The purpose of this rezoning is to remove the nonconforming status of his existing 8-unit apartment b�ilding. This matter was heard before the Current Planning & Zoning Committee on December 1 , 1977 at which time staff recorr�nended that the petitioner's request be granted. Ms.'�';McGinley moved to recor�nend denial of the request to rezone to RM-2. Mr. Hummer seconded the motion and it passed on a 5 to 2 roll call vote, with Messrs. Pangal and Bryan dissenting. On December 2, 1977 the Planning Commission confirmed the recommendation of the Current Planning & Zoning Committee by a 16 to 2 roll call vote. Hummer, Pangal and Bryan of the Current Planning & Zoning Committee; Mr. Robert Straughn, Assistant City Attorney; Mr. Richard Amey of the Division of Housing & Building Code Enforcement; Mmes. McNeally and Fox and Mr. Edward J. Warn of the Planning Staff. The meeting was chaired by James Bryan, Chairman. RICHARD SAGESETTER (#8243): A petition to rezone from R-4 to RM-1 property �ocatea on t e northwest corner of Lexington and Minnehaha. The petitioner was present. There was no opposition. Mr. Warn read the staff report and showed slides of the subject site. Richard Sagesetter, 1003 Van Buren, said he had purchased the property when the zoning was correct, and he was asking no more than what he had before the zoning map was changed. Mr. Humner asked if Mr. Sagesetter intended to expand and the petitioner said no, that he just wanted to be in the correct zone so he could refinance if necessary. Mr. Pangal said he understood that RM-1 had been requested in error, and actually RM-2 was being requested, and Mr. Sagesetter said this was correct. Ms. Summers moved to recomnend approval of the RM-2 rezoning, but the motion failed for lack of a second. Mr. Hummer said the entire neighborhood is single family homes and he thought the City Council chose to zone that whole area residential R-4. He said there is a question in his mind and that perhaps property would stick out like a sore thumb. Ms. McGinley then moved to recommend denial of the request, and Mr. Hurrrner seconded the motion. Access to the 3 garages on the site is from Lexington. E. AREA CONDITIONS: The area consists primarily of 20 to 50 year old single family omes in exce ent condition with some institutional uses such as St. Matthews Evangelical Lutheran Church and Central Lutheran School (one block north of the site). FINDINGS: 1 ) The existing building blends very well with the neighborhood. 2) Parking and traffic are not a problem for the immediate neighborhood because - off-street parking space (garages) is available for 6 autos with access from Lexington. 3) The proposed rezoning to RM-1 will allow the construction of 11 rooms, or the equivalent of five 1-bedroom units, and therefore not make the existing structure a conforming use. 4) The existing structure of 7 1-bedroom units plus one efficiency unit totals 16 rooms, which would require rezoning to RM-2 in order to be a conforming use (RM-2 would allow the construction of 17 rooms on this site). G. FINDINGS: 1 ) The existing building blends very well with the neighborhood. 2) Parking and traffic are not a problem for the immediate neighborhood because - off-street parking space (garages) is available for 6 autos with access from Lexington. 3) The proposed rezoning to RM-1 will allow the construction of 11 rooms, or the equivalent of five 1-bedroom units, and therefore not make the existing structure a conforming use. 4) The existing structure of 7 1-bedroom units plus one efficiency unit totals 16 rooms, which would require rezoning to RM-2 in order to be a conforming use (RM-2 would allow the construction of 17 rooms on this site) . G.
