On October 15, 1981 , the Zoning Committee conducted a public hearinq on the case. A representative of the District 5 Planning Council testified and requested the matter be laid over to allow for review of the project's site plan. Two letters were received in opposition to the rezoning. The Zoning Committee voted 3 to 0 to approve the rezoninc�. Subsequently, the District Council met with the applicant and submitted a letter supporting the rezoning and the vacation of Idaho between Westminster and I-35E. The Planning Commission considered the Zoning Committee's recommendation on October 23, 1981 , and voted 18 to 0 to recommend approval of the rezoning. On October 28, 1981 , the Public Works Committee of the City Council conducted a public hearing on the rezoning and the street vacation. No one testified at the public hearing. One letter, containing signatures of 10 property owners, was received in opposition to the rezoninq and the street vacation. The Public Works Committee voted 3 to 0 to recommend approval of the street vacation. The requested rezoning is scheduled to be heard by the City Council on November 10, 1981 . Surrounding land uses include single-family houses to the north, R-3; single-fami�y houses and medium density apartments to the south, RM-2; I-35 to the west; and a �omnercial , 6-3, district to the imrnediate northwest. A slope to the west buffers the site f om I-35. E. ZONING HISTORY; The site was zoned "A" residence from 1922 until 1975, �when it w�s des�gnated -3, single-family residential . � F. FINDINGS: j T---- l . The site is part of a 15 lot development on Sloan between Hoyt and Idaho, RM-�. The Board of Zoning Appeals granted front yard setback and minimum lot area variahces for three lots in the RM-2 district on September 22, 1981 . 2. The site plan indicates six off-street parking spaces will be provided, 1� pajrking spaces per unit, which meets the Zoning Ordinance parking requirement. 3. The rezoning is in conformance with the Housinq Plan. The Housing Plan enco�rages a more efficient use of land resources for housing development by encouragin, the development of inedium density housing on sites adjacent to traffic corridorsiand on larger vacant or underutilized sites within build up or developinq city neigtiborhoods (Policy 1-5, p.6) . ' 4. The rezoning is in conformance with the Land Use Plan. The Land Use Plan st�tes: "On those large vacant sites suitable for residential use, the City will enc�urage medium density housinQ development" (Policy 4.1-3, p.23) . i 5. Two letters were received in opposition - from property owners at 326 Wheelock and 597 Westminster. A letter was also received from District 5 requesting the matter be laid over to allow time to review the revised site plan. . . John Sauro, 466 Bayview Drive, stated that there is not good accessibility � to the site and with Idaho vacated and Sloan not going through, there would probably be no other use for the land other than the proposed rezoning use. Pat Sullivan, representing District 5, requested the matter be laid over. If it were not laid over, the Council would be in opposition to the rezoning until they have had an opportunity to review the current site plan. Hearing no further testimony, Mr. Bryan closed the public hearing portion of the meeting. Hughes Construction Co. on Ocotber 20th at their monthl,y board meeting . Mr . Hughes presented the plans for the devel;op- ment on �Sloan and Hoyt and gave some details as to the hist�ory of this project with regard to site plan changes, street and; alley vacations and rezoning . 1111 11 Council members had an opportunity to ask questions and consjider �-J the impact the total development would have on the single �amily � homes in the vicinity - particularily with regard to the moslt recent addition of two 4-plex units to the project. ' On October 15, 1981 , the Zoning Committee conducted a public hearing on the case. A representative of the District 5 Planning Council testified and requested the matter be laid over to allow for review of the project's site plan. Two letters were received in opposition to the rezoning. The Zoning Committee voted 3 to 0 to approve the rezoninc�. Subsequently, the District Council met with the applicant and submitted a letter supporting the rezoning and the vacation of Idaho between Westminster and I-35E. The Planning Commission considered the Zoning Committee's recommendation on October 23, 1981 , and voted 18 to 0 to recommend approval of the rezoning, I On October 28, 1981 , the Public Works Corrnnittee of the City Council conducted a public hearing on the rezoninq and the street vacation. No one testified at the public hearing. One letter, containing signatures of 10 property i owners, was �received in opposition to the rezoninq and the str�et vacation. The Public Works Corr�nittee voted 3 to 0 to recommend approval of the street vacation. The requested reioning is scheduled to be heard by the City Council on November 10, 1981 . Two letters were received in opposition - from property owners at 326 Wheelock and 597 Westminster. A letter was also received from District 5 requesting the matter be laid over to allow time to review the revised site plan. . John Sauro, 466 Bayview Drive, stated that there is not good accessibility � to the site and with Idaho vacated and Sloan not going through, there would ' probably be no other use for the land other than the proposed rezoning use. Pat Sullivan, representing District 5, requested the matter be laid over. , If it were not laid over, the Council would be in opposition to the rezoning until they have had an opportunity to review the current site plan.' Hearing no further testimony, Mr. Bryan closed the public hearing portion of the meeting. Mr. Lanegran made a motion to recomnend approval of the rezonina based on findings 2 through 5 of the staff report. Mr. Armstead seconded the motion. The motion passed on a roll call vote of 3 to 0.
