The property has a history which is pertinent to the rezoning. In 1962, Florentina Bubb was issued a building permit to construct a single family dwelling on the site. Construction was stopped in 1964 because a three-plex was being built on the site. Mr. Bubb then applied to the Board of Zoning for a lot area variance to complete construction of the house as a duplex. In December 1965, the Board of Zoning and the City Council denied the variance request. Assessor's records indicate 3 units were �n place by 1967 , in violation of City Council 's denial of the variance. The property does not have non-conforming status since the units were established illegally after August 24, 1964. The Zoning Committee conducted a public hearing on August 6, 1981 . One letter was received from a neighbor at 590 Concord stating opposition to the rezoning. A neighbor living at 492 E. Curtice testified in opposition to the rezoning. The Zoning Committee voted 5-0 to deny the rezoning. The Planning Commission considered the Zoning Committee's recommendation on August 14, 1981 , and voted 12-0 to deny the rezoning. The rezoning request is scheduled to be heard by the City Council on September 10, 1981 . Twelve parcels were eligible to sign the petition; 8 were needed; and 11 were obtained. C. SITE & AREA CONDITIONS: The parcel is irregularly shaped, with a frontage of 62' on Concord and an approximate area of 4,950 sq. ft. The site is occupied by a 2-story three-plex. Single family and duplex homes are located to the north, south and west. Lafayette Freeway is located 2 blocks west of the site. Industrial land uses are located east of the site across Concord. D. ZONING HISTORY: The site was zoned "C" Residence from 1922 until 1975, when it was � designated R-4. On May 23, 1962, Florentina �ubb was issued a building permit to construct a single family dwelling on the site. At that time, a lot size of 6000 sq. ft. was required for the first 2 units, plus 900 sq. ft. for eaeh additional unit. The Board of Zoning and the City Council denied the variance request, 6ased on findings that the hardship was self-created and not the fault of unusual circumstances; a single-fami1y dwelling could be constructed to meet the require- ments of the Zoning Code; and the purpose and intent of the Zoning Code would not be upheld by granting the appeal . Assessor's records indicate 3 units were in place by 1967 , in violation of City Council 's denial of the variance. E. FINDINGS: 1 . The applicant is attempting to rezone the site to RM-2, ratner than a more restrictive zone, because of the number of rooms in the structure in relationship to the small lot size. The structure has a room count of 8 (2 2-bedroom units and 1 1-bedroom unit) . 2. A minimum lot size of 10,000 sq. ft. is required for 3 units. t�lith a lot size of 4950 sq. ft. , the applicant would need an extreme lot size variance to allow the _ structure to be used as a 3-plex. 3. The District 3 Plan states that "overcrowding on land is a problem in scattered areas throughout the community. Narrow a n d u n d e r s i z ed lots are the principal causes of inadequate yard space for recreational purposes and off-street parking." �.p.9) •. .- One of the Plan' s recommendations is to "2. The Land Use Plan (p.24) states that the city will establish criteria to determine when to allow large house conversions. Ms. Daykin showed slides of the site and reviewed the staff findings with a recommendation for denial . One letter was received in opposition; no district camment was submitted. Ms. Lane reported that the 3 units were discovered at the time of the certificate of occupancy inspection. The Building Department checked the Assessor'sRecords before the certificate of occupanc,v .inspection was made and thev indicated there were 3 units since 1967. Ed Messenger, 965 So. Robert, attorney representing the applicants , stated that the structure has an actual room count of 11 rooms , and not 8 rooms under the Zoning Ordinance definition of room count; two bedrooms in each unit upstairs and l bedroom in the lower unit. He said the problem goes back to the early or middle 60s. The applicants are two different individuals ; the fee owner and the contract buyer. Mr. Thomas acquired the property in 1979 unaware of any problems and subsequently sold the property to Mr. Taylor. As a result of the transfers , the problem was discovered and now the applicants are trying , to remedy the situation. The design of the building as far as they know for many years has been a 3-plex. The upper units are separate with a stairs down the middle of the building. For practical purposes , it would be impossible to make the upper units into a 1-unit apartment. He also mentioned that there are two garage stalls and more than adequate parking space. The appearance of the structure is similar or at least comparable to the other houses in the area. They have had no opposition from the neighbors other than the 1 letter received by staff. The County Assessor's Rec�rds indicate that the structure was a duplex in 1962 and in 1964 they indicate 3 units . " George Rosenberger, 492 E. Curtis , expressed concern that if the rezoning were approved, it might be an opening for something else to come in later on. Mr. Messenger commented that there is no intention to expand the structure; they are just ask�ng to continue a use that has apparently been there for 15 years. Hearing no further testimony, Mr. Bryan closed the public hearing portion of the meeting. Mr. Lanegran made a motion to recommend denial of the rezoning based on findings 2 through 6 of the staff report. Mr. Levy seconded the motion. The motion passed on a roll call vote of 5 to 0.
