An Ordinance amending Chapter 60 of the
St. Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS , Pursuant to Minnesota Statutes, � 462. 357 and
� 64.210 of the Legislative Code, Robert 4V. Dunkel duly petitioned
to rezone Lots 13 through 17, inclusive, Windsor Square Addition,
located on the north side of Cook between Arkwright and DeSoto,
from RT-1 (2 family residential) to RM-2 (multiple family) for the
purpose of constructing an 11 unit apartment building, the petition
having been certified by the Department of Finance and Management
Services on October 18, 1978 as having been consented to by at
least 67� of the owners of the area of the property to be rezoned,
and further, having been consented to by at least two-thirds of
the owners of the property situated within 100 feet of the total
contiguous descriptions of real estate held by the same owner or
any party purchasing any such contiguous property within one year �`
preceding the date of the petition; and
WHEREAS, The current planning commi�tee on November 16, 1978
conducted a public hearing for the purpose of considering the re-
zoning petition, and, pursuant to Section 20.03 of the Aclministra- ,�
tive Code, submitted its recommendation to the Planning Commission
that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
peicition at its meeting held on November 17, 1978 and recommended
that the City Council approve the petition; and I
WHEREAS, Notice of a public hearing before the City Council �
on the said rezoning petition was duly published in the official

wholly or partly within 350 feet of the property sought to be re-
zoned; and
WHEREAS, A public hearing before the City Council, having been
conducted on December 21, 1978 where all interested persons were
heard, and the Council having considered all the facts and recom-
mendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 13,
as incorporated by reference in Section 60. 401 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the north side of Cook
between Arkwright and DeSoto, being more particu-
larly described as Lots 13 through 17, inclusive,
Windsor Square Addition, be and is hereby rezoned
from RT-1 (2 family residential) to RM-2 (multiple
family) .
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Madam:
This letter is written in response to the petition of Robert W. Dunkel to rezone
property located on the north side of Cook between Arkwright and Desoto from
RT-1 (Two-Family Residential ) to RM-2 (Multiple Family) , for the purpose of con-
structing an 11-unit apartment building.
This matter was heard before the Current Planning and Zoning Committee on
November 16, 1978. There were no letters in opposition and no persons appearing
in opposition at the hearing. Staff recorrvnended approval of the rezoning request
and the Current Planning and Zoning Comnittee also recommended approval on a vote
of 7 to 0 based on findings that the site was originally zoned C Residence, that
an RM-2 zone is immed�iately adjacent to the west, and that the rezoning would not
result in a significant increase in density.
On November 17, 1978 the Planning Carrmission unanimously confirmed the determination
of the Current Planning and Zoning Committee to approve the rezoning.
The City Council has scheduled a public hearing on this matter for Qecember 21 , 1978.

ROBERT W. DUNKEL (#83_76� An application to rezone from RT-1 to RM-2 property located on

The applicant was present. There was no opposition present at the hearing.
Donna McNeally showed slides of the subject site and reviewed the staff report
with a recomnendation of approval for the rezoning request.
Robert W. Dunkel , 2�12 E.Hoyt, the applicant, said he had visited all residents whose
property abuts his and assured them that the zoning, if approved, would be adequate
and the apartment building would be properly run.
Mr. Bryan inquired about the land to the north of Mr. Dunkel 's property and whether
there might be a request in the future to rezone this also. Mr. Dunkel said he owned
this land and it was already zoned RM-2.
There being no further testimony, the public hearing was closed.
Mr. Fitzgibbon questioned the RM-2 request rather than RM-1 and Mr. Dunkel said he
had based his request on conversations with his realtor and with banks. Mr. Fitzgibbon
then explored the question of the applicant increasing the apartment units over the
11 units mentioned, saying he was concerned with density. Mr. Dunkel assured him he
had talked this over with residents of the area slso, and most of them felt that the
land would add some relief from taxes, and if he had to to to more than 11 units,
they were assured it would be a quality building. �
Mr. Pangal moved to recommend approval of the rezoning request. His motion was seconded
by Gayle Sumners and passed on a 7 to 0 roll ca11 vote.

