SUFFICIENCY: The application was filed on a consent petition declared sufficient by t�ie Finance Department on February 6, 1981 . Twenty-six parcels were eligible to sign; 18 were needed; and 19 were obtained. • C. SITE & AREA CONDITIONS: The parcel has a 200 foot frontage on Holly and a 120 foot frontage on Grotto for a total area of 24,000 square feet. Surrounding land uses include one and two family residential and various institutional uses including Webster Elementary School across Grotto, Unity Church on the southeast corner of Grotto and Holly and Beth Israel Synagogue north of the site across the alley. D. FINDINGS: 1 . The applicant is applying for a rezoning to RM-3 based on the advice that RM-3 was necessary due to the density of the proposal . However, multi-family stri�ctures of 5 stories or less must conform to the RM-2 schedule of regulations. Therefore, rezoning to RP1-3 would not resolve the need for a density variance. 2. The proposed conversion of the vacant Performing Arts Center would create eic�hteen, 1-, 2-, �.nd 3-bedroom condominium units with a projected selling price of $50,000- $60,000. 3. Adaptive reuse of vacant institutional uses for residential use is encouraged by the City's Land Use Plan if criteria related to parking, open space, and density are met. 4. The site plan indicates 27 parking spaces will be provided. On March 19, 1981 , the Zoning Committee conducted a public hearing on this case, at which time the applicant indicated that an RM-2 zoning would be acceptable. No correspondence was received on the case. Four neighbors spoke in opposition to the rezoning; citing problems with parking and the increase in density which the project would create. The Zoning Committee recommended denial of the RM-3 zoning but approval of the rezoning to RM-2 on a vote of 5-0. The Planning Commission considered the Zoning Committee's recommendation on March 27, 1981 , and voted 16-2 to approve the rezoning to RM,-2. The matter of the requested rezoning is scheduled to be heard by the City Council on April 23, 1981 . Daykin showed slides of the site and reviewed her staff report with a recommendation for denial of the RM-3 but recommended approval of rezoning to RM-2. District 8 Council supports the project. Ken Mahel , 6100 Green Valley Dr. , Bloomington, technical consultant represer.ting United l,lay, presented their position on the property. He stated that Mr. Keuhn's proposal to convert the building to a resideritial use would be a desirable asset to the neighborhood. David Keuhn, 265 Fort Road, reported that they had a very good response from the neighbors in signing the petition; they met with District 8 and they support the project. He also indicated that he a�as in agreement with an Rf�1-2 rezoning. Larry Mazzitello, 770 Holly, stated 'that he did not oppose the concept of the project but was concerned with density and parking. He said that parking is already a critical problem in the area. John Meyer, speaking on behalf of Clara Meyer, 763 Holly, stated her opposition. Tiie proposed parking iot would be immediately adjacent to her property and t�►ould adversely affect her property and would deteriorate in value. Carolyn Rusch, 771 Ashland, spoke in opposition to the density o-F the property. She indicated that the synagogue located directly behind the property in question is also going to be requesting a rezoning to allow a density of 15 to 18 units. She asked that the Committee consider what is going to be happening in terms of parking and how this will change the neighborhood. Martha Cobb,. 774 Holly, spoke in opposition to the rezoning because of the traffic activity in and out of the parking lot all hours of the night. Coi°rine Cofax, 763 Holly, stated that all the living quarters are on the east side of the house that would face the pr.apos�d parking lot. - Pamela Sudheimer, 443 Holly, copartner in the project, testified that she did talk with ��rs. Meyers about the potential problem of the cars being so close to her dining room windows.
