An Ordinance amending Chapter 60 of the
St. Paul Legislative Code pertaining to
zoning for the City of Saint Paul and
the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes § 462.357 and § 64. 210
of the Legislative Code, the Port .Authority of the City of Saint
Paul, et al, duly petitioned to rezone portions of Section 27,
Township 29 North, Range 23 West, located in the City of Saint Paul,
from I-2 and RT-1 to I-1, for the purpose of developing the Energy
Park mixed use development consisting of energy efficient light
industrial, research and development, office and conunercial uses,
the petition having been certified by the Department of Finance and
Management Services as having been consented to by at least 67% of
the owners of the area of the property to be rezoned, and further,
having been consented to by at least two-thirds of the owners of
the property situated within 100 feet of the total contiguous
descriptions of real estate held by the same owner or any party
purchasing any such contiguous property within one year preceding the
date of the petition; and
WHEREAS, The current planning committee on January 22, 1981,
conducted a public hearing for the purpose of considering the re-
zoning petition, and, pursuant to Sectinn 107.03 of the Administra-
tive Code, submitted its recommendation to the Planning Commission
that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on January 23, 1981 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

WHEREAS, a public hearing before the City Council, having been
conducted on February 5, 1981 where all interested persons were
heard, and the Council having considered all the facts and recom-
mendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning ma.p of the City of Saint Paul, Sheet Nos. 10
and 11 as incorporated by reference in Section 60.401 of the Saint
Paul Legislative Code, as amended, is hereby further amended as
follows:
That property located on the north side of
Pierce Butler Route, being more particularly
described on the attached "Exhibit A" which
is incorporated herein by reference, be and
is hereby rezoned from I-2 and RT-1 to I-1.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

City Council Hearing: February 5, 1981
Dear Madam:
This letter is written in response to the petition of the City of St. Paul
and the Port Authority for rezoning a portion of the Energy Park area east
of Snelling Avenue.
The Zoning Committee of the Planning Commission held a public hearing on
January 22, 1981 ; no opposition was received. The staff recommended
approval of the rezonings to RM-2 and 1-1 with the condition that the
applicant specify the final boundary 1ine at the time of the City Council
public hearing. On a vote of 6 to 0, the Zoning Cornrnittee recornrnended
approval of the rezonings. �
The Planning Corr�nission considered the Zoning Committee's recor.imendation
on January 23, 1981, and approved the rezonings with the same condition
on a vote of 16 to 0.
A public hearing has been scheduled for February 5, 1981 , before the
City Council to hear the petitions for rezoning.

° A. SUFFICIEPICY: The application was filed on a consent petition, subscribed and sworn '
to before a notary public on December 18, 1980, declared sufficient on January 6, 1981 ,
and received in the Planning Division Office on the same date. Forty-four parcels
were eligible; 30 required; and 38 were obtained.
B. PURPOSE: The applicants propose to rezone the eastern portion of tne proposed Energy
Park to a mixture of RM-2 and I-1 . The attached map shows the t4�o areas. The
� applicants propose the rezoning to alloa� development of a mixed use area accordiny
. to the ��lan ror Energy Park. �
C. SITE & A�EA CONDITIONS: The site includes the Midway Stadium, the old Koppers CokE�
Plant and portions of City and Port Authority land in between. The site is situated
north, across Burlington Northern Railroad from the Hamline-Midway neighborhood,
and south of the Como Park neighborhood. Northeast of the site is a Burlington
Northern rail yard and Como Park itself. East across Lexington is the South Como
neighborhood.
D. FIN�INGS:
1 . The St. Paul Land Use Plan identifies the site as a portion of the Energy Park
employment -- housing mixed use cluster.
2. The site is in District 10. The District 10 Plan indicates the site should be
used for industrial uses and housing. The District 10 Plan does not agree with
all aspects of Energy Park plans at the moment. The area proposed for rezoning
' includes only one conflict: The District 10 Plan recommends that the stadium
remain where it is. The City Council has resolved the issue by approving
demolition of the .stadium in favor of the Energy Park proposals.
3. The Planning Division Staff is reviewing the Energy Park plan for consistency
with the Comprehensive Plan. The uses suggested for the area proposed for
rezoning does not contain conflicts with the Comprehensive Plan.
4. The final boundary betNreen the proposec� I-1 zone and the proposed Rhi-2 zone
has not been established. The attached maps show the area where the boundary _
may fluctuate.
E. STAFF AMALYSIS: The proposed uses and rezonings for this portion of Energy Park
are consistent with the City's Comprehensive Plan and should be approved. Movement
of the east/west boundary between the RP•1-2 and I-1 zones will not affect consistency .
�or staff's analysis of the proposal . However, the boundary must be fixed at the
time of the City Co.uncil hearing on the rezoning.
F. STAFF RECOMMENDATION: Based on findings 1 through 4, staff recommends approval of
the proposed rezonings to R�1-2 and I-1 with the condit�on that the applicant specify
ti�e final ,boundary line at the time of the City Council public hearing.
