AN ORDINANCE GRANTING PERMISSION TO JAMES J. WENGLER AND/OR HIS
SUCCESSORS IN INTEREST TO CONSTRUCT, OPERATE AND MAINTAIN ORNA-
MENTAL STREET LIGHTS AND CONDUIT IN THE RIGHT-OF-WAYS OF GRAND
AVENUE AND VICTORIA STREET ADJACENT LOTS 26 THROUGH 28, BLOCK 22,
SUMMIT PARK ADDITION.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section t .
That permission and authority are hereby granted to James J. Wengler,
and/or his successors in interest to construct, operate and maintain
ornamental street lights and conduit in the right-of-way of Grand Avenue
and Victoria Street adjacent lots 26 through 28, Block 22, Summit Park
Addition.
Section 2.
That the Director of Public Works is hereby authorized to issue a
permit to James J. Wengler and/or his successors in interest for the
construction, operation and maintenance of said ornamental street lights
and conduit upon and subject to the following terms and conditions:
a. That said permittee shall construct said ornamental street lights
and conduit entirely at its own expense and to the satisfaction
of the Director of Public Works in accordance with the approved
plans and specifications on file in the Department of Public
Works;
b. That said permittee and/or its successors in interest shall
provide electrical power supply for said lights entirely at
their own expense;

c. That said permittee shall pay the costs of administration�
engineering, and inspection incurred by the Department of
Public Works because of this undertaking;
d. That said permittee shall pay the costs for the publication
of this ordinance and all related resolutions and ordinances;
e. That said permittee and/or its successors in interest shall
remove said ornamental street lights and conduit or part
thereof in such manner as is satisfactory to the Department
of Public Works whenever the City Council by resolution shall
so order.
f. That said permittee and/or its successors in interest shall ,
during the term of this permit restore and repair all property,
whether public or private, damaged or which may be damaged due
to the construction, operation, maintenance and removal or
presence of said ornamental street lights and conduit provided
for herein;
g. That said permittee and/or its successors in interest shall
furnish a bond to the City of St. Paul in the sum of $5�000.00
conditioned to comply with all the terms of this ordinance and
to indemnify said City from ail jiability, cost and expense
that may accrue, occasioned by the making of the improvement or
arising out of the same;
h. That said permittee and/or its successors in interest shall
take out and maintain during the period of this permit a compre-
hensive protective public liability insurance which shall remain
in force and effect as long as said ornamental street lights or
conduit or any portion thereof is maintained or located on the
public right-of-way. This liability insurance shatl fully
indemnify, hold harmless, and defend the City of Saint Paul �
its agents, officers and employees from any and all damages,
claims, losses; judgments, suits or expenses on account of
all claims of whatever nature arising out of or connected
with the maintenance,operation and/or removal of said orna-
mental street lights and conduit.
Bodily injury insurance (including death) in an amount
of not less than $250,000.00 for all damages arising -
out of bodily injuries to or death of one person, and
subject to the same limit for each person, in a total
amount of not less than $500,000.00 on account of any
one accident.
Property damage insurance in an amount of not less
than $250,000,00 for all damages to or destruction
of property in any one accident.

The insurance coverage shall automatically be re-
stored immediately after the occurrence of any
accident or loss from which liability may thereafter
accrue and the City of St. Paul shall be notified at
least 30 days in advance of the cancellation of the
insurance coverage by the issuing insurance company;
i . That said permittee and/or its successors in interest shall submit
bond and insurance documents to the Office Engineer of the
Department of Public Works;
j. That said permittee shall , within thirty (30) days after the
passage of this ordinance, file written acceptance thereof
with the City Clerk;
Section 3
This ordinance shall take effect and be in force thirty (30) days from and
after its passage, approval and publication.
