AN ORDINANCE GRANTING PERMISSION TO EAST MALL ASSOCIATES AND/OR ITS
SUCCESSORS IN INTEREST TO CONSTRUCT, OPERATE AND MAINTAIN ORNAMENTAL
STREET LIGHTS AND CONDUIT IN THE RIGHT-OF-WAYS OF GRAND AVENUE AND
VICTORIA STREET ADJACENT LOTS 15 THROUGH 18, BLOCK 18, SUMMIT PARK
ADDITION.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1 .
That permission and authority are hereby granted to East Mall Associates
and/or its successors in interest to construct, operate and maintai� ornamental
street lights and conduit in the �ight-of-way of Grand Avenue and Victorla
Street adjace�t lots 15 through 18, Biock 18, Summit Park Addition. ,
Section 2.
That the Director of Public Works is hereby authorized to issue a permit
to East Mall Associates and/or its successors in interest for the constructton,
, operation and maintenance of said orname�tal street lights and conduit upon
� and subject to the following terms and condttions:
a. That said permittee shati construct said ornamental street ltghts
and conduit entirely at its own expense and to the satisfaction -
of the Director of Public Works in accordance with the approved
plans and specifications on file in the Department of Public
Works;
b. That said permittee and/or its successors in interest shall pro-
vide electrical power supply for said lights entirely at their
own expense;

c. That said permittee shall pay the costs of administration,
engineering, and inspection incurred by the Department of �C,Q� j �
Public Works because of this undertaking;
d. That said permittee shall pay the costs for the publication
of this ordinance and all related resolutions and ordinances;
e. That said permittee shall notify the Engineer in charge of
street lighting within the Department of Public Works before
and when construction starts and notify the same said
Engineer when construction has been completed to allow for
a final inspection;
f. That said permittee and/or its successors in interest shall
remove said ornamental street lights and conduit or part
thereof in such manner as is satisfactory to the Department
of Public Works whenever the City Council by resolution shall
so order.
g. That said permittee and/or its successors in interest shall ,
during the term of this permit restore and repair all property,
whether public or private, damaged or which may be damaged due
to the construction, operation, maintenance and removal or
presence of said ornamental street lights and conduit provided
for herein;
h. That said permittee shall properly protect all excavations
made in the public right-of-way so as to avoid all damage or
injury to persons or property, shall properly fill and tamp
said streets .to avoid settling, and shall restore said street
right-of-way to a condition satisfactory to the Director of
the Department of Pubiic Works;
i . That said permittee shall complete the construction of said
facilities within a maximum of 30 days of beginning such work;
j . That said permittee and/or its successors in interest shall
furnish a bond to the City of St. Paul in the sum of $5,000.00
conditioned to compiy with all the terms of this ordinance and
to indemnify said City fran all liability, cost and expense
that may accrue, occasioned by the making of the improvement or
arising out of the same;
k. That said permittee and/or its successors in interest shall
take out and maintain during the period of this permit a compre-
hensive protective public liability insurance which shall remain
in force and effect as long as said ornamental street lights
or conduit or any portion thereof is maintained or located on the
public right-of-way. This }iability insurance shall fully
indemnify, hoid harmless, and defend the City of Saint Paul ,
its agents, officers and employees from any and all damages,

claims, losses, judgments, suits or expenses on account of
all claims of whatever nature arising out of or connected
with the maintenance operation and/or rernoval of said orna-
mental street lights and conduit.
Bodily injury insurance (including death) i� an amount
of not less than $250,000.00 for all damages arising
out of bodity injuries to or death of one person, and
subject to the same limit for each person, in a total
amount of not less than $500,000.00 on accou�t of
any one accident.
Property damage insurance in an amount of not less
than $250,000.00 for all damages to or destruction
of property in any one acctdent.
The insurance coverage shall automatically be re-
stored immediately after the occurrence of any accident
or loss from which liability may thereafter accrue a�d
the City of Saint Paul shail be notified at least 30
days in advance of the cancellation of the insurance
coverage by the issutng insurance company;
l . That said permittee and/or its successors in interest shall submit
bond and insurance documents to the Office Engineer of the
Department of Public Works;
m. That said permittee shall , within thirty (30) days after the passage
of this ordinance, file a written acceptance thereof with the
City Clerk;
Section 3
This ordinance shall take effect and be in force thirty (30) days from and
