THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. The first sentence of Section 12.09 of the �Charter of the City of Saint Paul is hereby amended to read as follows: "Sec. 12.09. Collective Bargaining Agreements. � The Council shall recognize bargaining agents for � appropriate employee units in accordance with state ' law and ma.y by ad�.��.�s��a��*ae-e�d�r�a�ee� resolution � enter into collective bargaining agreements to t e extent not prohibited by law." Section 2. This ordinance and the amendments to the Charter of the City of Saint Paul contained herein shall become effective ninety (90) days after passage, approval and publication. MINNESOTA 55102 RESOLUTION OF THE SAINT PAUL CHARTER COMMISSION WHEREAS, the City Council adopted on March 24 , 1977, amendments to the Charter to permit the approval of wage agreements and civil service rule changes by resolution rather than ordinance ; and WHEREAS, the Charter Commission had at that time con- sidered the amendments , received testimony and recommended that the Council adopt such amendments without the necessity for an election; and WHEREAS, such amendments were noncontroversial , and have been successfully used for over two years in dealing with wage agreements and civil service rules changes ; and WHEREAS, the Office of the City Attorney has brought to the attention of the Charter Commission that through inadvertence an additional amendment which should have been made at that time was omitted; and WHEREAS, it would be desirable to complete the necessary amendment in order to remove any c{uestion that might arise as a result ; now, therefore, be it RESOLVED, that the Saint Paul Charter Commission recom- mends that the Council of the City of Saint Paul adopt by ordinance the amendment contained in the ordinance attached to this Resolution, without election, pursuant to Minn. Hozza, President Saint Paul City Council 719 City Hall and Court House Saint Paul , Minnesota 55102 Dear Mr. Hozza: On March 24, 1977, the City Council adopted by unanimous vote of all members , certain amendments to the Charter, which per- ' mitted approval of bargaining agreements and civil service rule changes by resolution (read twice) rather than by ordinance. These changes had been recommended by the Charter Commission. Inadvertently, one section which should also have been changed at that time was overlooked, and the City Attorney has recom- mended we make the change now to avoid any further complications . The Charter Commission has therefore adopted the attached resolu- tion at its meeting on September 27, 1979 , which recommends that you adopt the ordinance attached pursuant to Minn.