A. SUFFICIENCY: The applicant's request was filed on a consent petition subscribed & sworn
to e ore a notary public on September 21 and October 10, 1978; declared sufficient by
the Finance Department on October 18, 1978; and received in the Planning Office on
October 26, 1978.
B. HISTORY: The subject site is a portion of a parcel (the original parcel was a rectangle
run inn g through to Magnolia) which was rezoned from "B" to "C" Residence in 1963 based
on findings that the poor soil conditions of the property made single family or duplex
development economically unfeasible and that the "C" zoning was an extension of the "C"
zoning to the west. The property was never developed.
C. PURPOSE: The petitioner requests to rezone from RT-1 (Two Family) to RM-2 (Multiple) in
order to construct an 11-unit apartment building.
D. FRONTAGE & AREA: The site consists of five 36' lots plus 30' of vacated alley and
easement. Tota frontage on Cook is 190' ; the depth of the lots is 135' , for an approximate
area of 23,650 sq. ft. , or .58 acres.
E. SITE CONDITIONS: These 5 lots are at street grade, vacant, and overgrown. Adjacent to
the nort are 5 vacant lots owned by the petitioner; adjacent to the east, and abutting
across Cook to the soutt� are single family houses; adjacent to the west, and fronting on
Arkwright, is a mixture of single family and multiple use.
F. AREA CONDITIONS: The inunediate area is dominated by the vacant subject property. DeSoto
s opes own at a steep grade to Arkwright. Although the general housing stock is older,
there is evidence of new single family construction on Cook, Magnolia and Arkwright.
East Consolidated School is one block to the south; St. Patrick's is one block to the
northeast.
G. FINDINGS:
1 . The 1963 Comprehensive Land Use Plan identifies this site as Single Family.
2. The site was previously zoned "C" Residence under the 1922 Ordinance.
3. The applicant states that the subject property is fill , (this is verified by the
1963 rezoning and Public Works) and that the cost of construction on the site
dictates multiple family development.
4. There is an RM-2 zone adjacent to the west. -

5. The RT-1 (Two Family) zoning would permit construction of 3 duplex ex and l single
family; 4 single family; or with a variance of the required frontage, 4 duplexes --
the required density would not be exceeded.
6. The RM-2 zoning would permit construction of 14 2-bedroom units; 21 1-bedroom units;
or a combination.
7. An RM-1 zoning would permit construction of 10 2-bedroom units, 14 1-bedroom units,
or a combination.

Section b4.210 of St. Paul's 2oning Ordinance states that 677 of property owners within the
area to be considered must consent to the proposed rezoning. Section 462.357(5) of Minnesota
Statutes states that 2/3 of property owtiers within 100 feet of the land proposed for rezoning
must give written consent before the City shall consider the proposal. However, when the
owner of said property has owned for any tirse in the past year additional real estate contiguous
to the land proposed for rezoning, 2/3 of the property owners within 100 feet of this larger
package of property must give written consent. Pursuant to Section 64.210 of the St. Paul
Zoning Ordinance and Section 462.357(5) of Minnesota Statutes, we, the undersigned, own

Section 64.210 of St. Paul's Zoning Ordinance states that 67! of property owners within the
area to be considered must consent to the proposed rezoning. Section 462.357(5) of Minnesota
Statutes states that 2/3 of property owners within 100 feet of the land proposed for rezoning
must give written consent before the City shall consider the proposal. However, when the
owner of said property has owned for any time in the past year additional real estate contiguous
to the land proposed for rezoning, 2/3 of the property owners within 100 feet of this larger
package of property must give written consent. Pursuant to Section 64.210 of the St. Paul
Zoning Ordinance and Section 462.357(5) of Minnesota Statutes, we, the undersigned, own
