An Ordiinance amending Chapter 308 of the
Saint Paul �,egislative Code permitting the Council
ta r�-issue dormant liquor licenses displaced by
emin�nt dommain or the threat of eminent domain
THE COUNCIL OF T�IE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
Sectio� 308. 34 (b) is hereby amended by adding the
following:

businel�s has discontinued its operation or closed
for an�y reason, the Council shall renew said license
only u�on the condition that the license shall re-
open and restore the licensed business to full
operation within the term of the renewed license,
or in ithe alternative, that the licensee shall make
applic�tion for and obtain passage, approval and
public�tion of a resalution �or the transfer of
said 1'cense within the term of the renewed license
to ano�her person. No license issued upon condition
pursuaht to this subsection shall be further renewed
unless one or other of the above conditions has been
fully �net; rovided, however, that the Council ma
re-iss e a icense for a business whic has not been
in ful operation during the prior license year if
t��ie li ensed remises were acquirec� b eminent c�omain
or un r t e t reat o eminent omain an t e icensee
has ma e a ood faith attem t to relocate the usiness
to ano her location.

WHEREAS:
l. On March 6, 1979, the Port Authority of the City of 5aint
Paul adopted Resolution No. 1462, giving preliminary approval to the
issuance of revenue bonds in the initial principal amount of approxi-
mately $1,000, 000 to complete the financing of the Radisson Plaza
Hotel atop the Por�t Authority financed parking ramp being constructed
on Block A by St. Paul� Joint Venture;
2. Laws of Minnesota 1976, Chaptex 234, provides that any issue
of revenue bonds a�uthorized by the Port Authority of the City of Saint
Paul, shall be isslued only with the consent of the City Council of the
City of Saint Paul�„ by resolution adqpted in accordance with law;
3. The issuance of said bonds were consented to by the Council
of the City of Saint Paul by Resol�tion C. F. 272602 in the initial
principal amount of $1, 000, 000 at �a net interest cos� of not to exceed

4. Further negotiations between the Port Authority, the bond
underwriter, and the contracting party have indicated that the net
interest cost may exceed 8/;
5. The Port Authority of the City of Saint Paul has requested
that the City Coun�il give its requisite consent pursuant to said law
to facilitate the issuance of said revenue bonds by the Port Authority
of the City of Saimt Paul at such higher interest rate, subject to
final approval of �.he details of said issue by the Port Authority of
the City of Saint Paul; now, therefore, be it
