An ordinance amending Chapter 461 of the
Saint Paul Legislative Code, pertaining to
blasting and excavating; adding certain
requirements for insurance, approval, and
seismic monitoring; increasing the bond; other changes.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That Chapter 46'1 of the Saint Paul Legislative Code
be and the same hereby is amended by adding the following
new sec�ions:
461. 10. Insurance. The ermittee under an such
permit hereunder shall furnish to he ci y, in orm
to be a roved b the cit attorne evidence of com re-
hensive rotective ublic liabilit insurance o full
indemnify, save harmless and defend he city o� Saint
Paul, its a�ents, officers and employees from any and all
expenses, losses, liabilit�, suits or demands, including
le�al defense costs thereof, of whatever nature, arisin�
out of or connected with said blastin�. The liability
insurance policy shall be issued by an insurance company
licensed to do business in the state of Minnesota, shall
be non-deductib�e, and the city shall be named as jointly
insured with limits of liability as follows:
Bodily injury insurance �ineluding death) in�an
amount of not less than 250,000 for all damages arising
out of bodily injur.y to or death of one person, and
� sub 'ect to that same limit �or each erson in a total
amount of not less than 500,000 on account of any one
accident.

and submitted to the department of public works prior
to the issuance of the permit.

permit ee, at permittee' s expense. Inspec ion of such
monitorin� and results shall be made available o the
department of public works.
Section 2.
That Section 461.04 is amended to read:
461.04. All places where digging, excavating or -
quarrying is being done in or upon any of the streets,
avenues, alleys, public or private property, �ithin the
city of Saint Paul shall be protected and guarded by
suitable guards by day and by clear �e� ey llow lights
at night.

That Section 461.05 is amended to read:

461.05. Bond. Any p�:r•son, firm, partnership or corporation
wishing to obtain a permit as above provided from the department of
public works shall first deliver to the city of Saint Paul a surety
bond �o the amount of �S3�A8 50 000, in form to be approved by the
ee�pe�a��a�-es��se�. city attorn�y, indemnifying the city of Saint
Paul against any and all damages, costs, or suits arising out of,
or caused by said blasting, and conditioned further to indemnify
any person injured in person or property by reason of said blasting,
and guaranteeing the payment of any final judgment obtained against
such applicant by any person injured in person or property.
Sectior� �.
That Section 461.08 is amended to read:
461.08. Permit ea�ee��a��e�. revo.oation. The ee�����e�e�
director of the de artment of public works may3-a��e�-����e�.
�.e�}ee-� cancel �any permi issued hereunder at any time after
its issuance when the person, firm, partnership or corporation
is operating in a manner in violation of this chapter, or when
in the opinion of said e�a��se�e�e� director such operation is
dangerous to persons or groperty.
Section 5.
This ordinance shall take effect and be in force 30 days
from and after its passage, approval and publication.

Attached Ordinance would update the Chapter of the legislative code pertaining
to blasting permits.

The existing conditions of Chapter 461 provide little protection for the City.
The attached Ordinance would change or establish the following; �) Increase
Bond requirement from $2,500 to $50,000, 2) Require insurance coverage in the
amounts of $250,000/$500,000 bodily injury a�d $1 ,0�0,�00/$2,000,000 property
damage. No insurance is presently required, 3) Allow the City to require
seismic monitoring if we determine it's necessary.
