Small Area Plan states, "maintain the mix of residential and commercial zoning and uses along Selby and Snelling Avenues." p.l l There are commercial uses to the north and south in B-2 and B-3 zoning districts. Economic Development Principles in the District 13 Plan states, "Good quality businesses and good quality neighborhoods go hand in hand. They support each other. The needs of both neighborhoods and businesses need to be met," and "Economic growth is critical for employment and nonresidential tax base to help support public schools and city services." #2 7 #, p.23. - moved by �rton seconded by in favor U�i�� � � against— ,z - a � - �z�► � Zoning File #96-167 • Page Two of Resolution The intent of the B-2C Community Business (Converted) District states, "to create a business district expressly for existing residential structures in commercial areas, which will permit the operation of businesses which do not generate large amounts of traffic and at the same time will retain the visual character of the building forms and open space associated with residential uses. This includes a limited height on buildings and front and side yards. It is further the intent of this district to provide parking for employees who work in buildings which are converted from residential to business use." 3. The proposed rezoning is consistent and compatible with the way the area has developed and will not have an adverse impact on surrounding property. Snelling Avenue is a very busy, largely commercial, street accommodating almost 30,000 vehicles per day at this location. There is adequate space on the lot to provide the three required off-street parking spaces for the office. The proposed zoning, B-2C, allows both commercial and residential uses which provides the property owner with greater flexibility in future use of the property as both residential and commercial uses are allowed. Thus, the property would not have to be . rezoned to allow residential use in the future. 4. Current zoning does not allow reasonable use of the property as evidenced by an • inability to attract a residential buyer for almost a year. Snelling Avenue is a largely commercial strip with almost 30,000 vehicles per day which does not attract typical residential buyers. 5. The applicant submitted a sufficient petition signed by two-thirds of the property owners within one hundred (100) feet of the property to be rezoned (12 parcels eligible, 8 parcels needed, and 8 parcels signed). Kady Dadlez, Planning Division staff, reviewed the staff report and presented slides. The Snelling-Hamline Community Council voted to support the rezoning petition. Staff recommended approval of the petition to rezone property from RM-2 to . B-2C based on findings 1 through 5 as outlined in the staff report. Commissioner Vaught asked whether there are other properties zoned B-2C located on Snelling Avenue. • Ms. Dadlez did not believe that there are and said that B-2C uses are mostly on Grand Avenue, however that there are a few others throughout the city. She noted that currently discussions relating to a Selby Avenue Small Area Plan (from Virginia Street to Hamline) are taking place where consideration is being given to rezoning some property to B-2C. Commissioner Vaught asked whether staff was not concerned about the B-2C zoning classification at this location, and whether it might not be spot zoning since it is surrounded by RM-2. Ms. Dadlez responded to the contrary. She reviewed that OS-1, B-1, B-2, and B-2C were options given to the applicants who selected B-2C after careful consideration and discussions with the neighborhood. She said that B-2C is more restrictive than B-2 and would not permit some uses, including restaurants, that would generate more traffic, however B-2C does allow the applicants to maintain the building's residential appearance. Commissioner Vaught said he did not have a problem with the B-2C zoning, Margaret Wurtele, the property owner and co-applicant, spoke. Ms. Wurtele said that she purchased the property solely for the purpose of renting it to Hungry Mind Press, of which she is one of four partners, and all of which were present at the meeting. She said they intend to use the property for a very quiet, administrative, editorial business which would not generate any consumer traffic. Commissioner Kramer asked whether there would be signage on the property. Ms. Wurtele responded that there will likely be one small sign located either • on the front of the house or on the front porch, and tha`t since Hungry Mind is not interested in attracting consumer traffic that there would be no reason � GG - ��.�� • for a large sign. Commissioner Kramer asked whether sign restrictions vary depending on the various zoning classifications. Ms. Dadlez responded affirmatively, saying what's allowed in a residential zone is different than what's allowed in OS-1 and B-1, and that's slightly different than what's allowed in B-2 and B-3. Commissioner Kramer further asked whether the sign restrictions in a B-2C are similar to a B-2 or to an OS-1 or to residential. Ms. Dadlez responded that sign restrictions in a B-2C would be more sim�lar to commercial than to residential, and upon checking said that they're regulated the same as B-2 and B-3. No one spoke in support or in opposition of the rezoning. Commissioner Vaught moved approval of the petition to rezone the property from RM-2 to B-2C. Commi.ssioner Wencl seconded the motion. There was brief discussion generated by the comment in the July 24, 1996 letter from the Snelling Hamline Community Council that: ". . .a number of neighbors objected to the change on the basis that, even though they didn't mind the Hungry Mind Press, some future business that would also be allowed on that zoning designation, may not be so neighborly. " The point was made that zoning decisions are not made on the merits of the character of the people ' associated with a given property but in terms of its proper use, and that zoning decisions go with the land and not with a particular occupant. The proposed rezoning is in conformance with the comprehensive plan for the city. The Land Use Plan identifies this stretch of Snelling Avenue as a mixed use strip. One of the recommendations of the Selby Snelling Small Area Plan states, "maintain the mix of residential and commercial zoning and uses along Selby and Snelling Avenues. Economic Development Principles in the District 13 Plan states, "Good quality businesses and good quality neighborhoods go hand in hand. They support each other. The needs of both neighborhoods and businesses need to be met, " and "Economic growth is critical for employment and nonresidential tax base to help support public schools and city services. The intent of the B-2C Community Business (Converted) District states, "to create a business district expressly for existing residential structures in commercial areas, which will permit the operation of businesses which do not generate large amounts of traffic and at the same time will retain the visual character of the building forms and • open space associated with residential uses. This includes a limited height on buildings and front and side yards. It is further the intent of this district to provide parking for employees who work in buildings which are converted from residential to business use. " 3. The proposed rezoning is consistent and compatible with the way the area has developed and will not have an adverse impact on surrounding property. Snelling Avenue is a very busy, largely commercial, street accommodating almost 30, 000 vehicles per day at this location. There is adequate space on the lot to provide the three required off-street parking spaces for the office. The proposed zoning, B-2C, allows both commercial and residential uses which provides the property owner with greater flexibility in future use of the property as both residential and commercial uses are allowed. Thus, the property would not have to be rezoned to allow residential use in the future. 4. Current zoning does not allow reasonable use of the property as evidenced by an inability to attract a residential buyer for almost a year. Snelling Avenue is a largely commercial strip with almost 30,000 vehicles per day which does not attract typical residential buyers. 5.
