An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City ot Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes �462.357 and §G4 .210
of the Legislative Code, the Iiousing and Redevelopment l�uthority of
the City of Saint Paul duly petit�oned to rezone Part of Lot 6,
Auditor ' s Subdivision No. 55 ancl Tract C, Register Land Survey No.
246, locate� on the north side of Upper Afton Road between Sigurd
and Flandrau, from R-2 to RT-2 for the purpose of constructing 15
townhouse units, the petition having been certified by the Depart-
ment of Finance and rTanageMent Services on December 10, 1981 as
having been consented to by at least 67$ of the owners of the area
of the property to be rezoned, and further having been consented
to by at least two-thirds of the owners of the property situated
within 100 feet of the total contiguous cescriptions of real estate
held by the same owner or any party purchasing any such contiguous
nroperty within one year preceding the date of the netition; and
WHEREAS, The current Zoning Cor�uttittee on January 7, 1982
conducted a public hearing for the purpose of consic:ering the
rezoning petition, anu pursuant to �ection 107.03 of the Admini-
strative Code, submitte� its recommenciation to the Planning Com-
mission that the petition be granted; ancl

PURPOSE: This letter is written in response to the petition of the
Hous ni g & Redevelopment Authority to rezone property described as
the Upper Afton School Site located on the north side of Upper Afton
Road between Sigurd and Flandrau from R-2. (single family residential )
to RT-2 (townhouse residential } to allow construction of 15 townhouse
units.
ZONING COMMITTEE RECOMMENDATION: On January 7, 1982, the ?oning Committee
voted 6 to 0 to recommend aparoval of the rezoninq.
PLANPJIfJC COMMISSION DECISION: On January 8, 1982, the Plannin� Commission
considered the Zoning Committee's recommendation and voted 20 to 0 to
approve the rezoning.
STAFF RECOMMENDATION: Approval of the rezoning based on findinas 2 throuah
7 of the attached staff report. �
SUPPORT: None
OPPOSITION: Two property owners testified in opposition.
The rezoning is scheduled to be heard by the City Council on January 28,
1982. Please notify me by January 27 if any member of the Council wishes
to have slides of the site presented at the public hearing.

B. SUFFICIENCY: The rezoning petition was declar�e elifiblentobsignethenpetetDonarl8ewere

required; and 25 were obtained:
C. PARCEL SIZE: The parcel has irregular double frontages on Upper Afton Road and Leone
Avenue; the total area of the parcel is approximately 101 ,500 square. feet.
D. EXISTING LAND USE: Vacant lot. A ridge runs along the east portion of the site; there
is a natural ponding area on the northe�st corner of the site.
E. SURROUNDING LAND USE:
North/East/West - Single family residential (R-2)
South - Sin�le family residential (R-1 )
F. ZONING HISTORY: The site was zoned "A" Residence from 1922 to 1975 when it was
esignate R-2.
G. FINDINGS: i�
1 . The proposed development would create k�townhouse units. The units would
contain two bedrooms with the possibility for expansion to three bedrooms.
2. The site is approximately 100,200 sq. ft. (2 1/3 acres) in area. A parcel this
size permits a room count of 91 rooms in an RT-2 zoning district. The room count
for the proposed � three-bedroom units is �o rooms which meets the density
requirement. �
3. The preliminary site plan indicates 24 parking spaces will be provided, which
meets the Zoning Code parking requirement.
4. The rezoninq is in conformance with the Land Use component of the Comprehensive
Plan. The Land Use Plan states (p.35) that the "City will develop and implement .
changes in the zoning ordinance which allow more flexibility in the recycling of
vacated institutional lands and buildinas for uses appropriate to the site and
compatible with the surrounding land uses.°
5. The Land Use Plan also states, "On scattered vacant sites in existinq neiqhborhoods ,�"
the City will allow new housing development at densities somewhat hiqher than the
existing zoning but compatible with the general existinq pattern of development"
(p.23) .
6. The rezoning is in conformance with the Housing Component of the Comprehensive Plan
which states, "The City wili encourage the deve7opment of inedium density housinq
consisting of townhouses on sites adjacent to neighborhood commercial areas ,
traffic corridors and larger vacant and underutilized sites within both built-up
and developing City neighborhoods" (p.6) .
7. The rezoning is compatible with surrounding land uses and will not create disharmony
between existing land uses.
H, STAFF RECOMMENDATION: Based on findings 2 thraugh 7 , staff recommends approval of

Ms. Beseman, Ms. James , and Ms. Von Mosch of the Planning Division
Staff.

The meeting was chaired by Joseph Pangal , Vice-Chairman.
� HOUSING & REDEVELOPMENT AUTHORITY (#9081 � : Petition to rezone from R-2 to
RT-2 to allow construction of 15 townhouse units located at the Upper Afton
School site.
The applicant was present. There was opposition present at the hearing.
Ms. Von Mosch showed slides of the site and reviewed the staff report with a
recommendation for approval .
John Wenker reported that the development proposal has gone through a lengthy
negotiation process with the surrounding residents and has been approved by
them and the District 1 Planning Council .
Daniel Tacheny, 1645 Upper Afton Road, spoke in opposition stating that
15 townhouse units would not be consistent with the existing neighborhood.
He felt the proposal was only for economic gain and would not enhance the
neighborhood.
Mr. Pangal asked Mr. Tacheny if he had talked with anyone from District 1?
Mr. Tacheny indicated that he had not been contacted by anyone from the District.
Melvin Conover, 1649 Upper Afton Raod, commented that he would like to see
somthing done with the property but did not feel the residents would like to
have townhouses in the neighborhood especially if it were government housinq.
Steve Keller, 1584 Leone, reported that the residents have aareed with the
developer and all of the ramifications have been decided upon through the
different meetings the neighborhood has gone through.
Mr. Wenker stated that there has been neighborhood wareness of the process
that has been going on with the site. Since Auqust of 1980, r�eetings have
been taking place and the proposal is the efforts of the negotiating process.
He also commented that this would be owner-occupied housing and not any type
of rental housing.
Hearing no further testimony, Mr. Pangal closed the public hearing portion of
the meeting.
Mr. Lanegran made a motion to recommend approval of the rezoning based on
findings 2 through 7 of the staff report. Ms. Summers seconded the motion.
The motion passed on a roil call vote of 6 to 0.
